Hearing - Street Vacation
A hearing was had on the petition of The Linde Air Products Company to >
vacate a portion of lex Avenue. The petitioner appeared by its attorney, and C=1
there were no objection.
Resolution
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the follow-
ing resolution was adopted by unanimous vote of all members of the Council:
RESOLUTION VACATING STREET
WHEREAS, petition of all of the owners of real property fronting on the
line of Rex Avenue adjacent to Lot 17, Block 164, and Lot 1, Block 57a, Re-
arrangement of St. Louis Park, has been duly filed with the Village Council re-

questing said portion of said street be vacated, and said Council has met at
the time and place specified in a notice embracing a copy of said petition duly

published and posted and has heard all persons interested, and it appears that
said portion of said street is not used and serves no public purpose, therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that all that portion of Rex Avenue adjacent to Lot_ 17, Block 164, and Lot 1, ,
Block 57a, Rearrangement of St. Louis Park, according to the plat thereof re-
corded in the office of the Register of Deeds of Hennepin County, Minnesota, as
the same is now dedicated and laid out in said Village be hereby vacated.

Tax Discussion
A discussion regarding high taxes was had with a group present from area
near Parkview. They were told that assessment made in 1947 were now in the

hands of the State and that we expected word from them 'in about three weeks.
The group were also told about the Board of Equalization meeting that would be
held on the fourth Monday in June, when 1948 `taxes will be received. No action
taken.
Hearing - Proposed Assessments
A hearing was had on proposed assessments for improvements M-33 and M-34.
No one appeared.
Resolution
On motion of Clerk Justad, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of all members of the Council present:
STREET IMPROVEMENT ASSESSMENT RESOLUTION
WHEREAS, pursuant to resolution of the Village Council adopted January
26, .1948, and published in the St. Louis Park Dispatch January 30, 1948, the
Village Council has met at the time and place specified in said resolution and
has heard all testimony offered by interested parties in connection with pro-
posed assessments for improvement M-33, tar that for alley in Block 4, Parkview,
and improvement M-34, tar mat for alley in Block 2, Browndale, and the Village
Council has set the amounts of benefits conferred by said improvements upon
each lot, part of lot, piece or parcel of ground benefited thereby ratably and
in proportion to the special benefit conferred upon it, now therefore,
BE IT RESOLVED by the Village Council of the Village of St. Louis Park
that the total cost of said improvement M-33 is 11504.00, 'and said improvement
M-34 is $541.80 and
BE IT FURTHER RESOLVED that the amount 'of special benefits conferred upon
each lot, part of lot, piece or parcel of ground for the cost of each of said
improvements determined as above set forth ii hereby determined to be as res-
pectively set forth in the following list, and there is hereby levied and
assessed against each lot, part of lot, piece or parcel of ground described
therein an assessment equal to the sums therein respectively set forth as author-
ized by Chapter 382, Laws of Minnesota 1903, 'payable in three 'equal annual in-
stallments the first of which shall be payable concurrent with real estate taxes
levied in 1948 and collected in 1949 together" with a penalty of 10% if not paid
in full within thirty days after publication 'of this resolution and interest at
6% per annum from the date of issuance of orders for financing this improvement.
Grading - Jersey & Kentucky between 32nd & 33rd
On motion of Trustee Bolmgreri, seconded by Trustee Jorvig, the Village
Engineer was instructed to contact E. H. Shursen or Pacific Investment Company
regarding the grading of Jersey and Kentucky 'Avenues between 32nd Street and
33rd Street, by unanimous vote of Councilmen `present.
Complaint - Odors from Republic Creosoting Plant
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was
instructed to write to the Republic Creosoting Company and inform them of
complaints received about smoke and odors emanating from their plant. Motion
was passed by unanimous vote of the Council.

Hearing - Sidewalk Assessments
A hearing was had on the sidewalk assessments for sidewalk constructed on
the South side of 41st Street between Webster and Zarthan Avenues. No one
appeared.

On motion of Trustee Bolmgren, seconded by Clerk Justad, action on above
mentioned sidewalk assessments was deferred to March 8, 1948, by unanimous vote
of Council Members present.
Petition - Vacation of Alley
' On motion of Trustee Bolmgren, seconded by Clerk Justad, the petition of
Wm. 'A. Reiners and Chester Newby, for the vacation of alley adjacent to Lots 20, E--1
22, and 23, Lilac Way Terrace was referred to the Planning Commission, by un-
animous vote of Councilmen present.
Estimates Approved
On motion of Trustee Bolmgren, seconded by Clerk Justad, the following
Estimates of contract work in progress as presented by Village Engineer J. C.
Utton'was approved, and the President and Clerk were authorized to issue warrants
covering same, by unanimous vote of Councilmen present.

On motion of Trustee Bolmgren, seconded by Clerk Justad, the petition of
Maurice L. Gordon, 2824 Vernon Avenue, St. Louis Park and others; dated February
24,• 1948, for the construction of sidewalk on the West side of Vernon Avenue, be-
tween 28th and 29th Streets, was referred to the Village Engineer and Street De-
partment Committee for checking and recommendation, by unanimous vote of Council
Members present.
Petition - Water Main
On motion of Trustee Bolmgren, seconded by Clerk Justad, the petition signed
by Erwin A. Johnson, 414 Builders Exchange, Minneapolis and others, dated Feb-
ruary 16, 1948, for the construction of water main in Colorado Avenue between
Minnetonka Boulevard and a point 360 feet North of 28th Street, was referred to
the Village Engineer and Water Department Committee, by unanimous vote of Council
Members present.
License for 3.2 Beer On Sale (Non Profit)
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the application
of Frank H. Lundberg Post, American Legion for a license to sell 3.2 beer On-
Sale under Ordinance #287, was approved, and the President and Clerk were author-
ized to issue license to expire December 31, 1948. Motion was passed by unani-
mous vote of Council Members present.
Protest Against Liquor License
The following letter dated February 17, 1948 wa§ read and ordered filed
with Liquor License Applications:

Gentlemen:
At a recent meeting of the membership of Wooddale Luthern
Church, the fact was called to our attention that a license
for liquor is being sought for a certain location in St. Louis
Park. After considerable discussion a motion was duly made,
seconded and carried that a letter of protest be written to
the Village Council, stating that Wooddale congregation objects
to the issuance of any additional liquor license now, or at any
time in the future, to any place within one-half mile distance
from the church grounds at Fortieth and Wooddale.
Please file this letter for future reference when this matter
is again brought up for consideration.

Bingo - Police Association
A letter from the Suburban Police Association, dated February 28, 1948,

requesting permission to play Bingo at their Annual Spring Dance to be held at
the American Legion Hall, April 1, 1948, was read. No action taken.
Water and Sewer School and Plumbers School
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, Ira Vraalstad
was authorized to attend the Water and Sewer School to be held at the University
of Minnesota, March 15th to 20th, 1948; and Edwin Gilbert to attend the Plumbers
School during the same period, with all necessary expenses paid. Motion was
passed by unanimous vote of Council Members present.

IIIOn motion of Trustee Bolmgred, seconded by Trustee Jorvig, the application
of L. V. Foye for the following 1948 licenses was approved and the President and
Clerk were authorized to issue licenses to expire December 31, 1948:

Permission to Place Poles
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Northern
States Power Company was authorized to place two (2) poles in alley between
Raleigh and Salem Avenues and 27th and 28th Streets, by unanimous vote of Council
Members present.
Minutes
The minutes of meeting held February 16, 1948 were read and approved as
read.
Special Permit to Connect to Water Main
On motion of Trustee Bolmgren, seconded by Clerk Justad, a special permit
was granted to -Alfred E. Johnson to connect the home at 5521 West 42nd Street
to the water main in Webster Avenue and West 42nd Street for water service in said
home, with the understanding that the owner of said property pay an assessment of
$67.50; said payment to be credited to the future water main assessment when the
III water main is laid past the said property. Motion was passed by unanimous vote
of Council Members present.
