Bids/Well #6 Pursuant to advertisement for bids in the St. Louis Park Dispatch, bids were received for the drilling of Well #6 at Zarthan Avenue and West 42nd Street from the following Bidders: 1. Keys Well Drilling Company x$19,805.00 On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above bids were referred to the Village Engineer and Water Department Committee for tabu- lation and recommendation, by unanimous vote of the Council. Bids/2i Inch Hose Pursuant to advertisement for bids in the ,St. Louis Park Dispatch, sealed bids were received for 1,000 feet of 22 inch hose from the following bidders: 1. Hewitt Rubber Company On motion of Trustee Perkins, seconded by Trustee Jorvig, the above bids were referred to the Village Engineer for tabulation and recommendation, by unani- mous vote of the Council. Hearing/Rezoning (A. W. Lampe) Pursuant to advertisement in the St. Louis Park Dispatch, a hearing was had on the petition of A. W. Lampe to rezone from "C" Density to "D" Density that part of Lot 1, Block 10, Brookside, lying North_of the South_122 feet thereof. A. W. Lampe said he planned to build an eight-family apartment build- ing, containing 3i to 4 room apartments. Building to be 87 feet long, 36 feet at one end and 32 feet at the other - 16 feet from Brunswick Avenue and 20 feet from Excelsior Boulevard. Eight men from the neighborhood appeared- as follows: Wayne A. Stone, 4070 Brunswick Avenue, M. H. Heinecke, 4082 Brunswick Avenue, R. J. Nylander, 4074 Brunswick Avenue, J. Leslie, 4059 Brunswick Avenue, F. F. McKenzie,. 6217 Excelsior Boulevard, Dr. A. J. Carroll, 4066 Brunswick Avenue, C. W. Hobbs, 4065 Brunswick Avenue and C. W. Johnson, 4073 Brunswick Avenue. All eight men said they were against the construction of an apartment building. M. E. Niedenfour, 3974 Dakota Avenue spoke for the apartment, but against a commercial building. Dr. Carroll said he feels that no commercial store should be built there. A. W. Lampe said he had a garage in mind. Mr. Hobbs said a garage would be unwise there. Mr. McKenzie said it would be dangerous for children. Mr. Nylander said there would not be room for five cars on space in back of building. The petition received June 16, 1947 in this regard was read. • On motion of Trustee Perkins, seconded by Trustee Jorvig, the above petition was referred to Committee of the Whole, by unanimous vote of the Council, Two-Family Dwelling • Mr. Munson, 3716 Huntington Avenue asked about building a two-family dwelling on Lots 1 to 5, Block 2, Minikanda Vista Second Addition. He was asked to bring in a written request, and the Clerk was instructed to refer same to the Planning Commission. Building Permit/Commercial Building On motion of Trustee Perkins, seconded by Trustee Jorvig, the Building Inspector was instructed to issue a building permit to A. E. Lindahl for the construction of a commercial building on property just West of Edgewood Avenue and Great Northern Railroad Tracks, by unanimous vote of the Council. Shooting at Gravel Pit Mr. Hay appeared regarding shooting at the Gravel Pit located North of Minnetonka Boulevard and West of Texas Avenue. Trustee Jorvig suggested that "No Shooting" signs be placed on the property. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above matter was referred to the Police Committee for action, by unanimous vote of the Council. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION SETTING SIDEWALK ASSESSMENT HEARINGS WHEREAS, the Village Council of the Village of St. Louis Park has hereto- fore entered into contract for construction of sidewalks at the following lo- cations in said Village which have been completed within thirty days prior hereto: Browndale Avenue adjacent to Lots 17 and 18, Block 2, Browndale Park Dakota Avenue adjacent to Lots 1 to 7, Block 1, Parkview Edgewood Avenue adjacent to Lots 25 to 28, Block 1, Parkview ' West side of Georgia Avenue from 31st Street to 32nd Street September 15, 1947 Resolution, Continued: , East and West sides of Georgia Avenue from 28th Street to 29th Street \ East side of Idaho Avenue from 31st Street to 32nd Street '- East side of Idaho Avenue from Minnetonka Boulevard to 31st Street South side of 40th Street from Ottawa Avenue to West line of Lot 10, Jerome and Wilder Addition Xenwood Avenue adjacent to Lots 175 to 192, Norwaldo Minnetonka Boulevard from 150 feet East of Salem Avenue to 351 feet East of Salem Avenue Joppa Avenue adjacent to Lots 19 to 26, Thorpe Brothers Cedar Lake Heights - Block 3 Browndale Avenue adjacent to Lots 22 and 23, Block 11, Browndale Park Xenwood Avenue from 33rd Street to North line of Lot 122, Norwaldo Therefore, BE IT RESOLVED that the Village Council will meet at the Village Hall in said Village on the 6th day of October, 1947, at 8 o'clock P. M. and will hear testimony of all persons interested or affected and ascertain the amount of benefit to property fronting each of said sidewalks by reason of the construction thereof. License/Cigarette On motion of Trustee Perkins, seconded by Trustee Bolmgren, the applica- tion of Clifford J. Andreasen, 3933 Wooddale Avenue, DBA Lilac Way Service Station, for a license to sell cigarettes was approved, and the President and Clerk were authorized to issue license to expire December 31, 1947, by unani- mous vote of the Council. Certify Monies to take up Water Works Bonds On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Clerk was instructed to write a letter to the County Auditor, Hennepin County, certi- fying that there is on hand in Water Department Funds, $8,420.00, or sufficient amount to take up Water Works Bonds and pay interest due May 15, 1948. Motion was passed by unanimous vote of the Council. Bid Awarded/Sanitary Sewer 1-0 On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Western Underground Construction Company received September 8, 1947, for the construction of Sanitary Sewer 1-0, was determined the lowest bid of a responsible bidder, and the President and Clerk were authorized to enter into a contract with Western Underground Construction for same in behalf of the Village for the amount of bid - $7,336.80. Motion was approved by unanimous vote of the Council. Comylaint/Property Damage A letter dated September 12, 1947, from C. E. Robertson, 5100 West 40th Street, was read regarding certain damages done to his property by Sewer Con- tractor. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the com- plaint of C. E. Robertson was referred to the Village Engineer for attention, by unanimous vote of the Council. Resolution/Water Revenue Bonds On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION PROVIDING FOR AWARD AND SALE'OF WATER SUPPLY SYSTEM REVENUE BONDS WHEREAS, the Village Council on August 25, 1947, adopted a resolution for issuance of Water Supply System Revenue Bonds aggregating $140,000.00 to be dated October 1, 1947, and to be issued in denominations with maturities and in 18. September 15, 1947 1-3 00 Resolution/ Water Revenue Bonds, Conttd. the form therein specified, and WHEREAS, in response to advertisement for bids published in the St. Louis Park Dispatch August 29 and September 5, 1947, the Village Council has met_at the time and place specified in said advertisement and opened and considered the following bids for purchase of said bonds: NAME OF BIDDER INTEREST RATE PREMIUM Harold E. Wood and Company 22% $165.00 Piper, Jaffrey & Hopwood) 2% - 1948 to 1951 Allison-Williams Company) 2 1/4% - 1953 to 1957 And Associates ) 2 3/4% - 1958 to 1966 Paine, Webber, Jackson & Curtis) Caldwell, Phillips Company ) 2 3/4% $490.00 and, WHEREAS, at the request of several prospective bidders the Village Clerk has notified all persons who received the prospectus relating to the sale of said bonds that the Council would amend said resolution of August 25, 1947 by elimi- nating subparagraph "e" from the paragraph defining net revenues and by provid- ing for a bond reserve account in the sum of $15,000.00, and bids have been re- ceived from all bidders upon such basis, and WHEREAS, the Council has determined that the bid of Harold E. Wood and Company is the highest and best bid, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said resolution of August 25, 1947, be hereby amended by eliminating from the paragraph thereof relating to the definition of the net revenues the follow- ing subparagraph: "e. Principal aggregating $32,000.00 and interest maturing during the years 1941 to 1951 inclusive on Water Works bonds of the Village of St. Louis Park issued May 15, 1941." and that the paragraph of said resolution following the said paragraph relating to net revenues be amended to read as follows: "BE IT FURTHER RESOLVED that such net revenues shall be segregated by the Village Treasurer and there shall be set apart from such net revenues and transferred each month to a Sinking Fund Account which is hereby created, a sum not less than one-twelfth of the amount which will be required to pay the principal and interest of the bonds issued pursuant to this resolution within twelve months next ensuing. The sum of $15,000.00 is hereby transferred from the Water Utility Fund to a Bond Reserve Account which shall be used for no purpose other than to pay principal and interest on Water Supply Revenue Bonds issued hereunder at such times as the same shall be- come due and there shall be insufficient funds in the sinking fund account for this purpose. Whenever the moneys in said Bond Reserve Account shall be less than $15,000.00, forty per cent of any surplus net revenues remaining after the transfer of required net revenues to sinking fund account for *payment of interest and principal of out- standing Water Supply System Revenue Bonds of the Village shall be • transferred to said Bond Reserve Account and accumulated therein until the moneys in said account shall equal $15,000.00 ' Any balance of the net revenue over and above those required herein to be paid into the Sinking Funds and Bond Reserve Account may be retained in the general water fund and used for such purpose as the Village Council shall direct." and, BE IT FURTHER RESOLVED that the form of bond as authorized in said resolu- tion be amended with respect to the covenant on the part of the Village to maintain a reserve and that the following sentence relating thereto: "And to create and maintain a reserve for such purpose in amounts which shall be not less than the principal and interest to September 15, 1947 19 Resolution/Water Revenue Bonds, Cont'd. fall due within one year next ensuing" shall read as follows: "And to create and maintain a reserve for such purpose the sum of $15,000.00." and, BE IT FURTHER RESOLVED that the offer of Harold E. Wood and Company to purchase said Water Supply System Revenue Bonds, October 1, 1947 Series, aggre- gating $140,000.00, at a price of par and accrued interest plus $165.00 premium, is deemed the highest and best offer and a favorable offer and is hereby accepted; that the President, Clerk and Treasurer of the Village be hereby authorized and directed to execute and deliver- to said purchaser upon payment of the purchase price said bonds in form and with maturities and in denomina- tions as specified in said resolution of August 25, 1947, and upon the terms and conditions of said resolution as herein amended, and bearing interest at 22% per annum payable semi-annually, and BE IT FURTHER RESOLVED that the proceeds from the sale of said bonds be placed in tie Water Utility Fund of the Village for the uses and purposes described in the said resolution of August 25, 1947, and BE IT FURTHER RESOLVED that the President and Clerk of the Village be hereby authorized to execute purchase agreement submitted by said purchaser, and BE IT FURTHER RESOLVED that the Village Clerk be authorized to secure the printed bonds at the expense of the Village. Bingo A letter dated September 13, 1947 from Mrs. John J. Gillette, Chairman of Chaplet Club, Most Holy Trinity Church, stating that they would play Bingo at the Legion Hall, October 11, 1947, was read and no action taken. Justice of Peace Report (N. W. Joubert) Justice of Peace report of fines, dated September. 6, 1947, presented by Justice of Peace, N. W. Joubert was read and ordered filed. Permission to Place Pole On motion of Trustee Perkins, seconded by Trustee Bolmgren, the application of the Northern States Power Company for permission to place one (1) pole on Zarthan Avenue, North of 36th Street was approved by unanimous vote of the Coun- cilmen present. Permission to Employ a Minor On motion of Trustee Bolmgren, seconded by Trustee Jorvig, Carl Reiss was granted permission to employ his son Richard, age 20, in his 3.2 On and Off- Sale establishment, by unanimous vote of the Council. Building Permit/Public Garage • On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Building Inspector was authorized to issue a building permit to Vilhelm Roland to construct a public garage as per plans prepared by K. B. Skrivseth, on Lots 3 and 4, Block 14, Minikanda Vista, by unanimous vote of the Council. Skating Rinks/1947-8 On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Park Board . was authorized to prepare the following sites for ice skating rinks for the 1947-1948 season; and the Street Department Foreman instructed to use the neces- sary men and equipment from his Department to do the work. Lots 13, 14, 15, Brookside, Block 3 Alabama Avenue and 39th Street (Corner) Minikanda Vista (The newly developed park site) Possible maintenance of a rink on Lake at Lake Forest Resolution/Proposed Assessments Lateral Sanitary Sewers On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION APPROVING PROPOSED ASSESSMENTS FOR LATERAL SANITARY SEWERS111 WHEREAS, the Village Engineer has calculated the proper amount to be specially assessed for lateral sewers constructed for Lateral Sanitary Sewer Districts 2-A, 1-N, 1-L and 1-M and for storm sewers constructed for Storm Sewer Districts Nos. 15 and 16, and has calculated the amount to be specially assessed for each of said sewers against each lot, piece or parcel of land in the said respective sewer district, and tabulations thereof have been duly prepared and filed with the Clerk in duplicate as proposed assessments and have been laid - before the Village Council at this present meeting held not more than ten days after the filing thereof, now therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the total cost of each of said sewers is hereby determined to be as follows: Sanitary Sewer District No. 2-A $ 4,957.00 Sanitary Sewer District No. 1-N $ 4,199.30 Sanitary Sewer District No. 1-L $ 7,928.61 Sanitary Sewer District No. 1-M $„ " 9,846.37 Storm Sewer District No. 15 $ 18,301.22 Storm Sewer District No. 16 $ 1,589.66 and BE IT FURTHER RESOLVED that said proposed assessments are hereby approved, and the Clerk is directed to cause notice to be published in the St. Louis Park Dispatch, September 19, 1947, that the Village Council will pass upon said pro- posed assessments at its next regular session to be held at the Village Hall, October 6, 1947. Ordinance 277 On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following Ordinance was passed by unanimous vote of the Council: ORDINANCE NO. 277 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE_ OF ST. LOUIS PARK The Village Council, of the Village of St. Louis Park do ordain as follows: Section 1. Section 2 and Section 14 of the Zoning Ordinance of the Village of St. Louis Park adopted January 20, 1932, as heretofore amended, is hereby further amended, and the maps referred to therein are hereby further amended by deleting from that portion of the Village zoned for residential use "C" Density the following described property: East one-eighth (1/8) of the Northwest Quarter of Northwest Quarter (NW 1/4 of NW 1/4) and that part of Northeast Quarter of Northwest Quarter (NE 1/4 of NW 1/4) lying West of a line parallel with and distant 250 feet East from_the West line of the East one-eighth (E 1/8) of the Northwest Quarter of the Northwest Quarter (NW 1/4 of NW 1/4), Section 6, Township 128, Range 24, except West 150 feet, and including said property within that portion of the Village zoned for multiple dwelling use "D" Density. Section 2 of said Ordinance as heretofore amended is hereby further amended, and the maps referred to therein are hereby further amended by deleting from that portion of the Village zoned for commercial use the following described property: Lots forty-four (44), forty-five (45) and forty-six (46), Block One (1), Brooklawns and including said property within that portion of the Village zoned for resi- dential use. 111 Ordinance No. 278 On motion of Clerk Justad, seconded by Trustee Bolmgren, the following Ordinance was passed by unanimous vote of the Council: ORDINANCE NO. 278 AN ORDINANCE AMENDING ORDINANCE NO. 67 RELATING TO THE SALE OF NON- INTOXICATING MALT LIQUOR The Village Council of the Village of St. Louis Park do ordain as follows: Section 1. Section 3 of Ordinance No. 67 entitled "An Ordinance Relating to the sale of Non-Intoxicating Malt Liquor or Beverage,"_adopted by the Council, March 31, 1933, as heretofore amended, is hereby further_amended to read as follows: "Section 3. The annual license fee for "on sale" licenses shall be One Hundred Dollars ( p100.00), and for "Off sale" licenses shall be Five Dollars ($5.00)." Quit Claim Deed On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Quit Claim Deed covering the following described property from Hildegarde E. Erickson and O. B. Erickson was accepted for Street purposes, and ordered recorded: Motion passed by unanimous vote of the Council. (West 1/2 of Pennsyl- vania Avenue from 14th Street to Wayzata Boulevard) Hearing/Street Improvements Separate hearings were had on proposed assessments for each of the Street Improvements described in the following resolution. No one appeared. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: ASSESSMENT RESOLUTION WHEREAS, pursuant to resolution of the Village Council adopted August 11, 1947, and published August 15, 1947, in the St. Louis Park Dispatch, the Village Council has met at the time and place specified in said resolution and has heard all testimony offered by interested parties in connection with proposed assessments for each of the following street improvements: IMPROVEMENT NO. LOCATION M-27 Vernon Avenue from 28th Street to Minnetonka Boulevard 2 September 15, 1947 Assessment Resolution, Cont'd. IMPROVEMENT NO. Railway M-35 Brooklane from Brookside Avenue to 500 feet South thereof M-66 East and West alley in Block 3, Latham's Minnetonka Boulevard Tract M-67 East and West Alley in Block 4, Latham's Minnetonka Boulevard Tract therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the total cost of each of said improvements is hereby determined to be in the respective amounts hereinafter set forth and the amount of benefits con- ferred by said improvements upon each lot, part of lot,-, piece or parcel of ground so benefited thereby rateably and in proportion to the special benefits conferred upon it is hereby determined to be as respectively set forth in the following list, and there is hereby levied and assessed against each lot, part of lot, piece or parcel of ground described therein an assessment equal to the sums therein respectively set forth as authorized by Chapter 382, Laws of Minnesota 1903, payable in three equal annual installments the first of which shall be payable concurrently with real estate taxes levied in 1947 and collected in 1948 together with a penalty of 10% if not paid in full within thirty days after publication of this resolution and interest at 6% per annum from the date of issuance of orders for financing this improvement.
