HomeMy WebLinkAbout1949/11/07 - ADMIN - Minutes - City Council - Regular a 232 October 26, 1949 ; CD SPECIAL MEETING OCTOBER 26, 1949 A special meeting of the Village Council was called to order by President Erickson at 7 P. M., pursuant to notice by Clerk Justad to all Council Members. The following Councilmen were present at roll call: Trustee Perkins Trustee Jorvig Clerk Justad - Mayor Erickson Permit to Remove Black Dirt The matter of a permit for the Park Construction Company to excavate black dirt and remove same from the West 2 of Block "A", Minikanda Vista Second Addn. III was discussed with Sheldon Carlson of the Park_Construction Company. On motion of Trustee Perkins, seconded by Trustee Jorvig, permission was granted to the Park Construction Company to excavate and remove black dirt to a depth of approximately thre feet from their own property (West i of Block "A", Minikanda Vista Second Addition) upon receipt from said Park Construction Company of a bond in the amount of $1,000.00 for the refilling of same location after black dirt has been removed. Motion was passed by unanimous vote of the Council Members present. Bid Awarded - Two 2-Ton Dump Trucks The report and tabulation of bids received October 24, 1949 for the furnishing of two 2-ton dump trucks for the Street Department prepared by the Street Commission- er was read and his recommendation to purchase said trucks from Boyer-Gilfillan Company. On motion of Trustee Perkins, seconded by Trustee Jorvig, the bid of Boyer- Gilfillan Company of Minneapolis received October 24, 1949 for the furnishing of two 2-ton dump trucks as per specifications was deemed to be the lowest bid of a responsible bidder, and the Clerk was authorized to issue a purchase order for the two dump trucks to Boyer-Gilfillan Company in the amount bid --- $5,420.30 (without tax) less allowance on 1946 Ford Dump truck, or $3,647.50 net. Motion was passed by unanimous vote of Council Members present. . III Advertise for Sewer Bids Storm Sewer District #13-B . On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Clerk was instructed to advertise for bids for laying storm sewer in 28th Street from Webster to Xenwood Avenues according to specifications on file in the Village Engineers Office - bids to be opened November 14, 1949. No one appeared. _ On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Building Inspector was instructed to issue permits to William H. Siegel Company for the construction of two two-family dwellings on .Lots 5, 6, and 7, Block 1, Lenox Addition, by unanimous vote of the Council. . III Building Permit - Commercial Building On motion of Trustee Perkins, seconded▪ by Trustee Bolmgren, the Building Inspector was instructed to issue a building permit to Hold Construction Company for the construction of a commercial building on Lots 12, 13, and 14, Block 2, Minikanda Vista Second Addition, by unanimous vote of the Council. Hearings - Rezoning . As per notice published in the St. Louis Park Dispatch, a hearing was had on the application of M. P. Johnson Sales Company to rezone from Open Development to Commercial Use, the South 200 feet of the, East 24.71 acres of the 3E4 of Section 7, Township 117, Range 21; also the application of S. P. Carey to rezone from Residential to Light Industry Use, that part of the SW4 of the NW of Section 20, Township 117, Range 21, lying SFly of the right-of-way of the Chicago, Milwaukee, St. Paul and Pacific Railway, and Wly of the center line of Minnehaha Creek. No one appeared. Ordinance #344 On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following Ordinance was adopted by unanimous vote of the Council: ORDINANCE NO. 3• 44 AN ORDINANCE AMENDING THE Z▪ ONING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARKIII The Village Council of the Village of ,St. Louis Park ordains: Section 1. Section 2 of the Zoning Ordinance of the Village of St. Louis Park adopted by the Village Council January 20, 1932, together with the Use District maps referred to therein is hereby amended by deleting from the Residence District: The West 611.2 feet of the SWC of the NWS, Section 20, Township 117, Range 21, lying. South of that portion of said SW4 of the NWS now zoned, for Heavy Industry, and including the same within the Light Industrial Use, District and shall be subject November 7, 1949 235 5 Ordinance No. 344, Cont'd. to all the provisions of said ordinance regulating said premises within said district. Section 2. Section 2 of the Zoning Ordinance of the Village of St. Louis Park adopted by the Village Council January 20, 1932, together with the Use District. maps referred to therein is hereby amended by deleting from the Open Development Use District: The South 200 feet of the East 24.71 acres of the Southeast 4 of Section 7, Township 117, Range 21, 1 and including the same within the Commercial Use District and shall be subject to all the provisions of said ordinance regulating said premises within said district. Action on Juice Bar Deferred Mr. W. J. Horvereid presented plans for a Drive-in Juice Bar on Lot 1, Block 3, Minikanda Vista Addition (SW Corner Lynn and Excelsior) . Mayor Erickson said that complaints against the Bar have been received by him. He suggested that, Mr. Horvereid see Mr. Rudeen and others in the immediate vicinity for their approval. On motion of Trustee Perkins, seconded by Trustee Jorvig, the above matter was referred to the Committee of the Whole, to be brought up at the meeting of November 14, 1949, by unanimous vote of the Council. Petition for Alley Vacation On motion, of Trustee Perkins, seconded by Trustee Bolmgren, the petition signed by Lucille Bohnhoff and others, dated November 7, 1949, for the vacation of Alley in Block 143, Rearrangement of St. Louis Park, was referred to the Planning Commission for checking and recommendation, by unanimous vote of the Council. Bid Awarded - Storm Sewer District #17 On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of De Graff Wolff, 2360 University Avenue, St. Paul, Minnesota, received October 17, 1949, for the construction of Storm Sewer District #17 was determined to be the lowest bid of a responsible bidaer ($53,184.95), and the Mayor and Clerk are hereby authorized to enter into a written contract with De Graff Wolff on behalf of the Village for the construction of above sewer, in the amount bid, by unanimous vote of the Council. Fire Place at Smoky Point Restaurant Paul Fish, representing Mr. Ellis, owner of Smoky Point restaurant at 4801 Excelsior Boulevard, spoke in regard to the fireplace built in front of their building. He said there will be no fire in the place, and is to be used only as an advertisement. The builder neglected to obtain a building permit and the Building Inspector has stopped the work. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Building Inspector was authorized to issue a building permit to Smoky Point Restaurant for the construction of a fire place to be used only for advertisement -- and not for cooking. Motion was passed by unanimous vote of the Council. Hearing Date Set - Rezoning On motion of Trustee Bolmgren, seconded by Trustee Perkins, November 28, 1949 was set as date for hearing on the recommendation of the Planning Commission for rezoning from Open Development to Commercial Use, that property lying south of Minnetonka Boulevard 200 feet deep, from Texas Avenue westward to the Great Northern R. R. spur track. Motion was passed by unanimous vote of the Council. Special Permit to connect to Water Main On motion of Trustee Bolmgren, seconded by Clerk Justad, a special permit was granted to Leslie R. Johnson to connect the home he is building at 3053 Louisiana Avenue to the water main at West 31st Street and Louisiana Avenue for water service, said service line to be constructed as directed by the Superintend- ent of Water Department. At the time the water permit is taken out, and assessment of $140.00 shall be paid, add payment will be credited to the owner when the water main is constructed past the property. Equipment to Thaw Out Catch Basins, Cont'd. sewer system, bids to be opened December 12, 1949; bids to be based on specifi- cations set up by the Street Commissioner. Motion was passed by unanimous vote of the Council. Petition - Water Main On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following petition was referred to the Village Engineer and Chairman of the Plater Department Committee for checking and recommendation, by unanimous vote of the Council: P-478 PETITION FOR WATER MAIN, signed by Melvin P. Johnson, 7124 Minnetonka Boulevard, dated November 7, 1949, for the construction of — water main in SUMTER AVENUE BETWEEN 31ST ST. AND 322 STREET. Storm Sewer Ordered On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Street Com- missioner was instructed to construct storm sewer to drain the low spot in Alley in Block 2, Birchwood Addition, adjacent to Lots 25 and 26, across the south 5 feet of Lot 25 and north 5 feet of Lot 26, Block 2, Birchwood Addition, as per easements of October 26, 1949. Proposed Plat for Lee Valley Addition On motion of_Trustee Perkins, seconded by Trustee Jorvig, the proposed plat for Lee Valley Addition presented by M. P. Johnson (between Texas Avenue and Sumter Avenue and 31st Street and 322 Street, was referred to the Planning Com- mission for checking and recommendation, by unanimous vote of the Council. Building Permit for Caddy House On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Building Inspector was authorized to issue a building permit to the Minneapolis Golf Club to erect a caddy house on property deeded to them by the Crestview Association in South Crestview, and subject to agreements contained in letter dated September 28, 1949 addressed to Mr. Evans, President of the Minneapolis Golf Club and signed by C. S. Eaton of Crestview Association (letter filed in Minneapolis Golf Club folder in Building Department). Resolution [l] On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of the Council: RESOLUTION CANCELING GARBAGE COT,T,1 CTION ASSESSMENTS BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the following assessments levied pursuant to resolutions adopted for years 1944, 1945, 1946, 1947, and 1948 be hereby canceled for the reason that said lands were used for business, and were not served by the Garbage Collection Service of the Village, and the Mayor and Clerk are hereby authorized to refund the amount paid on receipt of a verified claim signed by the taxpayer: V. Edwards NW1y 77' Lots 1 and 2, 1944 $7.90 4369 Theilen Avenue except State Highway 1945 7.90 Minneapolis, Minnesota Minikanda Vista Addn. 1916 7.90 1947 7.92 1948 8.40 $40.02 Clerk's Expenses to Chicago Approved On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Clerk's trip to Chicago, Illinois on November 1, 1949, to deliver $296,000.00 Bonds sold to John Nuveen Company was approved and his expense account of $37.75 was approved and ordered paid, by unanimous vote of the Council. FWA Funds On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Clerk was instructed to apply to Federal Works Administration for funds to finance advance planning for various projects in the Village of St., Louis Park, by unanimous vote of the Council. Street Work Ordered On motion of Trustee Perkins, seconded by Trustee Bolmgren, Phelps-Drake Co., Incorporated were granted permission to prepare the following streets to protect them from freezing by tearing up the surface of the street to a depth of two feet, placing a little straw in the bottom of the excavation, and refilling and grading the street so that streets will be entirely passible from that time until sewer construction is commenced: November 7, 1949 241 Street Work Ordered, Cont'd. 1. Zarthan Avenue from West 35th Street to West 34th Street 2. Alabama Avenue from West 34th Street to Lake Street 3. Alabama Avenue from Lake Street to a point 900' North 4. 'Motion was passed by unanimous vote of the Council. Contract for Engineering Services On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Village Attorney was instructed to draw up a contract between the G. M. Orr Engineering Company and the Village for engineering services pertaining to advance planning for Village Projects, to be decided. Motion was passed by unanimous vote of the Council. • Plans for Lift Station A. C. Godward, Engineer, spoke regarding Garden Apartments to be built on the North Side of Excelsior Boulevard, just East of Huntington Avenue, and asked about sewer to serve same. On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Engineer was instructed to prepare plans and specifications for Lift Station to serve the area in the vicinity of Excelsior Boulevard and Glenhurst Avenue, by unanimous vote of the Council. Grade for Alley • Pursuant to petition received from Alen N. Kimm, 2928 Brunswick Avenue, and others, it was moved by Trustee Perkins, seconded by Trustee Bolmgren, that the Village Engineer be instructed to recommend a grade for Alley in Block 20, Park Manor and present same to the Village Council to establish at the earliest possible date. • Garage Permit Approved G. C. Riebe presented an appeal from the Building Inspector relative to permit to erect a private garage at 2848 Webster Avenue. On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Council determined that Subdivision 11 of Section 19 of the Zoning Ordinance does not require setback of the proposed garage from 29th Street as contended by the Building Inspector; that the location of the proposed garage as shown on the plat filed with the Building Inspector complies with the Ordinance with respect to setback requirements from the boundary of the lot adjacent to 29th Street; that the Building Inspector be directed to issue permit. Motion was passed by unani- mous vote of the Council. - Quit Claim Deed Accepted On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Quit Claim Deed, dated July 7, 1948, presented by Norman Maurice Moldestad, Agnes M. Moldestad, Marie Margaret Smith and Byron M. Smith for use as a public street, the East 301 of Lot Three (3) in Robinson & Gregory's Subdivision of the East 76.6 acres df Lots 5 and 8, Section 9, Township 117, Range 21, according to the recorded plat thereof (since then changed to Lot 9, Auditors Subdivision #350), was accepted by unanimous vote of the Council. _ Resolution • On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION SETTING HEARING FOR •• _ SIDEWALK ASSESSMENT WHEREAS sidewalk Improvement No. N-76 has been completed within Thirty days prior hereto, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that a hearing on proposed assessment for said improvement be had at the meeting of the Village Council to be held November 28, 1949. Drainage Ditch The problem of who and how would take care of the open ditch running from Monterey Parkway to Joppa Avenue, back of Star of Bethlehem Home which is now filled up was referred to the Village Attorney for a recommendation. 2420 November 7, 1949 Tax Delinquent Lots A letter from the Planning Commission, dated November 7, 1949, calling the Council's attention to securing tax delinquent lots at 25th and Monterey for Park purposes, was read. Mayor Erickson stated that he would write the State Department concerning this -matter at once. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of the Council: RESOLUTION CANCELING WATER MAIN ASSESSMENTS WHEREAS, it appears that by resolution adopted October 11, 1948 for Water Main N-91, the following lots were inadvertantly assessed for water main, whereas they had been assessed in Water Main Project #2, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park, that the assessments heretofore levied against the following described lots in respective amounts hereinafter set forth be hereby canceled and the Treasurer -and Auditor of Hennepin County be hereby authorized to cancel the same upon their respective records, and BE IT FURTHER RESOLVED that the installments of such assessments heretofore paid in the respective amounts hereinafter set forth be refunded to the respect- ive property owners and the Mayor and the Clerk be hereby authorized to issue warrants in payment of such refunds to respective, property owners.
