Plans to Acquire Property for Lift Stations
and Park Purposes
On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village
Attorney was instructed to prepare forms to acquire from the State, Lots 21 and
22, Block 6, Wooddale Park and Lot 10, ,Block 11, Mc Nair Park for sanitary sewer
lift stations; and Lot 7, Block_3, Lot 4, Block 9, Westmorland Park for park
purposes. Motion was passed by unanimous vote of Councilmen present.
Plans to Acquire Property for Street Purposes
On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village
Attorney was instructed to acquire the West Thirty (30) feet of the South half
(SA) of the West half (4) of the East half (E2) of_the West half (4) of the
Northeast Quarter (NE ) of the Southwest Quarter (SWC.) of Section Thirty-one
(31), Township Twenty-nine (29), Range Twenty-four (24), according to the U. S.
Government Survey thereof, for street purposes. Motion was passed by unanimous
vote of Councilmen present.
Village Engineer, J. C. Utton Resigns to Work on Part Time Basis
A letter from Village Engineer, J. C. Utton, dated April 19, 1948, was read,
stating that it was necessary for him to lessen his responsibilities, and suggest-
ing that after May 15th, he serve the Village on a part time basis if the Council
so desired, until such time as the Council could secure a full time Engineer.
After some discussion, it was unanimously agreed by the Council that Mr. Utton
be requested not to resign as Village Engineer at this time.
On motion of Trustee Perkins, seconded by Clerk Justad, the offer of J. C.
Utton, made because of health, to act as Village Engineer on a part time basis
after May 15th, 1948 at the rate of pay established by the Minnesota Association
of Professional Engineers of $40.00 per day worked, until a full time Engineer
can be employed to take his place was accepted by unanimous vote of Councilmen
present.

,Hearing - Alley Vacation
A hearing was had on the petition of H. V. Kindseth and others, for the
vacation of alley in Block 174, Rearrangement of St. Louis Park. H. V. Kindseth
and W. J. Geimer appeared in favor of vacation, and presented a quit claim deed _
for the,West 15 feet of Lot 26, Block 174, Rearrangement of St. Louis Park to
give an outlet for alley. No one appeared against the petition. Consideration
was deferred one week to give the Village Attorney an opportunity to verify
ownership of property involved.
Store Building Setback (H. A. Currie)
IIIH. A. Currie appeared in regard to his building permit for store building
on Lot 14, Block 22, Park Manor --- he was issued a permit subject to setback
in line with houses built in block. Foundation is already in with a 20 foot set-
back --- should be 24.3 ft. Mr. Currie said the owners of homes West of his
property would approve the 20 foot setback. He was asked to bring in letters
from above mentioned home owners, and the Council would consider approving a new
setback.
Neighbors Oppose Trailer and Basement Homes
Neighbors from Brookside appeared in opposition to trailer home permitted
in that section. They were told that the permit was issued for six months, and
would be reviewed at that time. Next, basement homes were discussed. President
Erickson explained the basis on which permits were issued, saying that permits
must be taken out for complete house. They asked if there was a time limit on
the permit, and it was explained that the State Law allowed basements inhabited
until 1950. They all left.
Petition Against Sidewalk
A petition signed by June Clark and others against the construction of side-
walk on the West side of Dakota Avenue between 28th Street and 29th Street was
read; also some folks were in from the North end of the block asking that sidewalk
be constructed in front of the six lots on the North end of the block. It was
suggested that above petition be placed in file for meeting of June 15, 1948.
Report on Violation of Building Code '
IIIOn motion of Trustee Perkins, seconded by Trustee Jorvig, the building
inspector was instructed to make a full report on any violation of the Building
Code at 2800 and 2804, Dakota Avenue. Motion was passed by unanimous vote of
Council Members present.
Complaint - Speeding
Roy Whipps complained about cars speeding on Wooddale Avenue South of 42nd
Street. He said the Police are doing nothing about it. President Erickson said
he would make a check on this and see what could be done to stop the speeding.

On motion of Trustee Jorvig; seconded by Trustee Perkins, ,the following
ordinance was passed by unanimous vote of all members of.the Council present:

AN ORDINANCE LICENSING AND-REGULATING
DOGS AND REPEALING ORDINANCE NO. 8A
The Village Council of the Village of St: Louis Park do ordain as follows:
Section 1. - DOG LICENSE REQUIRED. No person shall own, keep, or harbor
any dog over the age of three months within the Village of St. Louis Park unless
a'license therefor has first been secured. Licenses shall be issued by the
Village Clerk for a fee of $2.00 for each male•dog and $3.00 for each unspayed female &
$2.00 for each spayed female dog. It shall be the duty of each person owning,
keeping, or harboring a dog to pay a license fee imposed by this Section to the
Village Clerk on or before the first day of January in each-year, or upon acquiring
ownership or possession of any unlicensed dog,-or upon establishing residence in
the Village to forthwith pay such license fee. The Clerk may cause a notice of the
necessity of paying such license fee to be printed in the official newspaper in
December of each year.
Section 2. Receipts for-Licenses. Upon payment of the license fee the
Clerk shall execute a receipt in_ duplicate, the original of which shall be de-
livered to the person who pays the fee and the duplicate retained in the records
of the Village. The receipt shall describe the dog as to breed and age.
Section 3. Tags. The Clerk shall also procure a sufficient number of
suitable metallic tags, the shape of which shall-be different for each license
year and he shall deliver one appropriate tag to the owner when the fee is paid.
The owner shall cause said tag to be affixed by a permanent metal fastener to
the collar of the dog so licensed in such a manner so that the tag may be easily
seen by the officers of the Village. The owner shall see to it that the tag is
constantly worn by such dog.
Section 4. Dog Pound and Dog Catcher. The Village Council shall from
time to time designate a place as Village Dog Pound where suitable arrangements
are made for keeping and maintaining any dogs which may be seized or taken into
custody by any officer of the Village pursuant to this ordinance. The Village
Council shall from time to time appoint an official dog catcher who shall have
the authority of a police officer of the Village insofar as necessary or proper
in the enforcement of this oidinance. Such dog catcher shall subscribe an oath
and give such bond as the Village Council may determine.
Section 5. Impounding of Unlicensed Dogs. It shall be the duty of the
police officers of the Village and the dog catcher to impound any dogs found in
the Village without the tag provided for in Section-2, or found running at large,
harbored or kept contrary to any provision of this ordinance. When any dog is
impounded as provided in this ordinance, the Chief of Police shall be notified
immediately and shall forthwith post in one or more conspicious places in the
Village notice of impounding which shall specify a description of the dog by sex,
color, and breed and the name of the owner if known, and shall give notice that
unless the dog is redeemed on or before a specified date, which shall not be less
than two nor more than five days thereafter, the dog will be killed or otherwise
disposed of as provided by this ordinance.
Section 6. Redemption of Impounded Dogs. Any dog impounded may be re-

deemed by the owner by payment to the Village Clerk of the current license fee
and an impounding fee of x$1.00 for each day the dog is confined in the pound.
Section 7. Disposal of Unredeemed Dogs. Any dog which is not claimed
as provided in Section 6 within five days after impounding may be sold for not
less than $5.00 to anyone desiring to purchase the dog. All sums so received
shall be delivered forthwith to the Village Treasurer. Any dog which is not
claimed by the owner or sold shall be painlessly killed and buried by the keeper
of the dog pound or upon direction of the Village Council may be delivered to
the University of Minnesota for scientific purposes.
Section 8. Certain Dogs Not Allowed to Run at Large. It shall be unlaw-
ful for any person owning, possessing, or harboring any dog within the Village,

or the parents or guardians of any such person under 21 years of age, to allow
any female dog in heat, any dog of vicious habits or which is likely to cause
injury to any person, and any dog which habitually chases automobiles, or molests
pedestrians on any public street or sidewalk to run at large. Any dog which has
attacked or bitten any human being or which habitually attacks other dogs or
domestic animals or which habitually rushes at or growls at any person outside
the owner's premises is hereby defined to be a dog of vicious habits for the pur-
poses of this section. No dog prohibited from running at large under this section
shall be permitted off the premises,of its owner unless such dog is accompanied
Ill by a person over the age of twelve years and is securely confined and controlled
by an adequate leash not more than zix feet long.
Section 9. Barking Dogs. It shall be unlawful for any person to own,
harbor, keep or have in his possession or on his premises any dog which by loud
and frequent .barking, howling, or yelping shall cause noise, disturbance, or
annoyance to persons residing in the vicinity thereof.
Section 10. Trespassing by Dogs. It shall be unlawful for any person
who owns, harbors, or keeps a dog, or the parents or guardians of any such person
under 21 years of age, to allow such dog to stray or trespass upon the premises
of any other person to the latter' s damage or annoyance.
Section 11. Dogs which are Public Nuisance. Every vicious dog and every
dog that runs at large, strays, trespasses, barks or causes disturbance, annoy-
ance, or noise in violation of the provisions of this ordinance is hereby declared
a public nuisance and it shall be unlawful to own, harbor, or keep such a dog.
Section 12. Proceedings for Destruction of Certain Dogs. Upon sworn com-
plaint to a Justice of the Peace of the Village that any one of the following
facts exist:
(a) That any dog at any time has destroyed property or habitually
trespassed in a damaging manner on property of persons other than
the owner;
(b) That any dog at any time has attacked or bitten a person
outside the owner's or custodian's premises;
(c) That any dog is vicious or shows vicious havits, or molests
pedestrians or interferes with the driving of automobiles on ,
the public highways;
(d) That any dog is a public nuisance as herein defined;
(e) That any dog is running at large or violates its quarantine
contrary to the provisions of this ordinance;
said Justice of the Peace shall issue a summons directed to the owner or person
having possession of said dog commanding him to appear before said Justice and
to show cause why said dog should not be seized and killed by the keeper of the
dog pound or any police officer or otherwise disposed of as authorized in this
ordinance. Such summons shall be returnable not less than two nor more than six
days from the date thereof and shall be served at least two days beofre the time
of appearance mentioned therein. Upon such hearing and finding the facts true
as complained of, the Justice of the Peace may either order the dog killed or the
owner or custodian to remove it from the Village or may order the owner or custod-
ian to keep it confined to a designated place. If the owner or custodian dis-
obeys such order he shall upon the filing of a complaint and after a hearing and
conviction before a Justice of the Peace bd liable to the punishment provided for
violation of this ordinance and any police officer or dog catcher may upon dis-
obedience of said order impound-and slay any dog described in such order of the
Justice of the Peace. The provisions of this section are in addition to and
supplemental to other provisions of this ordinance. Costs of the proceeding
specified by this section shall be assessed against the owner or custodian of the
dog.
Section 13. Interference with Enforcement. It shall be unlawful for any
unauthorized person to break open the dog pound or attempt to do so or to take or
let out any dogs therefrom or to take or attempt to take from any officer any
dog taken up by him in compliance with this ordinance or in any manner to interfere
with or hinder such officer in the discharge of his duties under this ordinance.
Section 14. Quarantine. Whenever any person owning, possessing or harbor-

ing any dog within the corporate limits of the Village of St. Louis Park shall
learn that such dog has bitten any human being, such person shall immediately
impound said dog in a place of confinement where it cannot escape or have access
to any human being or other animal and shall also immediately notify the Chief
of Police. Whenever the Chief of Police shall learn that any human being has
been bitten by any dog within said Village, he shall ascertain the identity of
such dog and the person owning, possessing or harboring it and shall immediately
direct such person to forthwith impound such dog as herein required. Any dog
so impounded shall be kept continuously so confined for a period of fourteen
days from the day the dog bit a human being.
-Upon learning that a dog-has bitten a human being, the Chief of Police
shall immediately notify the Commissioner of Health and inform him of the place
where the dog is impounded. It shall be the duty of the Commissioner of Health
to inspect said dog from time to time during its period of fourteen days' con-
finement and to determine whether such dog is infected with rabies. For this
purpose he shall have access to the premises where such dog is kept at all
reasonable hours and may take possession of the dog and confine it in the Village
dog pound or other suitable place at the expense of the owner. The owner or
person in possession or harboring such dog shall immediately notify the Com-
missioner of Health of any evidence of sickness or disease in the dog during its
period of confinement and shall promptly deliver its carcass to the Commissioner
of Health in case of its death during said period.
Section 15. Penalty Provision. Any person, firm, or corporation
violating any provision of this ordinance shall be guilty of a misdemeanor and
upon conviction thereof shall be punished by a fine of not more than $100.00
or imprisonment in the city jail for not more than ninety days.
Section 16. Repealing Provision. Ordinance No. A-8 adopted by the
Village Council July 30, 1926 and Ordinances Nos. A-8A and 62 amending said
ordinance are hereby repealed.
Section 17. Effective Date. This ordinance shall be in full force and
effect from and after its publication.
Advertise for Bids - Dump Truck
On motion of Trustee Perkins, seconded by Clerk Justad, the Clerk was
instructed to advertise for bids for a one to two ton dump truck for the Street
Department as perspecifications on file in the Clerk's Office; bids to be opened
May 17, 1948. Motion was passed by unanimous vote of Council Members present.
Advertise for Bids - Park Equipment
On motion of Trustee Jorvig, seconded by Trustee Perkins, the Clerk was
directed to advertise for bids 'for swings, teeters, jungle gyms and slides for
three locations --- bids should be submitted specifying groupings. Bids to be
opened May 17, 1948. Motion was passed by unanimous vote of Council Members
present.
Office Secretary - Recreation Office
On motion of Trustee Jorvig, seconded by Trustee Perkins, Mary Brown, 5710
West 36th Street was hired as secretary for Recreation Office at a salary of
$100.00 per month for four months. Motion was passed by unanimous vote of Coun-
cil Members present.
License Approved - Plumbing
On motion of Clerk Justad, seconded by Trustee Perkins, the application
of M. Conner, DBA Conner' s Plumbing Company, 212 South Tenth Street, Minneapolis,
Minnesota, for a license to do plumbing work was approved, and the President and
Clerk were authorized to issue licenses to expire December 31, 1948.

Trustee Jorvig left the meeting at this time - 10:30 P. M.
Petition - Tar Mat P-167
On motion of Trustee Perkins, seconded by Clerk Justad, the petition signed
by W. F. Hayes, 7911 Division Street, and others, dated April 26, 1948, for
the laying of tar mat on DIVISION STREET FROM QUEBEC AVENUE TO TEXAS AVENUE, was
referred to the Village Engineer and Chairman of the Street Department Committee
for checking and recommendation, by unanimous vote of_Council Members present.

checking and recommendation, by unanimous vote of Council Members present.
Permission to Place Poles
On motion of Trustee Perkins, seconded by Clerk Justad, the Northern
States Power Company was granted permission to place 3 poles on Edgewood Avenue
between Cedar Lake Road and Great Northern Railway (Estimate #81891), by unani-
mous vote of Council Members present. _
Purchase Lots
A letter from Paul R. Nelson, 2930 Raleigh Avenue, St. Louis Park, dated
April 14, 1948 was read in which he offered for sale to the Village, Lots 21, 22,
23, 24, Block 205, Rearrangement of St. Louis Park for $400.00, with the under-
standing that should the Village at any future date, change their plans and decide
to sell them, that he be given first opportunity to purchase them.
On motion of Trustee Perkins, seconded by Clerk Justad, the Village
Attorney was ordered to make the necessary arrangements to purchase Lots 21, 22,
23, 24, Block 205, Rearrangement of St. Louis Park at price quoted of $400.00.
Motion was passed. by unanimous vote of Council Members present.
Bid Awarded for Pump House for Well #6
On motion of Trustee Perkins, seconded by Clerk Justad, Phelps-Drake Co.
of Minneapolis, Minnesota were determined the lowest bidder of responsible bidddrs
for the construction of pump house for Well #6 to be located at 4241 Zarthan
Avenue, received November 24, 1947, and the President and Clerk were authorized
to enter into'a written contract in behalf of the Village on forms approved by
the Village Attorney, with Phelps-Drake Company for the construction of pump
house for Well #6 at the base bid of $11,590.00, / Motion was passed by unanimous
vote of Council Members present. plus Alt. Bid A of $750.00.
