Preliminary Plat Approved . On motion of Trustee Perkins, seconded by Trustee Jorvig, the preliminary plat for South Westwood Hills Addition presented by R. H. Mc Nulty and Mr. J. Cattanach, was approved as recommended by the Planning Commission in their report dated May 9, 1949, by unanimous vote of the Council. Ordinance No. 330 On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following Ordinance was adopted by unanimous vote of the Council ----- ORDINANCE NO. 330 AN ORDINANCE REGULATING MINIATURE GOLF COURSES AND DRIVING FAIRWAYS The Village Council of the Village of St. Louis Park do ordain as follows: Section 1. No person shall engage in or manage the business of operating, maintaining, or keeping a miniature golf course or golf driving fairway within the Village of St.-Louis Park without first obtaining from the Village Council a license therefor for each separate location in the Village. Section 2. Applications for such licenses shall be made in writing to the Village Clerk and shall set forth the description of the premises to be licensed, the nature of the business to be carried on, and a description of the equipment and lighting to be used on the premises. Section 3. No license shall be issued until the applicant shall have paid to the Village Treasurer a license fee in the sum of $10.00 for each annual license period or fraction thereof. All such licenses shall expire December 31, of each year. Section 4. (a) Hours of Play. No person owning, operating or conduct- ing a miniature golf course or driving fairway shall allow any person to play or practice on such miniature golf course or driving fairway between the hours of 11 o'clock P. M. of any day and 7 o'clock A. M. of the following day. (b) Hours For Use of Mechanical Devices. No person owning, operating, managing or conducting a miniature golf course or driving fairway shall allow any work or labor with instruments or mechanical devices which are propelled by electric, steam or automotive power, to be performed upon such miniature golf course or driving fairway between the hours of 11 o'clock P. M. of any day and 7 o'clock A. M. of the following day. (c) Noise Signs. Persons owning, operating, managing or conducting a miniature golf course shall place in a conspicuous place on said golf course, at least four (4) signs upon which are written in legible English, in letters at least two (2) inches in height, words or phrases requesting patrons to regrain from loud talking and unnecessary noise at all times while on the golf course. Such signs shall be placed where they can easily be seen by the patrons. (d) Illumination. 0 May 16, 1949 ' C°1 Ordinance No. 330, Cont'd. Section 4 ----- (d) 1. The playing field of a miniature golf course or driving fairway shall not be illuminated between the hours of 11 o'clock P. M. of any day and 7 oIclock A. M. of the following day, except with such illumination as may be necessary only for the proper care and cleaning of such places. 2. The illumination of the playing field of any miniature golf course or driving fairway shall be such that no direct rays from the reflector or source of illumination shall fall upon any portion of any building used for living or sleeping quarters not under the ownership or control of the owner or operator of such golf courses. 3. Where electric lamps are used there shall be installed a reflector of a type that shall not permit any portion of the lamp to project beyond the plane of the opening of the reflector, if the golf course or driving, fairway is located less than four hundred (400) feet from any structure used for dwelling purposes. 4. The provisions of this Section shall not apply to festoons or similar lights, streamers, or assemblies used for advertising or attracting attention to such golf courses, provided that the lamps used therein do not ex- ceed twenty-five (25) watts each and are extinguished between the hours of 10 o'clock P. M. of any day and 7 o'clock A. M. of the following day. (e) Sound Devices. No person shall use, operate or employ any sound amplifying system, radio, or sound producing machine, device or instrument or permit any music of any kind to be played in or upon any miniature golf course or driving fairway. Section 5. No such license shall be granted if the premises are so arranged and operated adjacent to public streets or adjoining property as to be a nuisance to persons upon such public streets or upon such adjoining property by reason of the danger of flying golf balls coming upon such public streets or adjoining property or by reason of noise from or illumination of the licensed premises and any such license granted by the Village Council may be at any time revoked that the Council shall determine that the licensed premises by reason of the operation of the miniature golf course or driving fairway are such a nuisance. Section 6. Any person convicted of violating any provision of this ordinance shall be guilty of a misddemeanor and shall be punished by a fine not to exceed $100.00 or imprisonment not to exceed ninety days. Section 7. This ordinance shall take effect and be enforced from and after its publication. Petition for Curb & Gutter On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the petition signed by Dudley Kobe, 3921 Monterey Avenue and others, dated May 13, 1949, for the construction of curb and gutter on BOTH SIDES OF MONTEREY BETWEEN 39TH AND 40TH STREETS, was referred to the Village Engineer and Chairman of the Street Department Commitee for checking and recommendation, by unanimous vote of`the Council. Fire Insurance On motion of Clerk Justad, seconded by Trustee Jorvig, Fire and Extended Coverage Policy No. 265807, covering house owned by Village at 5627 West 37th Street, St. Louis Park for period of June 6, 1949 to June 6, 1952, in the amount of $3,500.00, furnished by C. L. Hurd Agency, was approved by unanimous vote of the Council. Sewer Bids Rejected - 2-I and 2-J On motion of Trustee Perkins, seconded by Trustee Bolmgren, all bids received May 9, 1949 for the construction of Sanitary sewers 2-I and 2-J were rejected because of the excessive cost that would have to be assumed by the property owners. Motion was passed by unanimous vote of the Council. Bonds On motion of Clerk Justad, seconded by Trustee Bolmgren, the following bonds were approved by unanimous vote of the Council ----- HEATING LICENSE BOND with Oak Knoll Heating and Sheet Metal Company of Minneapolis as prin- cipal, and American Surety Company of New York, New York as surety, dated December 8, 1948, in the amount of $1,000.00. May 16, 1949 61 Bonds, Cont t d. HEATING LICENSE BOND with Grudem Brothers Company, Inc. of St. Paul, Minnesota as principal, and American Surety Company of New York, N. Y. as surety, dated December 8, 1948, in the amount of $1,000.00. Heating License Bond with NW Sheet Metal and Air Conditioning Company of Robbinsdale, Minnesota as principal, and American Surety Company of New York, N. Y. as surety, dated May 5, 1949, in the amount of $1,000.00. Restaurant License On motion of Clerk Justad, seconded by Trustee Bolmgren, the following application for 1949 license was approved, and the President and Clerk are hereby authorized to issue license to expire December 31, 1949, by unanimous vote of the Council (Mrs.) Ann Nelson Restaurant Permission to Place Anchor and Buried Cable On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Northwest- ern Bell Telephone Company was granted 'permission to place one anchor on Colorado Avenue north of 33rd Street and buried cable in 33rd Street from the ally east of Colorado Avenue to Dakota Avenue, by unanimous vote of the Council. Electric Service for Traffic Signals On motion of,Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk is hereby authorized to sign application for commercial electric service for the new traffic control signals at QUEBEC AVENUE AND HIGHWAY NO. 7, and 41ST STREET AND HIGHWAY NO. 100, by unanimous vote of the Council. Bid Awarded - Grading (W. 28th St. from Natchez to Joppa) On the recommendation of the Village Engineer and Chairman of the Street Department Committee, it was moved by Trustee Perkins, seconded by Trustee Bolmgren, that the bid of Terry Brothers Excavating Company in the amount of $4,876.44, for the grading of West 28th Street from Natchez Avenue to Joppa Avenue (received 5-9-49) being the lowest bid of a responsible bidder, be approved and accepted; and the President and Clerk are hereby authorized to enter into a written contract with Terry Brothers Excavating Company for the work in the amount bid, ' by unanimous vote of the Council. Resolution On motion of Trustee, Jorvig, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of all members of the Council RESOLUTION FOR SIDEWALK CONSTRUCTION WHEREAS the Village Council duly adopted a resolution ordering a sidewalk to be reconstructed on the North side of Minnetonka Blvd. adjacent to Lots 7, 8 and 9, Block 2, Sunset Gables Second Addition, which reso- lution was duly served on the owners of said property and, whereas said sidewalk has not been reconstructed, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the Street Commissioner of the Village is hereby authorized and directed to reconstruct sidewalk 5 feet in width on the North side of Minnetonka Boulevard 62 May 16, 1949 C- Resolution, Sidewalk, Cont'd. � adjacent to said Lots 7, 8 and 9, Block 2, Sunset Gables Second Addition, in accordance with standard specifications for Village sidewalks heretofore approved by the Village Council and the costs to be,assessed against property improved. Resolution • On motion of Trustee Perkins, seconded by Trustee Bolmgren, the follow- ing resolution was duly adopted by unanimous vote of all members of the Council present: RESOLUTION SETTING HEARINGS FOR STREET IMPROVEMENTS WHEREAS, the Village Council desires on its own motion to improve the following named streets and alleys within the corporate limits of the Village as authorized by Chapter 382, Laws of 1903, THEREFORE, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that it is necessary and expedient to improve the following portions of existing streets and alleys in said Village by construction of curb and gutter: Improvement - Number Street From To 0-92 E. A separate hearing is to be conducted as to each street to determine whether said improvements or any of them shall be made; that in case said improve- ments or any of them shall be made the total cost thereof or so much thereof as May 16, 1949 63 , Resolution Setting Hearing for Street Improvements, Cont'd. represents the benefits received as determined by said Council will be assessed against the lots, parts of lots, pieces or parcels of land benefited by said improvements. Bid Awarded ' On motion of Trustee Jorvig, seconded by Trustee Holmgren, the bid of Boyer & Gilfillen Motor Company dated April April 28, 1949 for One (1) 1949 Ford ton panel truck at a net total delivery price of '$1,552.57, was determined to be the lowest bid of a responsibld bidder and the Clerk was authorized to issue and order to Boyer & Gilfillen Motor Company for the truck for immediate delivery to Fire Department, by unanimous vote of the Council. Salary Checks On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the President and Clerk were authorized to issue the Village Employees May 31st, 1949 salary checks on May 27th, 1949, by unanimous vote of the Council. No Council Meeting, May 30, 1949 On motion of Trustee Bolmgren, seconded by Trustee Jorvig that no Council Meeting be held May 30, 1949 because of said date being a legal holiday. Motion was passed by unanimous vote of the Council. Board of Directors, Mc Carthy's St. Louis Park Cafe, Inc. The following copy of minutes of a special meeting of the Board of Directors of Mc Carthy's St. Louis Park Cafe, Incorporated showing change in said Board was read and ordered filed SPECIAL MEETING OF THE BOARD OF DIRECTORS OF McCARTHY'S ST. LOUIS PARK CAFE, INC. A special meeting of the Board of Directors of this corporation was held on the 10th day of December, 1948, pursuant to notice, at ten o' clock A. M. of said day, at the registered office of the corporation. The secretary announced that James J. Keefe had submitted his resignation as director and president and treasurer of this corporation and on motion duly made and carried, the said resignation was duly accepted. On motion duly made and carried, Jerimiah Murphy was elected to fill the unexpired term of the said James J. Keefe resigned as director and president and treasurer of this corporation to hold such office until his successor has been duly elected and qualified. Streets Taken Out of Specifications for Grading On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following streets were taken out of specifications for grading that are now up for bidding; bids to be opened May 23, 1949, by unanimous vote of the Council 1. Princeton Avenue from 42nd to Wooddale 2. 14th Street from Louisiana to Hampshire Location of Garage Approved _ A letter from Mrs. Edna L. Damron, 2910 .Pennsylvania Avenue, dated April 13, 19.49, stating that "it is not disagreeable to me in any way for garage at 2906 111 Pennsylvania Avenue to remain where it is, and I hereby give my permission to leave it as it is with no alterations" was read. On motion of Trustee Jorvig, seconded by Trustee Perkins, the location of garage built by Clarence Nix at 2906 Pennsylvania Avenue was approved by unanimous vote of the Council. }Letter Re: Bus Schedules A letter from the Twin City Rapid Transet Company, dated May 12, 1949 was read relative to rearrangement of bus schedule- and additional service to the Oak Hill District was read and a hearing was set for May 23rd, 1949 for interested persons.
