SPECIAL MEETING MAY 9, 1949
A meeting of the Village Council was called to order by President
Erickson at 8:15 P. M., with the following Council Members present at roll call:

The minutes of meeting held May 2, 1949 were read and approved as read.
Verified Claims
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
verified claims were approved, and the President and Clerk are hereby authorized
to issue warrants covering same, by unanimous vote of Council Members present,

On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above bids
were referred to the Village Engineer and Chairman of the Street Department Com-
' mittee, for checking and recommendation, by unanimous vote of the Council
Bid Awarded - Curb & Gutter Construction
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, upon the recom-
mendation of the Village Engineer and Chairman of the Street Department Committee,
the bid of George Madsen, dated May 2, 1949 for the construction of curb and gutter
improvements numbered N-144 to N-146, inclusive,. in the amount of $13,152.84 was
determined to be the lowest bid of a -responsible bidder, and the President and
Clerk are hereby authorized to inter into a written contract with George Madsen
for the construction of curb and gutter improvements numbered N-144 to N-156, in-
clusive, at price bid, by unanimous vote of the Council.

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
applications for 1949 licenses were approved, and the President and Clerk are here-
by authorized to issue licenses to expire December 31, 1949, by unanimous vote of

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
bonds were approved, by unanimous vote of the Council
PLUMBING LICENSE BOND with A. W. Greening
of Minneapolis as principal, and Commercial
Casualty Insurance Company of Newark, N. J.,
as surety, dated May 2, 1949, in the amount
of $4,000.00.

On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Minneapolis
Gas Company was granted permission to construct gas mains as follows --- by un-

Apartment Houses
Ralph Wormsecker of the Donovan Construction Company, 1725 Carroll Avenue

Apartment Houses, Cont'd.
St. Paul, (NE 7331) told the Village Council that he was interested in building
40 apartment houses with approximately 400 units on the property West of
Minnehaha Creek and North of Excelsior Boulevard. It was suggested that he
contact Morton Arneson, Chairman of the Planning Commission and request a special
hearing before the Commission in order to save time. He was referred to the
Village Engineer to answer his inquiry about sewer and water services.
Miniature Golf Course
Mr. Wessner, 2927 Huntington Avenue and others asked about the operation
of the Miniature Golf Course at Huntington Avenue and West Lake Street. They said
it was their understanding that the 1948 season would be the last season this
course would be in operation. It has been a continuous source of annoyance to
the neighbors. The members of the Village Council agreed that it was also their
understanding that the operation of this course would terminate with the 1948
season, and as there is no permit required at the present time for the operation
of Miniature Golf Courses, it was moved by Trustee Bolmgren,'seconded by Trustee
Perkins, that the Village Attorney be instructed to prepare an ordinance to
regulate the operation of Miniature Golf Courses and Driving Tees and providing
for permits for the operation thereof. Motion was passed by unanimous vote of
the Council.
Annual Convention, League of Minn. Municipalities
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Village
Attorney, Village Engineer and Members of the Village Council were authorized to
attend the annual convention of the League of Minnesota Municipalities at Hibbing,
Minnesota, June 9, 10, and 11, 1949, with necessary expenses paid, by unanimous
vote of the Council.
Thank You Letter - Minikanda Oaks Assn.
A letter from the Minikanda Oaks Association, dated April 13, 1949, express-
ing their appreciation to the Village Council and Park Board for providing a
skating rink in the Minikanda Oaks area during the past winter season, was read
and ordered filed.
Sidewalk - Excelsior Blvd. from Brookside to Hghy. #100
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the sidewalk
project for Excelsior Boulevard from Brookside Avenue to Highway #100 as suggested
by Nate La Due at May 2, 1949 meeting was, ordered tabled until after the new- T
Village Code is in effect; also bring the matter to the Council' s attention on
July 11, 1949 meeting. Motion was passed by unanimous vote of the Council.
Permit for Underground Gasoline Storage Tanks
On motion of Trustee Bolmgren, Seconded by Trustee Jorvig, the application
of George T. Butler for permission to install One (1) 6,000, and One (1) 8,000
gallon underground gasoline storage tanks was approved, and the President and
Clerk are hereby authorized to issue permit for same to be installed on property
at 7000 West Lake Street; also the Fire Department is to inspect same. Motion
was passed by unanimous vote of the _Council.
Re solution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of the Council:
RESOLUTION AWARDING_BITUMINOUS PLANT MIX CONTRACT
WHEREAS, the Village Council has duly received bids for furnishing bitumi-
nous plant mix pursuant to public advertisement for bids, and bids have been
received from Glenn Johnson and J. V. Gleason and others, and,
WHEREAS, it appears that the bid of Glenn Johnson at $4.10 is the lowest
bid but that said bidder submitted special specifications, and the bid of J . V.
Gleason was the next lowest bid and is in accordance with the required specifi- ,
cations, and,
WHEREAS, it appears to the Council that said Glenn Johnson will be unable
to furnish the full Village requirements of bituminous plant mix and that during
some days the Village requirements will be in excess of the supply available
from J. V. Gleason, therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
the said J. V. Gleason's bid for bituminous plant mix at $4.30 be hereby accepted
and the President and Clerk be authorized to enter into contract with him in
behalf of the Village for furnishing Village requirements during the coming season,
reserving the right of the Village to purchase part of its requirements else-
where, and,

Resolution, Bituminous Plant Mix, Cont'd.
BE IT FURTHER RESOLVED that the President and Clerk be authorized to enter
into a contract with said Glenn Johnson for furnishing said bituminous plant
mix in accordance with specifications submitted with his bid at $4.10, purchases
to be made from Glenn Johnson at the discretion of the Street Commissioner.
C. L. Dickinson, Janitor
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the motion
passed by the Village Council on January 24, 1949 regarding the eleven months
per year employment of C. L. Dickinson was recinded,- and he was put back on a
twelve month basis at $150.00 per month with two weeks vacation with pay. Motion
was passed by unanimous vote of the Council.
Proceed with Grading
On motion of, Trustee Bolmgren, seconded by Trustee Jorvig, Terry Brothers
Excavating Company was authorized to proceed with the grading of Monterey Avenue
from 26th to 27th Streets; and 26th Street from Lynn to Natchez Avenues accord-
ing to contract dated October 4, 1948, the work on these streets having been held
up by the Village Council on October 25, 1948 because of lateness of season and
condition of soil. Motion was passed by unanimous vote of the Council.

Hearing Date Set - Street Vacation
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, June 6, 1949
was set as date for hearing on the Petition of Frank S. Lamson and others, for
the vacation of street adjacent to Block 66-A, and Lots 24 to 30, inclusive,
Block 155, Rearrangement of St. Louis Park, by unanimous vote of the Council.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of the Council:
Resolution Canceling Sanitary Sewer District #1-0
BE IT RESOLVED by the Village Council of the Village of St. Louis Park,
that the following assessments levied pursuant to resolution adopted October 11,
1948, be hereby canceled for the reason that he has been previously been assessed
for Sanitary Sewer District #1-F.
BE IT FURTHER RESOLVED that the following assessment, levied pursuant to
resolution adopted October 11, 1948, be hereby canceled, and the Treasurer and
Auditor of Hennepin County are hereby authorized to cancel said assessment on
their respective records -----

Ordinance No. 329
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
ordinance was adopted by unanimous vote of the Council
ORDINANCE NO. 329
AN ORDINANCE AMENDING ORDINANCE NO 67 RELATING
• TO THE SALE OF NON INTOXICATING MALT LIQUOR
Section 1. Ordinance No. 67 entitled "An Ordinance Relating to the sale
of Non Intoxicating Malt Liquor or Beiaerages'! adopted by the Village Council
March 31, 1943, as heretofore amended, is hereby further amended as follows:
Section 11 of said ordinance is hereby amended to read as follows:
Section 11. No "on-sale" or off-sale" licensee for the sale of non-intoxi-
cating malt liquor shall sell any such malt liquor, nor shall any such licensee
serve or permit to be served or consumed on the premises named in the license any
such malt liquor, on any election day between the hours of one o'clock A. M. and
eight o'clock P. M. or on Sunday between -the hours of one o'clock A. M. and twelve
o'clock noon or on any other day between the hours of one o' clock A. M. and eight
o'clock A. M.
Section 2. This ordinance shall take effect from and after its publication.
Two Family Dwelling
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Building
Inspector was authorized to issue a building permit to Allen Garrison for the
construction of a two-family dwelling on Lot 18, Block 4, Meadowbrook Addition,
by unanimous vote of the Council.

Report of Building Inspector - 4616 Mtka. Blvd.
Peter Stienstra reported as follows --- "A check was made at 4616 Mtka.
Boulevard on May 6, 1949 and it was found that (1) outside door and stairway
from rear of basement had been built, (2) the east half of basement has teen
divided into two rooms and a washroom and finished to be used as a beauty parlor,
(3) no permits have been taken out for any of the work.
On motion of Trustee Bolmgren, seconded by Clerk Justad, the Building
Inspector was instructed to notify Annabell Miller, 4616 Minnetonka Boulevard
that she .is violating the Building Code and Zoning Ordinance, by unanimous
vote of the Council.
Request for Sewer
A letter dated May 2, 1949 from Harry E. Fryer, 4508 West 39th Street,
requesting sewer in 39th Street to serve his residence was read. On motion of
Trustee Bolmgren, seconded by Trustee Jorvig, the above request was referred to
the Village Engineer for checking and report, by unanimous vote of the Council.
Request for STOP SIGNS
A request was received from the Village Council of Morningside for :the
placing of STOP SIGNS on Kipling and Lynn Avenues at 40th Street to regulate the
traffic going South on these streets. On motion of Trustee Bolmgren, seconded
by Trustee Jorvig, the above request of Village of Morningside was approved and
the Police Department was instructed to place two STOP SIGNS; one at Kipling and
one at Lynn Avenue, at 40th Street, by unanimous vote of the Council.
Building Permit Denied
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the request of
Mr. Allen Garrison for a permit to erect a two-family dwelling on Lot 17, Block
4, Meadowbrook Addition was denied, by unanimous vote of the Council.
Wage Rate Changed - C. Betley
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the hourly
wage rate for C. Betley was set at $1.75 per hour, and classification to instru-
ment man, effective May 16, 1949. Motion was passed by unanimous vote of the
Council.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of the Council:
RESOLUTION CANCELING GARBAGE COLLECTION ASSESSMENTS
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the following assessments levied pursuant to resolution adopted October 6,
1947, be hereby canceled for the reason that said lands were used either for
business or were vacant lands and were not served by the garbage collection service
of the Village, and the President and Clerk are hereby authorized to refund the
amount paid on receipt of a verified claim signed by the taxpayer:

Resolution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of the Council:
RESOLUTION CANCELING WEED CUTTING ASSESSMENT
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the following assessment, made in 1948 be hereby canceled for the reason that
Weed Destruction was billed in error against the SEly 58' of Lot 1 and Lot 2, and
the NEly 10' of SEly 58' of Lot 3, Block 4, Minikands Vista in the amount of
$3.50; and the President and Clerk are hereby authorized to refund the amount paid
on receipt of a verified claim signed by the taxpayer (Dale Eckers, etal., 3846
Natchez Avenue.
Advertise for Bids - Light Plant
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was
authorized to advertise for bids on a portable electric plant and flood lights as

be opened June 6, 1949. Motion was passed by unanimous vote of the Council.

Raleigh Avenue, Extended
On motion of Trustee Bolmgren, seconded•by Trustee Jorvig, the Clerk was
instructed to secure information as to location of street (Raleigh Avenue, West
of Carpenter Park), both on a profile and on property, by unanimous vote of the
Council.
