M., with the following Council Members present at roll call: Trustee Jorvig Trustee Perkins Clerk Justad Mayor Erickson Study Rezoning • A study of the rezoning request of Morten Arneson and S. J. Rutherford was made on the grounds, and the Committee was. asked to bring in their report. Bid awarded for Grading and Graveling - A tabulation prepared by Village Engineer, J . C. Utton, of the bids received August 22, 1949, for grading and graveling (Jobs 0-21 to 0-100, incl.), and his recommendation for the award of same, was read. • - On motion of Trustee Perkins, seconded by Trustee Jorvig, the bid of Terry Excavating Company received August 22, 1949, for grading and graveling - Jobs 0-21 to 0-100, incl. in the amount of $24,538.26 was determined to be the lowest bid of a responsible bidder, and the Mayor and Clerk are hereby authorized to enter into a contract in behalf of the Village. for same in the amount bid (.$24,538.26) . Motionwaspassed by unanimous, vote of Council Members present. Resolution • On motion of Trustee Perkins, seconded by Clerk Justad, the following resolution was adopted by unanimous vote of Council Members present: • RESOLUTION AUTHORIZING EXECUTION OF QUIT CLAIM DEED WHEREAS, it appears that under date of April 29, 1946, Tecla I. Oas and Reider Oas conveyed to the Village the North 30 feet of Lots 21 to 24, inclusive, Black 156, Rearrangement of St. Louis Park, for street purposes, their intention being to rededicate the South Half of Division Street which had been vacated by the Village Council December 19, 1934, and, • WHEREAS, it appears that the question has been raised as to ambiguity in X the description of the property conveyed to the Village by said deed, and the present record owners, Leonard Swedlung and Stanley A. Ecklund having tendered a deed to the Village conveying the South Half of Division Street as previously vacated, adjacent to said lots, and it apprear to the Council that the Village reoonveyed the North 30 feet of said lots to said record owners, therefore, • BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the Mayor and Clerk be hereby authorized to execute and deliver quit claim deed of the Village conveying the North 30 feet of Lots 22, 23, and 24, Block 156, Re- arrangement of St. Louis Park to Leonard Swedlung and Stanley A. Ecklund and the said deed tendered by them to the Village is hereby accepted. Meeting Adjourned • The meeting was adjourned by Mayor Erickson at 6:30 P. Electrical Ohleen Dairy Milk Trucks (3) 1.56PO September 6, 1949 L 1 National Lead Odors Mayor Erickson made an oral report of the conference had with representa- tives of the National Lead Company with regard to disagreeable odors coming from their plant. George Williams added a few remarks. It was suggested that action be deferred until a letter of explanation is received this week, indicating what the Company' s plans are to obliterate the obnoxious odors. If a letter is not received by September 12, 1949, the matter will be brought up again. It was also suggested that the Building and Heating Inspectors be instructed to. check what is being done. Storm Sewer Hearing Date Set On motion of Trustee Perkins, seconded.by Trustee Bolmgren, September 26, 1949 was set as date- for hearing for construction of storm sewer in 22nd Street from Jersey to Louisiana Avenues; also in 28th Street from Xenwood to Vernon Avenues, by unanimous vote of the Council. Bonds On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following bonds were approved by unanimous vote of Council Members present: CONTRACTORS BOND with Fitzgerald Brothers of Minneapolis, Minnesota as principal and American Casualty Company of Reading, Penn. as surety, dated August 25, 1949, in the amount of $10,559.52, covering construction of curb and gutter - Improvements 0-92, 0-106 and 0-110. CONTRACTORS BOND with Terry Excavating Company of St. Louis Park as principal and New York Casualty Company, New York as surety, dated August 29, 1949, in the amount of $24,538.26, covering Grading and Graveling of Texas Avenue and other Streets in the Village of St. Louis Park. September 6, 1949 Regional Meeting - League of Minn. Municipalities On motion of Trustee Bolmgren, seconded by Clerk Justad, the Members of the Village Council, Village Engineer and Village Attorney were authorized to attend the regional meeting of the Minnesota League of Municipalities to be held at Chaska, Minnesota on September 29, 1949, with necessary expenses paid. Motion was passed by unanimous vote of the Council. Letter from Gas Co. Re: Gas Mains in Cedar Lake Road Area. On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Clerk was instructed to send a copy of letter dated August 29, 1949 from the Minneapolis Gas Company regarding the extension of gas mains to serve 6114 Cedar Lake Road and others to Mr. Ben Lewis at 6114 Cedar Lake Road. Motion was passed by un- animous vote of the Council. Planning Commission Report - Rezoning The following report from,the Planning Commission, dated September 3, 1949 was read. No action taken. "The Planning Commission considered the above petition. There were many features about it that were vague and not definitely set, and it represented a decided change for the neighborhood. There were a number of the residents living on Webster Avenue who were present and indicated their objections to the change in zoning. The accompanying petition presented by them is enclosed. The Planning Commission recommends that the above petition of Mr. Glen Woodmark and Motley Berman be denied at this time by reason that there are not sufficient facts appearing from petition, plans, and hearing from which the Planning Commission could recommend a rezoning which would apparently make a drastic change in the neighborhood and the zoning already established. Rezoning Approved (Arneson & Rutherford Property On August 22, 1949, the Committee of the Whole made a check on the premises of Morton Arneson and S. J. Rutherford in connection with their request for re- "' zoning. After some discussion, it was decided to recommend that the change in zoning be made as requested. Motion was passed by unanimous vote of the Council. Bid Awarded - Water Meters On motion of Trustee Bolmgren, seconded by Trustee Perkins, the bid of Badger Meter Mfg. Company, Milwaukee, Wisconsin, received August 22, 1949, for furnishing 556 water meters, was determined to be the lowest bid of a responsible bidder, and the Clerk is hereby authorized to issue purchase order for same at the amount bid - $11,401.80. Motion was passed by unanimous vote of the Council. III Bids_.For __ Copperhorns and Corporation Stops _0n motion of Trustee Bolmgren, seconded by Trustee Jorvig, the bids )received on August 22, 1949 for the furnishing copperhorns and corporation stops were re- ferred back to the Water Department Committee for further consideration and recom- mendation, by unanimous vote of the Council. Bid Awarded - Sanitary Sewer No. 1-S A tabulation made by Village Engineer, J. C. Utton, of bids received on August 22, 1949, for the construction of Sanitary Sewer No. 1-S, and his recom- mendation to award the contract to the Phelps-Drake Company, Inc. for same was read. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Phelps-Drake Company, Inc. received August 22, 1949, for the construction of Sanitary Sewer No. 1-S, in the amount of $13,350.75, was deemed to be the lowest bid received from a responsible bidder, and the Mayor and Clerk are hereby authorized to enter into a contract with Phelps-Drake Company, Inc. in behalf of the Village for same in the amount bid (13,350.75), by unanimous vote of the Council. Hearing Date Set for Relief Storm Sewer The following report prepared by Village Engineer, J. C. Utton was read: REPORT ON RELIEF STORM SEWER FOR DAKOTA AVENUE Plans and specifications for a storm sewer to relieve the flood condition on Dakota Avenue between 32nd and 33rd Streets are now ready for bids. After studying several routes, it was decided that a sewer in Edgewood Avenue from - 33rd Street to 27th Street, and on 27th Street from Edge- wood Avenue to Colorado Avenue would be the most feasible and most economical. This proposed sewer will take all the water now emptying into the present sewer in Edgewood Avenue, north of 33rd Street, thus relieving the Dakota Avenue sewer. This additional sewer will take part of the flow of West 31st Street which now empties into the Dakota Avenue sewer. Also the low intersections at West 29th Street and Florida, and West 29th Street and Edgewood can be drained. This work should be started and completed this year, before the sanitary sewer is laid in Edgewood Avenue, the contract for which has already been let. Estimated cost of the proposed storm sewer is $45,000.00. On motion of Trustee Perkins, seconded by Trustee Jorvig, September 26, 1949 was set as date for hearing on the above mentioned sewer, by unanimous vote of the Council.
