Ziegler Co., Inc. 608.00 On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above bids were referred to the Village Engineer and Chairman of the Water Department Com- mittee for tabulation and recommendation, by unanimous vote of the Council. Bid Awarded - Grading On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Park Construction Company received May 23, 1949, for grading and graveling of Street Improvements Nos. N-157-161; N-163-168; N-171-175, was deemed to be the III lowest bid of a responsible bidder, and the President and Clerk are hereby authorized to enter into a written contract with Park Construction Company for same in the amount bid - $15,081.60. Motion was passed by unanimous vote of the Council. Estimates Approved On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following Estimates of contract work in progress, presented by Village Engineer, J. C. Utton, Village Engineer Property for Park Sites On motion of Trustee Jorvig, seconded by Trustee Perkins, the Park Committee was instructed to investigate what is involved to purchase and make a pre- liminary survey of that property North of Blocks 8 and 9, Thorpe Brothers Cedar Lake Heights, known as the Whitmore Tract,. for future Village park sites. Motion was passed by unanimous vote of the Council. Hearing Date Set - Rezoning With •the approval of the Planning Commission, it was moved by Trustee Bolmgren, seconded by Trustee Perkins, that June 27, 1949 be set as date for hearing on the petition of M. Mandel and S. Mandel for the rezoning of Lot 7, Block 1, Fernhill Addition, except the South 81.5 feet of same from Residential Use to Multiple Dwelling Use District; and from "C" Density to "D" Density District. Motion was passed by unanimous vote„of the Council. Push Cart Hawkers License On motion of_Trustee Perkins, seconded by Trustee Bolmgren, Charles B. Piro; June 6, 1949 Push Cart Hawkers License, Cont'd. Koehler, 3233 Holmes Avenue South, Minneapolis (CO 3928) application for a license to sell ice cream, factory packed (Dixie cups) from a push cart from house to house was approved, and the President and Clerk were authorized to_ issue "Hawker's" license to expire December 31, 1949, by unanimous vote of the. Council, at a fee of $10.00. Application for Licenses (E. J. Danielson) On motion of Trustee Perkins, seconded by Trustee Jorvig, the application of E. J. Danielson for licenses to sell Cigarettes, 3.2 Beer On-Sale, 3.2 Beer Off-Saleand operate a Restaurant at 7201 Minnetonka Boulevard was referred to the Committee of the Whole, by unanimous vote of the Council. Permission to Place Poles On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Northern States Power Company was granted permission to place poles at the following locations, by unanimous vote of the Council ----- One (1) pole on Quebec Avenue at 34th Street One (1) pole on Toledo Avenue at 31st Street One (1) pole on Brunswick Avenue between 27th . and 28th Streets One (1) pole on Wooddale Avenue between 35th Street and State Highway #7. . Advertise for Bids - Power Mower On motion of Trustee Jorvig, seconded by Trustee Perkins, the Clerk was authorized to advertise for bids for a power mower for Park Board, according to specifications on file with Village Clerk; bids to be opened June 27, 1949. •Motion was passed by unanimous vote of the Council. Advertise for Bids - Police Car On motion of Trustee Perkins, seconded by Trustee Bolmgren,, the Village Clerk was authorized to advertise for bids on Police Car - bids to be based on a turn in of 1947 car now being used by the Police Department, to be opened June 27, 1949. Motion was passed by unanimous vote of Council Members present. State Fire Fighters Meeting On motion of Trustee Jorvig, seconded by Trustee Bolmgren, six Firemen and Trustee Perkins were authorized to attend the State Fire Fighters Meeting to be held at St. Peter, Minnesota, June 13, 14, 15, 1949, with necessary ex- • penses paid, by unanimous vote of the Council. Licenses On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following applications for 1949 licenses were approved, and the President and Clerk are hereby authorized to issue licenses to expire December 31, 1949, by unanimous vote of Council Members present: Roger M. Carlson Enterprises, Cigarette Koolaire, Incorporated Heating Gas Main Extensions On motion of Trustee Perkins, seconded by Trustee Jorvig, the Minneapolis Gas Company was granted -permission to construct gas mains at the following loca- tions, by unanimous vote of the Council: In Cedar Lake Avenue from Glenhurst Avenue to Lot 1, Block 2, Cedarhurst Addition. In Kentucky Avenue from 4' S. S. Line of West 28th Street to West 27th Street. - In West Sunset Boulevard from Huntington - Avenue to Lot 14 and E. 40' Lot 15, Block 7, Sunset Gables 2nd Addition. [ June 6, 1949 Hearing Date Set - Water Mains On motion of Trustee Bolmgren, seconded by Trustee Jorvig, June 27, 1949 was set as date of hearing on the following water main extensions, by unani- mous vote of the Council: Jersey Avenue from West 26th Street to West 27th Street Kentucky Avenue from West 26th Street to West 27th Street West 26th Street from Kentucky Avenue to Hampshire Avenue Hampshire Avenue from West 26th Street to West 27th Street. Deposit - Traffic Control Signals . On motion of Trustee Perkins, seconded by Trustee Bolmgren, the statement for deposit required to cover an amount equal to one-half of the cost of the installation of Traffic Control Signals on Trunk Highway #100 & #169 and 41stIII Street South, St. Louis Park - S. P. #2734-02 T. H. #100, Agreement # C-582, was approved, and the President and Clerk are hereby authorized to issue warrant for same, by unanimous vote of the Council. Opinion Re: Re-opening Gorhan Avenue On motion of Trustee Jorvig, seconded by Trustee Perkins, the Village Engineer was requested to get an opinion from the State Highway Department as to the feasibility of re-opening Gorham Avenue into State Highway #7, by unanimous vote of the Council. Continuation of Monterey Avenue-28th to 27th Streets Upon the recommendation of the Planning Commission, it was moved by Trustee Plerkins, seconded by Trustee Jorvig that the. Village Engineer be ins- tructed to prepare plans and estimate cost of the continuation of Monterey Avenue from 28th Street to 27th Street, by unanimous vote of the Council. Extension of Brookside Bus Service On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was instructed to write to the Twin City Rapid Transit Company for an extension of Brookside Bus Service to be routed North on Alabama Avenue to 36th Street, by unanimous vote of the Council. Permanent Playground - 25th & Monterey . A petition signed by J. J. Mc Tague and others, dated June 1, 1949 III regarding a permanent playground at 25th. Street and Monterey•Avenue, was read. On motion of Trustee Jorvig, seconded by Trustee Perkins, the Village Attorney was ordered to start negotiations for the purchase of the balance of lots (37 to 44 inclusive), Block 9, Thorpe_ Brothers Cedar Lake Heights Addition not owned by the Village, for park purposes. Motion was passed by unanimous vote of the Council. _ . Purchase of Property Authorized On motion of Clerk Justad, seconded by Trustee Bolmgren, the Village Attorney was instructed to megotiate for the purchase of property for the ex- tension of 27th Street East of Raleigh Avenue to connect with 27th Street, run- ning West from Quentin Avenue. Motion was passed by unanimous vote of the Council. Legal Opinion Re: Vacations (R. Senander) ,On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Village Attorney was instructed to give an opinion as to pay for vacations earned by Richard Senander while he was in the U. S. Marine Corps - 11-26-45 to 11-25-48, 1 • by unanimous vote of the Council. _ t Hearing Canceled - Rezoning At the request of Chester Thompson, it was moved by Trustee Bolmgren, seconded by Trustee Perkins, that the hearing scheduled for June 13, 1949 on his application to rezone from "Co Density to "D" Density, Lots 8 and 9, Block 2, Minikanda Vista Second Addition known at 3740 Kipling Avenue, to permit the construction of an eleven unit apartment building, was canceled; and the Clerk was instructed to bill Chester Thompson for the expense incurred for advertising of hearing and notification of property owners in vicinity of proposed build- ing site. Motion was passed by unanimous vote of the Council. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of the Council: RESOLUTION CANCELING PORTION OF WATER MAIN ASSESSMENT WHEREAS, it appears to the Village Council and it adopted a resolution levying-an assessment for water main extension No. L-95 from Yosemite Avenue and June 6, 1949 79 Resolution Canceling Portion of Water Main Assessment, Conttd. Hamilton south across Highway No. 7 to the property of Good Foods, Incorporated, in the total sum of $3,644.76 of which the sum of $3,044.76 was levied against property of Good Foods, Incorporated, and WHEREAS, complaint has been received from Good Foods, Incorporated, with respect to the amount of said assessment, and it appears to the Council that there is some question as to whether the assessment is in excess of the benefit received by the property assessed because a substantial portion of the cost consisted of the expense of extending the water main under state highway property, which portion of the cost should be charged to the general water fund, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that assessment levied by said resolution against the following described property in the sum of -$3,044.76 be hereby adjusted and reduced to the sum of $2,049.19, payable in ten equal annual installments with interest at 5% per annum concurrent- ly with general taxes commencing with taxes payable in the year 1950; that the property above referred to is described as follows: Sec. 16, Twp. 117, Range 21 Commencing at a point in the Swly. boundary line of Auditors Subdivision 249 a distance 29 feet Nwly. measured at right angles from the Nly. R/W of the M. and St. L. Railway, said point of beginning being 79 feet Nwly at right angles from the center line of the S. bound track of said Railroad; thence Swly. para- llel with the Nly. -line of said R/W 600 feet; thence at right angles Nwly. 166.5 more or less, to the SEly.
