No one appeared. • Re solution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION ADOPTING WATER MAIN ASSES W NTS WHEREAS proposed assessments for the cost of water main Improvements N-91, N-100 and L-95 have been duly filed with the Village Clerk and open to public inspection and notice has been published in the St. Louis Park Dispatch September 17, 1948 that the Village Council would pass upon said_proposed assessments at this meeting, and the Council has met at the time and place specified in said notice and heard and passed upon all objections to said assess- - ments, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said proposed assessments which are hereby referred to and made a part hereof are hereby adopted and an assessment is hereby levied against each of the lots, parts of lots, pieces and parcels of land described therein in the sums therein respectively set forth and each of said tracts of land is hereby found to be benefited in the amount.of the assessment levied against it herein, and, • BE IT FURTHER RESOLVED that each. assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first to be payable on the first day of June, 1949, all deferred payments to bear interest at the rate of 5% per annum commencing November-1,- 1948; said_assessments and interest shall be a lien upon the property therein specified concurrent with general taxes as authorized by Chapter 65, Laws of Minnesota 1919 as amended. Hearings Re: Sanitary & Storm Sewer Assessments Separate hearings were had upon each of the proposed-assessments for construction of sewers described in the following resolution. No- one appeared. • Resolution On motion of Trustee Perkins, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION LEVYING ASSESSMENTS FOR SANITARY AND STORM SEWERS WHEREAS pursuant to notice published in the St. Louis Park Dispatch September 17, 1948, the Village Council has-met and passed upon all objections to the proposed asses•sments for construction of sanitary sewers for Sanitary Sewer Districts No. 2-D, No. 1-I, No. 1-0, No. 1.Q, and No.__2-B,_No_._1-P-;-and Storm Sewer Districts No. 17-1, No. 17-2, No. 17-3 and No. 17-4, separate hear- ings having been conducted for each improvement, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the proposed assessments, which have been on file with the Village Clerk, for each of said improvements be hereby affirmed and adopted and the same shall constitute special assessment against the lands named therein and each lot, piece or parcel of land included in said assessments is hereby found to be benefited'by the respective improvements in the amount of the assessment levied against it. BE IT FURTHER RESOLVED that such assessments shall be payable in equal` annual installments over a period of ten (10) years, the first of said install- ments to be payable on the first day of January, 1949 and succeeding install- ments on the first day of January in each year thereafter until the full amount of said assessment is paid. Said special assessments and each installment thereof shall bear interest at the rate of 5% per annum until fully paid, said interest to be computed from November 1, 1948; said special assessments with the accruing interest thereon shall be a paramount lien upon the property in- cluded therein from the time of the adoption of this resolution and shall remain as such lien until fully paid as authorized by Chapter 312, Laws of Minnesota 1903, as amended, and, BE IT FURTHER RESOLVED that all moneys collected on any such special assessments shall constitute a fund for the payment of the cost of the improve- ment for the respective districts above described, and the same shall be credited to the proper sewer district fund. Complaint Re: Outside Privies Ed. E. Scharnueber, 3053 Nevada Avenue (Main 7151, Ext. 234) and others reported a number of outhouses or privies in Boulevard Heights area - from 368 October 11, 1948 CO Complaint Re: Outside Privies, Conttd. Minnetonka Boulevard to 32nd Street and Maryland Avenue to Pennsylvania Ave. They asked if there was an Ordinance prohibiting privies; also asked what action they as citizens could take to correct the condition. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above matter was referred to the Health Department and Village Attorney for checking and recommendation, by unanimous vote of Council Members present. Hearing Date Set for Rezoning Maurice Mandel asked for a permit to build two (2) ten-family apartments on Lots 6 and 7, Block 13, St. Louis Park. The Planning Commission in their_ letter dated October. 9, 1948 approved rezoning of these lots from "C" to "D" Density. On motion of Trustee Perkins, seconded by Trustee Bolmgren, October 25th, 1948 was set as date for hearing on the rezoning from "C" Density to "D" Density, Lots 6 and 7, Block 13, St. Louis Park Addition, by unanimous vote of the Council. Building Permit for Oil Station On motion of Trustee Perkins, Seconded by Trustee Bolmgren, the Building Inspector was authorized to issue a building permit to George T. Butler for the construction of an oil. station on the east' end of Block 187 and vacated Street adjoining, according to plat presented to the Council. Motion was passe&by unanimous vote of the Council. Hearing Date Set - Garage Business On motion of Trustee Jorvig, seconded by Trustee Perkins, October 25, 1948 was set as date for hearing on request of Nordlang and Johnson fora special permit to conduct a garage business at 6504 Walker Street, by unanimous vote of the Council. - Bingo - A request dated September 29, 1948, from St. George's Episcopal Church, signed by Mrs. Herbert H. Stevens, 3806 Glenhurst Avenue, for permission to play Bingo at the American Legion Hall, October 29, 1948 was read. No action taken. Notice to Repair Sidewalk On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Village Engineer was instructed to give required three days written notice to I. J. Donnelly Construction Company to repair damaged sidewalk and curb and gutter on Webster Avenue between Excelsior Boulevard and West 41st Street; and if owrk is riot done within three days after notice is received, the Village Engineer is hereby instructed to proceed with repairs, the cost thereof to be charged against the balance of contract price due the Contractor. Motion was passed by unanimous vote of the Council. • Proposed Amendments to- Zoning Ordinance On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the proposed amendments to the Zoning Ordinance as approved by the Planning Commission , September 21, 1948, were referred to the Village Attorney, by unanimous vote of the Council. Bid Awarded - Ford Chassis with Cab On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid received October 4, 1948, for "1 Model F8 Ford Chassis with cab, two speed rear axle, six 900 x 20 tires, 195 inch wheel base, from Miner Company, was determined to be lowest bid received from a responsible bidder, and the President and Clerk are hereby instructed to sign agreement for delivery of same, by unanimous vote of the Council. The plat book of the Village of St. Louis Park in which exist- ing house and building numbers have been designated on the respective lots and tracts by the building inspector, which is filed with the Village Clerk and labeled "House Number Plat Book" is hereby adopted as the official house and building number plat of the Village, and the numbers therein designated are here- by approved and assigned as the numbers to be used and displayed on each and every house and other building situated on the respective tracts or lots as in- dicated on the plats in said book. Section 2. The building inspector is hereby authorized and directed to designate and assign house and building numbers to each and every house and other building constructed hereafter or which may not heretofore have been numbered in accordance with the numbering plan used in said official plat book, such numbers to be appropriately entered on said plats and ypon building permit issued. Section 3. Any owner of property who considers that the building inspector has erroneously designated a number for his property may petition the Village Council to designate a different number, and the Council may in such case con- sider the petition and either sustain the action of the building inspector or designate a different number and on notice to the owner or occupant of any premises the Council may change any number heretpfore designated by the building inspector or on said plat which does not conform to the plan of numbering appearing on the plat. Section 4. No owner or occupant of any house or other building within the Village of St. Louis Park shall display or permit to be displayed on the exterior of such house or other building any number for identification purposes.other than the number designated and assigned for such property on the official plat. Any number displayed on any house or other building for any purpose other than identification in such a manner as to cause confusion in identification of such house or other building with other houses or buildings in the vicinity shall be removed by the owner or occupant on order of the Village Council within such time after the notice of the order as the Council may designate in the order. Section 5. Any person who shall violate any provision of Section 4 of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed $100.00 or in default of payment of the fine by imprisonment for not to exceed 90 days. . Section 6. Any number displayed on the exterior of any house or building in violation of this ordinance may be removed by any police officer of the Village actinb under direction of the Village Council. Section 7. This ordinance shall take effect from and after its publica- tion. Permission to Place Pole On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Northern States Power Company was granted permission to place one (1) pole on Franklin Avenue - Georgia and Hampshire Avenues, by unanimous vote of the Council. Gas Main Extension On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Minneapolis Gas Company was granted permission to construct a 3 inch gas main in 26th Street from France Avenue South to #3900 - Lots 5 and 6, Block 5, Basswoods Addition, by unanimous vote of the Council. 370 October 11, 1948 1.3 Justice of Peace Report of Fines Justice of Peace, N. W. Joubert's report of fines covering cases Nos. 595 thru 624 was read and ordered filed.' Painting 500,000 Gallon Water Tank On motion of Trustee Bolmgren, seconded by Trustee Perkins, Midway Waterproofing Company, bidder on painting of 500,000 gallon water tank, was authorized to strike out the following sentence in his bid dated October 4, 1948: "IF ALL OF THE QUOTATIONS ARE ACCEPTED AS ONE' UNIT PRICE, DEDUCT THE SUM OF 5% FROM LUMP SUM BID". Motion was passed by unanimous vote of Council Members present. Bonds Approved On motion of Trustee Perkins, seconded by Trustee Jorvig, the following bonds were approved by unanimous vote of the Council: HEATING LICENSE BOND with Clifford J. Condemnation Proceedings • On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Attorney was instructed to start condemnation proceedings for the opening of the North and South Streets in Supreme Park 1st Division, by unanimous vote of the Council. Deeds Accepted On motion of Trustee Perkins, seconded by Trustee Bolmgren, the two deeds for Quentin Avenue from 27th Street to 28th Street as described below were accepted and ordered recorded, by unanimous vote of the Council: For use as a public street, that part of the west 30 feet of the east half of the west half of the NE quarter of the SW quarter of Section 1. 31, Township 29, Range 24, according to the U. Bill Charges for Grading On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Clerk was instructed to' bill the Pacific Investment Company $610.00 for grading of Kentucky Avenue from 32nd Street to 33rd Street; and $635.00 for grading of Jersey Avenue from 32nd Street to 33rd Street, and deduct those amounts from the assessments for these two job, and spread the rest. Motion was passed by unanimous vote of' Council Members present. Hearings - Sidewalk Assessments Separate hearings were had upon each of the sidewalk assessments described in the following resolution. No one appeared.
