Resolution Bids for the purchase of $296,000.00 principal amount of Sewer Warrants were opened as set forth in the following resolution: On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION PROVIDING FOR AWARD AND SALE OF SEWER WARRANTS WHEREAS, pursuant to advertisement for bids published in the St. Louis Park Dispatch, September 16, 1949, for purchase of $2900.00 principal amount of sewer warrants of the Village of St. Louis Park issued for construction of sanitary sewers for Sanitary Sewer Districts 2-C, 2-F, 2-G, 2-L, 2-M, and 1-R, and for storm sewers for Storm Sewer Districts 17-B, .18 and 19. The following bids have been received and opened and appear to be in proper form: Kalman & Company, Incorporated ) Juran and Moody ) 2.80% plus premium of $501.00 Allison-Williams Co. ) NW Nat'l. Bank of Minneapolis ) 2.80% plus premium of $1,024.80 First Nat'l. Bank of Mpls. ) John Nuveen & Company ) Harold E. Wood & Company ) 2i% for 1951-1956 Maturities Manheimer-Egan, Incorporated ) 2-3/4% for 1957 to 1962 , plus Woodward Elwood & Company ) Premium of $398.69 therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said bid of Juhn Nuveen & Company and Associates for the purchase of sewer warrants aggregating $296,000.00 authorized to be issued by resolution of the Village Council adopted September 12, 1949, be hereby determined to be the highest and best bid, and the Mayor and Clerk are hereby authorized and directed to execute and deliver such warrants upon payment by said bidder of the face amount thereof plus accrued interest and premium to be dated October 15, 1949, bearing interest at 22% for the 1951-1956 maturities, 2-3/4% for the 1957-1962 maturities per annum, plus premium of $398.69, and the Mayor and Clerk are authorized to execute purchase agreement submitted by said bidder and to furnish the printed warrants and certifying opinion of Fagre and Benson at Village expense. BE IT FURTHER RESOLVED that the full faith and credit of the Village for the payment of the principal and interest of such warrants when the moneys on hand in the 1949 Sewer Projects Fund are insufficient for such purpose, is hereby pledged, and the Village Council shall each year during the time these warrants are outstanding and unpaid, include in its general tax levy a suffi- cient amount to take care of any accumulated and anticipated deficiency in said sewer fund, and the Council shall pay the principal and interest of any such warrants out of the funds in the treasury when the moneys on hand in said sewer fund are insufficient to meet the payment of such principal and interest as the same matures. BE IT FURTHER RESOLVED that there is hereby created a separate fund of the Village of St. Louis Park to be known and designated as 1949 Sewer Projects Fund, and into such fund will be paid all moneys received from-the-collection of special assessments levied on account of the construction of sewers in Sanitary Sewer Districts 2-C, 2-F, 2-G, 2-L, 2-M, and 1-R, and Storm Sewer Districts 17-B, 18 and 19, and the moneys in said fund will be used only for the payment of the sewer Warrants herein authorized as they severally mature, and said warrants shall be primarily paid out of the moneys in said fund, and that said sewer projects be hereby consolidated pursuant to MSA Sec. 435.15 for purposes of econmy as if originally consolidated and joined as one project. Bids for Grading Pursuant to advertisement for bids in the St. Louis Park Dispatch for the grading and graveling certain streets in the Village designated as Improve- ments 0-99, 0-115, 0-116, 0-150 and 0-51 --- no bids were received. Said he owns 212 feet on 28th Street. Suggested that School Board was getting the full benefit and feels that his property gets no benefit at all. If the street was lower in front of his house, he would have received some benefit. He does feel that he shoiild pay something, but does not know how much. Everett Drake, Attorney for the School Board spoke for the School Board. Action on this matter was deferred to October 10, 1949. Hearings - Sidewalk Assessments Separate hearings were had on each of the proposed sidewalk assessments listed in the following resolution. No one appeared. Company) A hearing was had on-the petition of S. and L. Company, Inc. for rezoning of following property from Residential Use to Commercial Use. All that part of the East 1/2 of the West 1/2 of Section 20, Township 117, Range 21 lying North of Excelsior Boulevard; south of a line that is 50 feet south of and meanders parallel with the southerly edge of Minnehaha Creek; east of the west 252.25 feet of said east 1/2 of the west 1/2 of said section; and west of the east 200 feet of said east 1/2 of the west 1/2 of said section. No one appeared in opposition. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Village 2 0 6 October 3, 1949 CC) Hearing, Rezoning, Cont'd. , Attorney was instructed to draw up an ordinance to rezone above described property from Residential Use to Commercial Use, plus permission to bring in goods by truck. Motion was passed by unanimous vote of the Council. Bid Awarded - Sanitary Sewers On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Phelps-Drake Company, Inc. received September 26, 1949 for the construction of Sanitary Sewers in Kipling Avenue from West 26th Street to West 25th Street; in Utica Avenue from Wooddale Avenue to, 325 feet South of West 41st Street and in Xenwood Avenue from Excelsior Boulevard to West 41st Street, in the amount of $19,317.80, was deemed to be the lowest bid of a responsible bidder, and the Mayor and Clerk are hereby authorized to enter into a written contract for same at price bid, by unanimous vote of the Council. Petition for Water Main A petition from Northern Development Company, ;dated October 3, 1949, was read, stating that they were the-owners of Lots 1 to' 5, Block 9, and Lots 6 to 10, Block 8, Basswood Addition; and requesting that ;water main be constructed to serve said lots. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of the Council: RESOLUTION FOR THE CONSTRUCTION OF WATER MAIN • WHEREAS the Village Council has heretofore ordered construction of Village water main in Joppa Avenue adjacent to Lots 6 to 8, Block 8, and Lots 1 to 5, Block 9, Basswood Addition, and the work has been held up pending grading of said portion of Joppa Avenue, and said grading has now been completed and seven houses are now under construction, two of which are near completion, and WHEREAS the Northern Development Company as owner of said property has petitioned that the work be done immediately without advertisement for bids and has waived notices and hearings, and consented to assessment, therefore, BE IT RESOLVED that water main extension be made in said portion of Joppa Avenue as anextra to water main construction contract with Phelps-Drake Company, Inc., dated September 26, 1949 at the unit prices therein specified provided said Phelp-Drake Company, Inc. will accept same as an extra to said contract on that basis. Licenses On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following applications for 1949 licenses were approved, and the Mayor and Clerk are hereby authorized to issue licenses to expire December 31, 1949, by unanimous vote of Council Members present ----- Butler & Holmberg Soft Drink Gas Station 5 Pumps George C. Penny Plumbing ©rlo Hemstock Orlo Hemstock appeared regarding his layoff as of September 23, 1949 by the Park Board. Stated that there is a man working in another Department who has less rights than he has. On motion of Trustee Bolmgren, seconded by Trustee Perkins, the matter above referred to was referred to the Committee of the Whole, by unanimous vote of the Council. Permission to Place Poles On motion of Trustee Jorvig, seconded by Clerk Justad, the Northern States Power Company was granted permission to place poles at the following locations by unanimous vote of the Council: 2 poles on Joppa Avenue between Highway No. 7 and Minnetonka Boulevard 1 pole on Walker Street at Louisiana Avenue Police Report for September, 1949 The following Police Report for the month of September, 1949 was read and ordered filed: October 3, 1949 207 Police Report, Continued • warnings None Arrests 113 Radio Calls 196 Aids 2 Accidents 23 'Phone Calls 3 Mileage 11,642 Miles Hearings - Proposed Sewer Assessments Separate hearings were had on proposed assessments now on file with the Village Clerk for Storm Sewer Construction in 28th Street from Colorado Avenue to Kentucky Avenue for Storm Sewer District No. 17B, and for Storm Sewer cons- tructed in Xenwood Avenue and Webster Avenue to 33rd Street for Storm Sewer District No. 19. Alexis Caswell appeared regarding Storm Sewer in Xenwood Avenue in District No. 19. .Asked for a legal opinion on whether he sbuld be assessed for this im- provement. Said water from center of Lot 149, Norwaldo runs South. Said he owns Lots 152 and 153. Mr. Conn who owns Lots 150 and 151, Mr. Zebach who owns Lot 156, Mr. Engler who owns Lot 154, Mr. Westerman who owns Lots 157 and 158, and Mr. Blum who owns Lot 155 were also present and in accord with Mr. Caswell's opinion. Mr. Montgomery, Village Attorney asked if they used the Street. They said they are not benefited, and at no time does water from their property enter this sewer. On motion,by Trustee Perkins, seconded by Clerk Justad, action on above assessments were deferred to meeting of October 10, 1949, by unanimous vote of the Council. Permit for Garage Approved On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Building Inspector was authorized to issue to Stuart Smith a building permit for the construction of a garage to be attached to his home at 3966 Brunswick Avenue, by unanimous vote of the Council. ' Plumbing License and Bond Canceled On' motion of Trustee Bolmgren, seconded by Trustee Jorvig, 1949 Plumbing License No. 209 issued to Sandhoff & Mc Namara was canceled at their request, and the Clerk was instructed to notify the Bonding Company that their bond would terminate as of this date. Motion was passed by unanimous vote of the Council. • Bid Awarded for 60 Ton Shop Press On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the bid of E. S. Ingersoll for One (1) 60 Ton Shop Press received September 26, 1949 of $520.00, F. 0. B. •St. Louis Park, was deemed to be the lowest bid of a responsible bidder, and the Clerk was authorized to issue a Purchase Order for same at price bid, by unanimous -vote of the Council. Bid Awarded for Twin Post Car & Light Car Lift On motion of Trustee Jorvig, seconded by Trustee Perkins, the bid of Minneapolis Iron Store for One (1) Model EC 107 Weaver Twin Post Lift, Air Oil Operated, received September 26, 1949 of 4:09.00 FOB St. Louis Park was deemed to be the lowest bid of a responsible bidder, and the Clerk was authorized to issue a purchase order for same at price bid, by unanimous vote of the Council. Resolution On motion of Trustee Perkins, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of four members of the Council (Trustee Bolmgren not voting). RESOLUTION DETERMINING LOCATION OF 42ND STREET FROM HIGHWAY 169 TO BROOKSIDE AVENUE • WHEREAS, it appears that 42nd Street (formerly Morningside Road) from Highway 169 to Brookside Avenue appears to have been graded and curbs to have been placed thereon' the assumption that the north line of Government Lot 8, Section 21, Township 117, Range 21, was an equal distance from the north line of Brookside Addition and the south line of Suburban Homes Company's Addition as the same had been staked out, and • WHEREAS, the Village Engineer has reported that from a survey of said government lot line he has determined that there appears to have been an error in the staking out of Suburban Homes Company' s Addition and that the south line of said addition as staked out encroached upon the platted right-of-way of 42nd Street, there being less than twenty (20) feet from the south line of said sub- division to the north line of said Government Lot 8, and CP 208 October 3, 1949 , Resolution, Continued WHEREAS, the Village Council desires to avoid any hardship to owners of property lying south of said street and to avoid any confusion resulting from said original erroneous surveys, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the south line of said 42nd Street between Highway 169 and Brookside Avenue be hereby determined to be twenty (20) feet south of the north line of said Government Lot 8 as determined by the Village Engineer, and that the north curb line of said 42nd Street where curbs are now installed is not a proper point of survey based upon the assumption that said curb lines are located a standard distance south of the north line of the street. Authorized to Sell Model A Ford On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Water Department was authorized to sell Model "A" Ford Sedan by accepting sealed bids, by unanimous vote of the Council. 212 October 3, 1949 Resolution On motion of Clerk Justad, seconded by Trustee Bolmgren, the following , resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION APPROPRIATING FUNDS FOR PAYMENT OF CERTIFICATES OF INDEBTEDNESS WHEREAS, the Village Council adopted a resolution September 12, 1949, for award and sale of certificates of indebtedness totaling $7,500. to be issued under date of September 15, 1949, and providing in said resolution for a tax levy in each of the years 1949-1953 for payment of principal and interest due upon said certificates, and WHEREAS, it appears that the law requires that provision be made for an additional 5 per cent to cover possible delinquencies, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that there be hereby appropriated from the General- Fund of the Village the sum of $410. which shall be transferred to the 1949 fund for payment of said certi- ficates of indebtedness to be used for payment of same as they severally mature in the event that the taxes levied pursuant to said resolution are not available at said maturity dates. Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of the Council: RESOLUTION LEVYING ASSESSMENT FOR COLLECTION AND DISPOSAL OF GARBAGE AND REFUSE WHEREAS, the Village Council has, during the annual period from September • 1, 1948 to August 31, 1949, provided by contract for collection and disposal of garbage and refuse from dwellings and places of business within the Village of St. Louis Park at a cost of $44,,605.40, said cost being allocated on a monthly basis as set forth in Ordinance No.-339, and, WHEREAS, the Village Clerk has prepared an assessment roll providing for an assessment of a service charge for such collection and disposals against each residence and place of business served on a basis set forth in said ordinance, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park,that said assessment roll is hereby adopted and there is hereby levied and assessed against each lot or parcel of ground set forth in said assessment roll an assess- ment equal to the sums therein respectively set forth, payable concurrently with taxes levied in the year 1949 and collected in the year 1950.
