Council Members present. Resolution On motion of Trustee Perkins, seconded by Trustee- Bolmgren, the following resolution was passed by unanimous vote of all members of the Council present: RESOLUTION GRANTING PERMIT FOR USE OF PREMISES AS STUDIO III WHEREAS Martin G. Fowler and Alice J. Fowler have made application to the Council for a ruling under the Village Zoning Ordinance as to whether they can construct on Lots 3-41d 4;;Hazike&s Replat a single detached residence incor- porating therein an artist' s studio in which they desire to do commercial art work, make and sell handicraft objects of art and classes in drawing, painting, handicraft and applied arts, having not more than two associates on the premises at any one time; and WHEREAS the Council deems such use of the premises in violation of the use restrictions imposed in the Residence District when there are employees on the premises,' and likely to be a violation because amounting to the conduct of a business or private school on the premises, but WHEREAS the said premises front on Excelsior Boulevard which is a state highway carrying such heavy traffic as to be undesireable for residential purposes exclusively, and yet because of adjacent residential area, rezoning to commercial use is undesirable, and • WHEREAS the Village Council considers that use of said premises for said purposes would be in harmony with the,purpose and intent of the Zoning Ordinance and it would be for the best interests of the area and consistent with the purposes of said ordinance to permit these premises to be improved and used as requested, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that permit be hereby granted to Martin G. Fowler and-Alice J. Fowler to construct on Lots 3 and 4, Hanke's Replat, a single detached residence incorporating an artist' s studio therein which will face on Excelsior Boulevard and to use said studio_for drawing, painting, making of handicraft objects of art, and for teach- ing of drawing, painting, handicrafts, and applied art, provided that said occupations be carried on primarily by the occupants of the residence in such a manner as not to result in any noise or odors discernable in the adjacent resi- dential area, and provided further that no more than two persons be associated and working on the premises in said occupations at any one time. J Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following September 13, 1948 341 Resolution, Continued resolution was adopted by unanimous vote of all members of the Council present: **RESOLUTION REQUESTING COMMISSIONER • OF HIGHWAYS TO MODIFY SPEED ZONE WHEREAS the Commissioner of Highways more than ten years prior hereto determined that the portion of State Highways No. 212 and No. 169 extending along Excelsior Boulevard in the Village of St. Louis Park from France Avenue to Vernon Avenue be designated as a 40 mile speed zone, and; WHEREAS the Village Council of the Village of St. Louis Park and its law enforcement officers do now and have during al of said ten years considered that a speed in excess of 30 miles an hour was unsafe and unreasonable on said portion of said highways, and; WHEREAS during said ten years the population of the adjacent area has very substantially increased and said portion of said highway has become built up with retail business establishments including grocery stores, liquor stores, res- taurants, taverns, nurseries, gasoline service stations, drive-in eating places, and other retail stores; bus service along the highway has been increased so that there is now five to ten minute service, the buses making stops at nearly every block; and records of the Village Police Department show a substantial increase in automobile accidents along said highway and more accidents thereon than any other place in the Village, and; • WHEREAS said highway is unusually dangerous because of a curve, because of the many vehicles which are constantly stopping and coming on and off the highway from the many retail establishments adjacent thereto, because of its four lane widththe many pedestrians required to cross the highway coming to and from bus stops and retail stores find it impossible at times, especially at night, to cross without great danger, and because this highway is the route of many large commercial and transport trucks coming in and out of the City of Minneapolis, and because many drivers of vehicles on this highway take full advantage of the 40 mile speed zone, therefore BE IT RESOLVED that the Village Council of the Village of St. Louis Park, that the Commissioner of Highways of the State of Minnesota be hereby urgently requested to recognize the special hazards existing on said highways from France Avenue to Vernon Avenue and to rezone the said highways from a maximum speed of 40 miles per hour to 30 miles per hour. 30 MPH Speed Signs Ordered On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Police Department was directed to place 30 miles per hour signs on Excelsior Boulevard from Vernon Avenue to the West Village Limits, by unanimous vote of Councilmen present. Plans and Specifications On motion of Trustee Perkins, seconded by Trustee Bolmgren, plans and speci- fications prepared by the Village Engineer for grading projects Numbers N-6, N-16, N-120, N-122 to N-127 and N-134 to N-141 inclusive were approved, and the Clerk was directed to advertise for bids to be opened October 4, 1948, by unanimous vote of all Council Members present. Village Engineer Re-employed On motion of Trustee Perkins, seconded by Trustee Jorvig, J. C. Utton was re-employed as Village Engined on a full time basis at the same salary he received prior to his accepting part time employment -- $p6,000.00 per year be- ginning October 1, 1948. Motion was passed by unanimous vote of the Council. Use of Village Hall for Sunday School In behalf of the Union Congregational Church, Reverend Einar Martinson requested continued use of the Village Hall for Sunday School purposes. No action taken. Cooperative Road Construction On motion of Trustee Jorvig, seconded by Trustee Perkins, the Clerk and President were directed to request the Town Board of Minnetonka Township to co- operate in construction of a road West of the Village and south of Minnehaha Creek to County Highway No. 18 in St. Louis Park and Minnetonka Township. Motion was passed by unanimous vote of the Council. Examination for Assistant Fire Chief On motion of Trustee Jorvig, • seconded by Trustee Perkins, the Fire Civil 342 September 13, 1948 00 Examination for Assistant Fire Chief Service Commission was requested to hold an examination for Assistant Fire Chief at as early a date as practicable, by unanimous vote of Council Members present. Clerk Justad Clerk Justad came to the meeting at this time -- 9:30 P. M. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of Council Members present: RESOLUTION FOR ADDITIONAL BUS SERVICE (Minnetonka _Boulevard West of Georgia) WHEREAS there have been requests from home owners for additional bus service from the Twin City Rapid Transit Company's line along Minnetonka Boule- vard, West of Georgia Avenue, and WHEREAS many homes have been built in this area during recent months, now therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the Twin City Rapid Transit Company be requested to extend their present bus route West from Georgia Avenue to County Highway No.18, and grant riders of this bus the same fare and transfer privileges that now exist on the line. Special Permit to Connect to Water Main On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Suburban Sanitary Drayage Company was granted permission to run a water service line from the 12 inch water main at elevated tank #1 to the West end of their build- ing at 3612 Alabama Avenue, it being understood that they pay an assessment of $67.50 at the time the permit is taken out. This assessment to be credited to a future assessment when a water main is constructed past this property. Motion was passed by unanimous vote of Council Members present. Advertise for Bids for Painting Water Tank On motion of Trustee Bolmgren, seconded by Clerk Justad, the Clerk was instructed to advertise for bids for painting 500,000 gallon water tank, as per specifications on file in the Water Department; bids to be opened October 4, 1948. Motion was passed by unanimous vote of Council Members present. Change of House Number On motion of Trustee Bolmgren, seconded by Trustee Perkins, the correct house number for the house built on the East 100 feet of the South 230 feet of Lot E, Block 6, Forest Tract, Lake Forest Addition was determined to be 4300 West 24th Street, and the Building Inspector was instructed to change his records accordingly, and to assign 4230 West 24th Street to the house located on that part of Lot 19, Block 6, Forest Tract, Lake Forest Addition lying South of a line drawn from a point in the West line of said Lot 19 distant 90 feet South of the Northwest corner thereof to the Southeast corner of Lot 8, Block 6 in said Forest Tract, Lake Forest Addition to St. Louis Park. Motion was passed by unanimous vote of the Council. Ordinance Enforcing Use of House Numbers On motion of Trustee Jorvig, seconded by Trustee Perkins, the Village Attorney was instructed to draw up and ordinance designating and enforcing house numbers, by unanimous vote of the Council. Licenses Approved On motion of Trustee Perkins, seconded by Trustee Jorvig, the following applications for 1948 licenses were approved, and the President and Clerk were authorized to issue licenses to expire December 31, 1948, by unanimous - vote of.Council Members present. Gas Main Extensions On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Minneapolis September 13, 1948 343 Gas Main Extensions, Cont'd. Gas Company's request for gas main extensions was approved as follows, by un- animous vote of the Council: #/,08 3 inch main in Vernon Avenue from Werner Street (vacated) to Village Limits South of Werner Street. #4489 3 inch main in Inglewood Avenue from 218' South of South line of 39th Street West to • #3918 - Part of Lot 80, Auditors Subdivision #301. Mc Adams of Minneapolis, Minnesota as principal and Standard Accident Insurance Company of Detroit, Michigan as surety, dated August 26, 1948, in the amount of $4,000.00, was approved by unanimous vote of the Council. 345 September 13, 1948 Condemnation of Land On motion of Trustee Perkins, seconded. by Trustee Bolmgren, the condemna- tioh of land needed for the widening of intersection at Minnetonka Boulevard and West Lake Street was approved, and work ordered to start as soon as des- cription of land needed is received from the- County Engineer's office.
