COUNCIL MEETING OCTOBER 10, 1949
A meeting of the Village Council was called to order by Mayor Erickson
at 8:17 P. M., with the following Council Members present at roll call as

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the condition
of 27th Street from Inglewood to Kipling was referred to the Street Commissioner
for attention at once, by unanimous vote of Council Members present.

Bids for Cleaning and Painting Steel Water Reservoir
Pursuant to advertisement for bids in the St. Louis Park Dispatch and
Construction Bulletin, sealed bids were received from the following bidders for
the cleaning and painting of 1,500,000 gallon surface steel water reservoir:

Pursuant to advertisement for. bids in the St. Louis Park Dispatch, sealed
bids were received from the following bidders for grading and landscaping of
grounds around pumping stations at 4701 West. 41st Street and 4241- Zarthan Avenue:

Request for Street Lights
A request from Oscar Cohen, 3130 Colorado Avenue and others, dated October
8, 1949, for the installation of streets at corners of 31st and 32nd Streets
and Colorado, was read.
• On motion of Trustee Jorvig, . seconded by Trustee Bolmgren, the Northern
States Power Company was ordered to place street lights at corners of 31st and
32nd Streets and Colorado Avenue, by unanimous vote of Council Members present.
Electrical License
• On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the application
of Stevens Electric Company, 925 Second Avenue South, Minneapolis, Minnesota for
a license to do electrical work was approved, and the Mayor and Clerk are hereby
authorized to issue licenses to expire December 31, 1949, by unanimous vote of
Council Members present. _
Justice of Peace Report of Fines (Linnee)
Justice of.Peace E. A. Linnee's Report.▪of Fines dated October 4, 1949 was
read and ordered filed.
Permission to Place Pole
On motion of Trustee Bolmgren, seconded▪ by Trustee Jorvig, the Northern
States Power Company was granted permission to place one pole on 22nd Street
between Kentucky Avenue and Louisiana Avenue, by unanimous vote of Council Members
present.
Fire Department Report for September, 1949
.The Fire Department's-Report of Fires for the month 9f September, 1949 was
and ordered filed.
Permission to Place Buried Cable
On motion of Trustee Jorvig, seconded by▪ Trustee Bolmgren, the Northwestern
Bell Telephone Company was granted permission to place buried cable in Lynn
Avenue south of State Highway #7, by unanimous vote of Council Members present.
Petition for Water Main - P-467
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the petition of
Wallace T. Bruce and others, dated September 21, 1949, for the extension of water
main from intersection of East Parkwoods and Parklands Road, Lake Forest Addition
to serve Lots 18 and 20, Parklands Tract, Lake Forest Addition, and Lot X in
Westridge, was referred to the Village Engineer and Chairman of the Water Depart-
ment Committee for checking and recommendation, by unanimous vote of Council
Members present.

On motion of Trustee Bolmgfen, seconded by Trustee Jorvig, Contractor' s
Bond with Phelps-Drake Company, Inc. of Minneapolis, Minnesota as principal and
United States Guarantee Company of New York N. Y. as surety, dated September 26,
1949, in the amount of $7,289.21, covering Water Main Extension, Job 0-153, was
approved by unanimous vote of Council Members present.

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following

Advertise for Bids - 2 Two Ton Trucks
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was
instructed to advertise for bids for two (2) two-ton truck for Street Department
use, and to advertise that one (1) lz ton Ford dump truck would be turned in;
bids to be opened October 24, 1949. Motion was passed by unanimous vote of
Council Members present.
Hearing Date Set - Double Bungalows
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, October 24, 1949
was set as date for hearing on request of Claude W. Rossman Company for special
permits to construct double bungalows on Lot 13, Block 1, and South 55 feet of
Lot 5, Block 2, Sunset Gables Second Addition, by unanimous vote of Council Mem-
bers present.

Hearing Date Set - Rezoning
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, November 7th,
1949 was set as date for hearing on the request of M. P. Johnson Sales Company,
for change in zoning from Open Development Use to Commercial Use, the South 200
feet, exclusive of roadway, of the East 24.71 acres of the SET, of the SET of
Section 7, Township 117, Range 21. Motion was passed by unanimous vote of
Council members present.
Hearing Date Set - Rezoning
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, November 7th,
1949 was set as date for hearing on the request of S. P. Carey for the rezoning
of that part of the SVT of the NWT of Section 20, Township 117, Range 21, lying
North of the South Line of said Southwest T of the Northwest T, east of the

the Council.
Request for Rezoning Dropped
The Planning Commission's report dated October 6, 1949, on the request of
Glen Woodmark and Motley Berman for rezoning the unplatted property between
Minnetonka Boulevard and 32nd Street and adjoining Highway #100 on it's west
side, from Residential to multiple dwelling use district and from "C" to "D"
Density was read. It was their opinion that request for proposed rezoning be
denied on the grounds that there is not sufficient evidence to satisfy them
that the rezoning proposed will not adversely affect the general welfare of the
Village of St. Louis Park.
On motion of Trustee Bolmgren, seconded by Trustee Jorvig that hearing
on above proposed rezoning be dropped, by unanimous vote of the Council Members
present.
Adjourned Hearings on Proposed Sewer Assessments
Adjourned hearings were had on proposed assessments for sewers described
in the following resolution. No one appeared.

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all members of the Council:
SEWER ASSESSMENT RESOLUTION
WHEREAS, pursuant to notice published in the St. Louis Park Dispatch
September 23, 1949, the Village Council has met and heard and passed upon all
objections to the proposed assessment for construction of storm and sanitary
sewers as follows:
Storm sewer extending from Xenwood Avenue between
Lots 129-130, Norwaldo Addition, to,Alley and in
Alley South to West 33rd Street; thence East to 125

BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that each of said proposed assessments is hereby affirmed and adopted and shall
constitute a special assessment against the lands named therein, and each lot,
piece or parcel of land included in said assessments is hereby found to be
benefited by the respective improvement in the amount of the assessment levied
against it, and
BE IT FURTHER RESOLVED that such assessments shall be payable in equal
annual installments over a period of ten years, the first of said installments
to be payable on the first day of January, 1950, and succeeding installments on
the first day of January in each year thereafter until the full amount of said
assessments are paid. Said special assessments and each installment thereof
shall bear interest at the rate of 5% per annum from the date of this resolution.
Said special assessments with the accruing interest thereon shall be a paramount
lien upon the property included therein from the date of the adoption of this
resolution and shall remain such lien until fully paid as authorized by Chapter
312, Laws of Minnesota, 1903. amended, and,
BE IT FURTHER RESOLVED that all moneys collected on any such special
assessments shall constitute a fund for the payment of the cost of the improve-
ment for the respective-districts for which such assessments were made and the
same shall be credited to the proper sewer district fund.
Constable Appointed
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all Council Members present:

WHEREAS, the Village Council hereby determines that Constable Robert
Gordon has moved from the Village and that there now exists a vacancy in the
office of constable, and
WHEREAS, the Council has checked the qualifications of Wilbur B. Davies
for the appointment to fill the vacancy and determined that they are satisfactory,
therefore,
BE IT RESOLVED that the appointment of Wilbur B. Davies, 3984 Colorado
Avenue, St. Louis Park to fill the unexpired term of Robert Gordon be approved.
Proposed Plat (M. P. Johnson)
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the proposed
plat presented by M. P. Johnson of property between 32nd Street and a point
within approximately 330 feet south of Minnetonka Boulevard' and between Texas
and Utah Avenues, was referred to the Planning Commission for checking and recom-
mendation, by unanimous vote of Council Members present.
Employment of R. W. Baden Approved
On motion of Clerk Justad, seconded by Trustee Bolmgren, Robert W. Baden,
5924 West 35th Street was employed as a draftsman in Village Engineer's Office
at $1.60 per hour, employment to start at once. Motion was passed by unanimous
vote of Council Members present.
Employment of Mrs. Myrtle Houpt Approved
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the employment
of Mrs. Myrtle Houpt as secretary for Recreation Department at $125.00 a month
for three months, effective October 1, 1949, was approved by unanimous vote of
Council Members present.

Ordinance No. 342
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
Ordinance was adopted by unanimous vote of Council Members present:
ORDINANCE NO. 342
AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE VILLAGE OF ST. LOUIS PARK
The Village Council of the Village of St. Louis Park ordains as follows:
Section 1. Section 2 of the Zoning Ordinance of the Village of St. Louis
Park adopted by the Village Council January 20, 1932, together with the Use
District maps referred to therein, as heretofore amended, is hereby amended by
deleting from the Residence District the following described property:
All that part of the E2 of the W2 of Section 20,
Township 117, Range 21, lying North of Excelsior
Avenue; South of a line that is 50 feet South of
and meanders parallel with the Southerly edge of
Minnehaha Creek; East ,of the West 252.25 feet of
said E2 of the WI of said section; and West of
East 200 feet of said El of the W2 of said Section,
and including the same within the Commercial District, and it shall be subject
to all the regulations.and restrictions imposed by said ,ordinance within said
Commercial District.
Section 2. The applicant for said rezoning, Salkin & Linoff, Inc., having
represented to the Village Council that it proposes to construct upon said premises
a substantial building to be used by it for general offices, retail store and
distribution center for receiving, warehousing and distributing merchandise sold
by it through various retail stores operated by it at other locations, permission
is hereby granted to use the premises for such purposes, the Council interpreting
the exclusions from the Commercial District as set forth in Section 6 of said
Ordinance as not intended to exclude the proposed uses above described provided
that said premises shall not be used primarily as a storage warehouse or for the
storage and warehousing of goods owned by others than the owner or occupant of
the premises.
Section 3. This Ordinance shall take effect from and after its publication.

therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the total cost of each of said improvements is hereby determined to be in
the respective amounts hereinafter set forth in the following list and the amount
of benefits conferred by said improvement upon each lot, part of lot, piece or
III ' parcel of ground so benefited thereby ratably and in proportion to the special
benefits conferred upon it is hereby determined to be as respectively set forth
in the following list, and there is levied and assessed against each lot, part
of lot, piece or parcel of ground described therein as assessment equal to the
sums therein respectively set forth as authorized by Chapter 382, Laws of Minne-
sota, 1903, payable in three equal annual installments the first of which shall
be payable concurrent with real estate taxes levied in 1949 and collected in
1950 together with a penalty of ten per cent if not paid in full within 30 days
after publication of this resolution, and interest at 6 per cent per annum from
the date of issuance of orders for financing this improvement.

Request Permission to Use Storm Sewer
For Catch Basin Connection
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was
instructed to write the City of Minneapolis for permission to use their Storm
Sewer for a Catch Basin connection, to drain the low spot on the West side of
France Avenue at bus stop on Minnetonka Boulevard. Motion was passed by unani-
mous vote of the Council Members present.
Re solution
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of Council Members present.
