Proposed Plat - Donnybrook Terrace First and Second On motion of Trustee Bolmgf'en, seconded by Clerk Justad, the proposed Plats of Donnybrook Terrace First and Second Additions were referred to the Planning Commission for checking and recommendation, by unanimous vote of Council Members present. Purchase Lots for Street Purposes On motion of Trustee Bolmgren, seconded by Clerk Justad, the Mayor and Clerk were authorized to purchase Lots 40 and 41, Block 291, Rearrangement of III St. Louis Park for Street Purposes, for the sum of $450.00 net from A. J. Deters, 3141 sumter Avenue, by unanimous vote of Council Members present. Tentative Plat for Lee Valley On motion of Trustee Bolmgren, seconded by Clerk Justad, the tentative Plat of Lee Valley was approved subject to the vacation of 32nd Street from Texas Avenue to rear of Lot 10, Block 6, Roanoke Acres Addition, and the opening of Sumter Avenue across Lot 41, Block 291, Rearrangement of St.Louis Park. Motion was passed by unanimous vote of Council Members present. Building Permit for Store Building On motion of Trustee Bolmgren, seconded by Clerk Justad, the Building Inspector was instructed to issue a building permit to M. G. Brown for placing of store building on Lots 169 and 170, Richmond Third Addition fon commercial use, as approved by the Planning Commission, subject to Ordinance requirements. Motion was passed by unanimous vote of Council Members present. Hearing Date Set - Alley Vacation On motion of Trustee Bolmgren, seconded by Clerk Justad, January 23, 1950 was set as date of hearing on the Petition of Lucille Bohnhoff and others for the vacation of Alley in Block 143, Rearrangement of St. Louis Park, by unanimous vote of Council Members present. - Heating License Bond - Gas Heat Engineering Co. III On motion of Trustee Bolmgren, seconded by Clerk Justad, the Heating Lidense Bond with Francis J. Fox, DBA Gas Heat Engineering Company of Minneapolis as 'principal, and U. S. F. G. 'Company of Baltimore, Maryland as surety, dated November 25, 1949, in the amount of $1,000.00, was approved by unanimous vote of Council Members present. - • No 'Council Meetings on December 26, 1949 and January 2, 1949 ' On motion of Trustee Bolmgren, seconded by Clerk Justad, it was voted' there would be no meetings of the Council held on Monday, December 26, 1949, and Monday, January 2, 1949, because of said dates being legal holidays; and further, that both days be declared holidays with pay for the Village Employees. Motion was passed by unanimous vote of Council Members present. December 12, 1949 271 First Council Meeting in 1950 On motion of Trustee Bolmgren, seconded by Clerk Justad, it was agreed that the first meeting of the Council in 1950 will be held on Tuesday, January 3, 1950, by unanimous vote of Council Members present. Petition for Water Main P-484 On motion of Trustee Bolmgren, seconded by Clerk Justad, the -petition signed by Mrs. Herbert Muncy, 7300 Minnetonka Boulevard and others for the cons- truction of water main_ in Minnetonka Boulevard from Maryland Avenue to Nevada Avenue; and in Nevada Avenue from Minnetonka Boulevard to West 32nd Street, was referred to the Engineering Department and Chairman of the Water Department Com- mittee for checking and recommendation, by unanimous vote of Council Members present. Petition for Sanitary Sewer On' motion of Trustee Bolmgren, seconded by Clerk Justad, the petition of Mary Lou'Ferm, 2514 Girard Avenue South, and others for the construction of Sanitary Sewer in Raleigh Avenue from 26th- Street to 27th Street;' and in 26th St. from Raleigh Avenue to Quentin Avenue, to connect with sewer in abandoned right- of-way, was referred to the Engineering Department and Chairman of the Sewer Department Committ for checking and recommendation, by unanimous vote of Council Members present. 272 :c December 12, 1949 C`D Licenses for 1950 On motion of Trustee Bolmgren, seconded by Clerk Justad, the following applications for 1950 licenses were approved, and the Mayor and Clerk are hereby authorized to issue licenses to expire December 31, 1950, by unanimous vote of Council Members present: Bowler Plumbing_ & Heating Co. Creamery Assn. Milk Truck (2) Lee Electric Company Electrical Special Permit to Connect to Water Main On motion of Trustee Bolmgren, seconded by Clerk Justad, a special permit was granted to H. C. Thompson, 3605 44th Avenue South to run a water service line from the present water main at the northeast corner of Toledo Avenue and West 31st Street, south to the new home at 3101 Toledo Avenue for water supply, with the understanding that an assessment of $108.00 be paid at time a permit is taken out, said payment to be credited to any future assessment when the water main is constructed past this property. Motion was passed by unanimous vote of Council Members present. Minutes The minutes of meetings held November 21, and 28, 1949 were read and approved as read. Sale of Model "A" Ford Approved On motion of_Trustee Bolmgren, seconded by Clerk Justad, the bid of Herman Freiborg, dated October 24, 1949, for the purchase of the old Model "A" Ford (1928) owned by the Village (Water Department) in the amount of $20.00, was approved by unanimous vote of Council Members _present. Refund Authorized - William Eddy On motion of Clerk Justad, seconded by Trustee Bolmgren, the request of William Eddy for the refund of $10.00 he paid for license to operate a miniature golf 'course .(5-2O-49 Receipt #14525), was approved in as much as the license was denied. _ Motion was passed by unanimous vote of Council Members present. Petition to Lower Alley On motion of Trustee Bolmgren, seconded by Clerk Justad, the petition . signed by Oliver Anderson, 3045, Louisiana Avenue and others to lower the alley in Block 8, Lenox Addition, to provide proper drainage, was referred to the Engineering Department and Chairman of the Street Department Committee for check- ing and recommendation, by unanimous vote of Council Members present. Request for Signal at R.R. Crossing A letter from Brooklawns, Incorporated, dated December 6, 1949, requesting the installation of a block-signal at the crossing of Minneapolis, Northfield and Southern R. R. on Brunswick Avenue was read. On motion-of Trustee Bolmgren, seconded by Clerk Justad, it was recommended that a copy of the Brooklawns letter be sent to the M. N. & S. Ry., with a request for a signal on Alabama Avenue as well. Motion was passed by unanimous vote of Council Members present. Plans and Specifications for Water Mains Ordered On motion of Trustee Bolmgfen, seconded by Clerk Justad, Ira Vraalstad was instructed to prepare plans and specifications for all water main petitions now on file and have same ready for action on March 1st, 1950. Motion was passed by unanimous vote of Council Members present. Deed Accepted (Anne E. White and Ralph E. White) On motion of Clerk Justad, seconded by Trustee Bolmgren, the deed- of Anne E. White and Ralph E. White, her husband for the use as a public street, the West 30 feet of the West Half (W2) of the East Half (E2) of the Northwest __ Quarter (NW4) of the Northeast_Quarter (NE4) of the Southwest Quarter (SW4), Section 31, Twp. 29, Range 24, according to ,U. S. Government Survey; it being understood that this land be used as an extension of Quentin Avenue, in the Village of St. Louis Park,/ Motion was passed by unanimous vote of Councilmen present. _ _ was accepted. December 12,4-1949 ,273 Resolution On motion of Trustee Bolmgren, seconded by Clerk Justad, the following resolution was adopted by unanimous vote of all members of the Council present; RESOLUTION AUTHORIZING WITHDRAWAL OF SEWER BID AND REJECTION OF ALL BIDS WHEREAS, THE VILLAGE COUNCIL HAS HERETOFORE TAKEN BIDS FOR THE CONSTRUCTION OF STORM SEWER, KNOWN_AS STORM SEWER NO. 17-C, and has determined that_the bid of De Graff Wolff was the lowest bid of a responsible bidder and has prepared and submitted to him a contract for execution; that said DeGraff Wolff has in- formed the Village Council in writing that in preparing hiss:bid he was not informed that the Village was about to undertake construction of a sanitary sewer at the same location and that he did not know until after opening of the bids that the Village has entered into contract for the construction of sanitary sewer in Edge- wood Avenue from 28th Street to 32nd Street; that construction of the sanitary sewer commenced shortly after opening of said bids, and because of the extensive excavation of the street, the conditions materially changed with respect to cons- truction of a storm sewer at the same locality, and it appears to the Council that until the soil is settled in said street, the cost of construction of storm sewer will be greatly in excess of the cost of the construction of the same sewer if the sanitary sewer had not been constructed and that to again excavate the soil at this time will endanger the sanitary sewer, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that De Graff Wolff be permitted to withdraw said bid and that all bids submitted for said sewer project be hereby rejected and that the project be held in abey- ance until such time as the Village Engineer shall report that the soil condi- tions exist so that it is proper to again proceed. Claima for Damages Approved On motion of Trustee Bolmgren, seconded by Clerk Justad, the two follow- ing claim for damages were approved ---- 1. J. A. FELBER and FLORA FELBER, 5920 Oxford Street, St. Louis Park -- _Amount $7.00 for all damages incurred on September 20, 1949, in front of 5920 Oxford Street. 2. Harold E. Lemke, 2732 Edgewood Avenue, St. Louis Park -- Amount $27.00 for all damages incurred on October 8, 1949, in accident near Hampshire and 28th Street, • and the Mayor and Clerk were instructed to issue checks covering same, by unani- mous vote of Council Members present. • Liability for Damages Denied A NOTICE .0F DAMAGE claim dated December 7, 1949 was presented to the Coun- cil by Van Valkenburg, Blaisdell and Moss, representing ---- • 1. Western National Fire Insruance Company $8,000.00 . 2. Pacific National Fire Insruance Company 1,500.00 . 3. Northern Assurance Company 2,500.00 • in.the case of Melvin W. Fisher explosion which occurred on November 18, 1949 at.3781 Kipling Avenue, St. Louis Park. . After discussion, and on the advice of Village Attorney, E. T. Montgomery, it.was moved by Clerk Justad, seconded by Trustee Bolmgren, that any liability for the above claim was denied, by unanimous vote of Council Members present. Notice of Loss - Damages Denied . A NOTICE OF .LOSS submitted by Hanson and Willcox, Attorneys for Adele Donahue, Plaintiff vs Village of St. Louis Park, Defenddnt , claiming that a garbage truck driven by Carl Mack on September 27, 1949, caused damage to Adele Dopahue' s 1949 Pontiac automobile in the sum of $150.00, was read. • On motion of Clerk Justad, seconded by Trustee Bolmgren, any liability in. this case was denied, by unanimous vote of Council Members present. • Trustee Perkins • Trustee Perkins came to the meeting at this time - 10:00 P.
