Hearing - Water Main Extensions As advertised in the St. Louis Park Dispatch, a hearing was had on proposed water main extensions at the following locations: Louisiana Avenue from Kentucky Avenue to West 32nd Street Hampshire Avenue from Minnetonka Boulevard to West 29th Street West 26th Street from Vernon Avenue to Xenwood Avenue Xenwood Avenue from West 28th Street to West 27th Street Colorado Avenue from Minnetonka Boulevard to West 27th Street Quebec Avenue from Walker Street to West 24th Street • Rhode Island Avenue from Walker Street to West 35th Street West 44th Street from Dartt Avenue to Glenn Place ' Glenn Place from West 44th Street to South line of Lot 17, Block 12, Browndale Park ' Webster Avenue from West 26th Street to 270 feet South of 26th Street Zarthan Avenue from Morningside Road to Well #6 Morningside Road from Brookside Avenue to Yosemite Avenue Irving Johnson and Walter Segal appeared in favor of extension in Colorado Avenue.from Minnetonka Boulevard to West 27th Street. A. H. Reid, N. H. Epstein and G. S. Dycie appeared against the extension --- Mr. Epstein said Mr. Boling, 29th and Colorado Avenue was against the Colorado Avenue extension. According to Irving Johnson, Forest Hanson and Hobin Johnson were in favor of same. M. E. . Beighley, 4221 Zarthan Avenue and Mrs. M. Craft, 4211 Zarthan appeared against the extension in Zarthan Avenue; suggesting that they run same to Yosemite Avenue. Action on above proposed water main extensions was deferred to meeting to be held on May 10, 1948. ' Ordinance for Rezoning Authorized On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village , Attorney was instructed to prepare the proper ordinance for rezoning the follow- ing property, from Residential Use to Commercial Use: Lots 16 and 17, Block 1; Lots 7, 8, 9, 18, 19, Block 2, John A. Johnson' s Addition and an un- platted area bounded as follows: Commencing at the intersection of Dakota Avenue with Wayzata Boulevard; thence South along the center line of Dakota Avenue to the South line of Lot 9, Block 2, John A. Johnson's Addition extended West; thence West .along said extended line and parallel with Wayzata Boulevard, a distance of 1135 feet West of the center line of Dakota Avenue; thence ' North to Wayzata Boulevard; .thence East along the South line of Wayzata Boulevard to the point of beginning. Motion was passed by unanimous vote of Council Members present. Special Building Permits - Two-family Dwellings On motion of Trustee Perkins, seconded by Trustee Jorvig, the Building Inspector was instructed to issue to M. 0. Anderson, special permits to construct 226 May 3, 1948 Special Permits - Two-family Dwellings, Cont'd. three (3) two-family dwellings on Lots 30, 31, 32, Block• 5, Meadowbrook Addition, by unanimous vote of Council Members present. Building Permit - Commercial Building On motion of Trustee Perkins, seconded by Trustee Jorvig, H. J. Currie was granted a special permit to build his commercial building on Lot 14, Block 22, Park Manor Addition with a 20 foot setback from front lot line. Motion was passed by unanimous vote of Council Members present. Licenses Approved On motion of Trustee Perkins, seconded by Trustee Jorvig, the following applications for 1948 licenses were approved, and the President and Clerk were authorized to issue licenses to expire December 31, 1948, by unanimous vote of Councilmen present: • B. F. Myers (Dairy Queen) Restaurant Midwest Scavenger Co. _ • Scavenger Body & Fender Shop The matter of the Body and Fender Shop located at 9408 Frederick Avenue was discussed with the owner, Paul C. Altringer. He asked the Council how long he may stay there --- says he needs the business to raise his family. Claims he has fixed cars for nearly everybody in the neighborhood, except T. Jorvig. He said he would be out in 60 days. Special Permit to Connect to Water Main On motion of Trustee Perkins, seconded by Trustee Jorvig, a special permit was granted to James K. Seirup to run a copper tubing service connection from the residence at 7840 West Lake Street along an easement on the West 10 feet of Lot 16 and the Westerly 10 feet of the Northerly 50 feet of Lot 33, Block 155, Rearrangement of St. Louis Park to supply water for the above house from the Water Main on Cambridge Street, with the understanding that an assessment of $250.00 will be paid when the permit is taken out; said assessment to be credited to the future assessment for water main if and when it is constructed past this property. Motion was passed by unanimous vote of Council Members present. Plans & Specifications for Manhole On motion of Trustee Perkins, seconded by Trustee Jorvig, the plans and specifications for the manhole and sewer connection for depositing of scavenger loads, to be located on the Minneapolis and St. Louis Railway Right of Way, just West of Wooddale Avenue were approved, and the Clerk was instructed to advertise for bids for construction of same; bids to be opened May 24, 1948. Motion was passed by unanimous vote of Council Members present. Inside Boulevard - Dakota Avenue On motion of Trustee Perkins, seconded by Trustee Jorvig, the inside boulevard was set at 1 foot on both sides of Dakota Avenue from Minnetonka Blvd. to 28th Street, by unanimous vote of Council Members present. Grading - West 29th Street ' On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Engineer was instructed to grade to proper grade, West 29th Street from Edgewood Avenue to Florida Avenue; work to be done by Village Street Department. Motion was passed_by unanimous vote of Council Members present. Surface 39th Street - France to Joppa On motion of Trustee Perkins, seconded by Trustee Jorvig, the Street Department was instructed to surface West 39th Street from France Avenue to Joppa Avenue, and charge same to the Al Johnson Construction Company. Motion was passed by unanimous vote of Councilmen present. Police Report for April, 1948 The following Police Report for April, 1948 was read by President Erickson and ordered placed on file: _ 235 radio calls 127 arrests 4 warnings 5 aids 5 accidents 9 'phone calls 10,690 miles traveled Fireman' s Convention On motion of Trustee Jorvig, seconded by Trustee Perkins, two regular firemen, two volunteer firemen and one member of the Village Council were author- ized to attend the State Fireman' s Convention to be held at East Grand Forks, Minnesota, June 14, 15, 16, 1948, with necessary expenses paid, by unanimous vote of Councilmen present. 22 ( May 3, 1948 Report of Fires for April, 1948 • The following report of fires for April,' 1948 was read by Trustee Jorvig, and ordered filed: Buildings 3 • Grass 111 First Aid 1 Drills 2 Emergency 3 False 1 Found Nothing 1 122 Total for'year as of April 30, 1948 - - - - - 188 TOTALS FOR THE YEAR -- • - Buildings Valuation $305,200.00 • Insurance 248,950.00 Damage 3,415.00 • Contents Valuation 84,400.00 Insurance 64,850.00 Damage 1,160.00 Fire School Expenses Authorized On motion of Trustee Jorvig, seconded by Trustee Perkins,- the necessary expenses for Firemen attending Fire School in St. Paul, May 3, 4, 5, 1948, were approved by unanimous vote of Councilmen present. Parking Problems - Brookside & Excelsior Blvd. A letter dated May 3, 1948, from Philip K. Zorn, proprietor of the Lilac Way Dairy Bar at Brookside Avenue and Excelsior Boulevard was read regarding the parking problems in front of his store, and referred to President Erickson for action. Ordinance No. 299 On motion of Trustee Perkins, seconded by Trustee Jorvig, the following ordinance was adopted by unanimous vote of Council Members present: ORDINANCE NO. 299 • AN ORDINANCE REGULATING PARKING OF VEHICLES ON THE PUBLIC STREETS AND PLACES OF THE VILLAGE OF ST. LOUIS PARK _ The Village Council of the Village of St. Louis Park do ordain as follows: Section 1. No person shall stop, park, or leave standing any vehicle, whether attended or unattended, upon the paved or improved or main travelled part of any street or highway in this Village when it is practical to stop, park or so leave such vehicle off such part of the street or highway, but in every event a clear and unobstructed width of at least twenty (20) feet of such part of the street or highway shall be left for the free passage of other vehicles, and a clear view of such stopped vehicle shall be available for a distance of two hundred (200) feet in each direction upon such street or highway. Section 2. No person shall stop or park or leave a vehicle in a roadway other than parallel with the edge of the roadway, headed in the direction of - Ill traffic, and with the curb-side wheels of the vehicle within twelve (12) inches of the edge of the roadway, and not closer than four (4) feet to another vehicle parked at the curb, except that upon those streets which have been marked or signed for angle parking, vehicles shall be parked at the angle to the curb in- dicated by such marks or signs, Section 3. The driver of a vehicle intending to park at the curb of any street at a place about to be vacated by another vehicle shall stop back of said parking space and wait until said vehicle has vacated said parking space. The person so desiring to park shall then move his vehicle to a place immediately in front of said parking space and back into it, and the driver of any other vehicle approaching from the rear shall yield the right of way to such person for the purpose of parking at said parking space. In case there is no one in position immediately in front of said parking space prepared to back into it, and said 228 May 3, 1948 p'mRe Ordinance No. 299, Cont'd. parking space is large enough to permit it, the driver of an approaching vehicle may head into said parking space without backing. Section 4. When the weight or bulk of a load necessitates loading or un- loading a vehicle in a position backed up to the curb, such vehicle may be backed up to the curb for the purpose of loading or unloading, but only for a period of time necessary to so load or unload said vehicle, and no vehicle shall be backed up to a curb and remain in such position except as in this section authorized. Section 5. No person driving or in charge of a motor vehicle shall permit it to stand unattended on a grade without effectively setting the brake thereon and turning the front wheels to the curb or side of the highway. Section 6. Every person leaving a motor vehicle on a public street or highway shall lock the ignition, remove the key and take the same with him. Section 7. Existing signs which have been posted by the Village Council or the Chief of Police regulating parking of vehicles shall be recognized as properly placed under this ordinance until changed by proper direction of the Village Council. Section 8. No person shall stop, park, or leave standing any vehicle on any street or highway in this Village in front of the entrance to or exit from any theater, dance hall, church, hospital, school, or any hotel having twenty- five or more rooms, for the full width of such entrance or exit during the hours that such buildings are in use by the public. Section 9. The owner of any such building used for said purposes shall cause to be placed at such entrance or exit one hour before such building is opened to public use proper, adequate and visible signs subject to the approval of the Police Department, giving notice to the public of their hours of use of such building. Such signs shall be removed when such use by the building ceases. Section 10. Vehicles other than trucks shall not be parked in public alleys, and trucks shall not be so parked for a longer period of time than is necessary to load or unload commodities, and then not to exceed thirty (30) minutes. - Section 11. A vehicle may be brought to a stop on the left 'side of a high- way in one-way streets. Section 12. No person shall stop, park or leave standing a vehicle, whether attended or unattended, except in compliance with the directions of a police officer or traffic control device in any of the following places: (a) In front of a public or private driveway or within five feet of the intersection of any public or private alley with any highway. (b) Within an intersection. (c) Within ten feet of a fire hydrant. (d) On a crosswalk. (e) Within twenty feet of a crosswalk at an intersection. (f) Within thirty feet upon the approach of any flashing beacon, stop sign, traffic control signal or school sign at the side of a roadway. (g) Within fifty feet of the nearest rail of a railroad 'crossing. (h) Within twenty feet of the driveway entrance to any fire station or on the side of the street opposite the entrance to any fire station within seventy-five (75) feet of said entrance. (i) Along the curb adjacent to any public school property from 8 o'clock A. M. to 4 o'clock P. M. on days when school is in session. (j) Upon any bridge or approach or other elevated structure upon any highway or street. (k) At any place designated as a no parking zone or for longer than the time permitted in a limited time parking zone by the Village Council where signs are posted indicating the no parking or limited time parking zone. May 3, 1948 229 Ordinance No. 299, Cont'd. (1) In a private driveway or on other private property without permission of the owner. Section 13. The Village Council may designate no parking or limited time parking zones by the resolution setting forth the location of the zone, and in the case of a limited time parking zone, the time limit imposed. The Chief of Police shall post signs at locations so designated which shall either indicate, in accordance with the resolution, •a no parking zone or the specified time limit for parking, and if there is a concrete curb, the curb shall be painted yellow at the designated parking zone. 1 Section 14. Words and terms used in this ordinance shall be defined in accordance thereof set forth in Section 169.01 Minnesota Statutes. Section 15. This ordinance shall take effect and be in force from and after its publication. Bonds Approved On motion of Trustee Perkins, seconded by Trustee Jorvig, the following bonds were approved by unanimous vote of Council Members present: HEATING LICENSE BOND with Sigwald Engineer- ing Company as principal, and Standard Accident Insurance Company as surety, dated April 26, 1948, in the amount of $1,000.00. PLUMBING LICENSE BOND with Lloyd Burns, DBA Burns Plumbing & Heating Company as principal, and The Aetna Casualty and Surety Company as surety, dated April 12, 1948, in the amount of $4,000.00. SIDEWALK OR CURB AND GUTTER CONSTRUCTION BOND of Arthur E. Snyder and Morris Trach, dated April 28, 1948, in the amount of $500.00.
