Oppose 8 Family Dwellin,a A petition, signed by Dr. A. J. Carroll, 4066 Brunswick Avenue and others, dated June 16, 1947, opposing the A. W. Lampe proposed eight,-family dwelling to be constructed on the SW corner of Brunswick Avenue and Excelsior Boulevard was read. It was the opinion of the Village Council that the Building Inspector be instructed to hold up issuing building permit to A. W. Lampe, and the group present were asked to be present at the meeting to be held June 30, 1947. It was suggested that A. W. Lampe be asked to be present at this meeting also. Extension of Burd Place Mrm. George Anderson, Mrs. N. T. Norby and T. Douthitt of Burd Place 438 June 16, 1947 Extension, Burd Place, Cont'd. appeared regarding the extension of Burd Place, South beyond Lot A, which has-been blocked by the owner of Lot 10, Auditors Subdivision No. 302. The matter was referred to the Village Attorney for checking, and report on pro- cedure to follow: Benefited Area - Storm Sewer #15 The following group from the neighborhood of Quentin Avenue and 40th Street Storm Sewer #15 project appeared and asked for an explanation of "Bene- fited Area''. They were told that there would be a hearing on the assessments in the Fall when the job is done: Charles G. Lindquist, 3918 Natchez Avenue Stanley H. Rudd, 4704 Vallacher Avenue Dale A. Jacobsen, 3945 Ottawa Avenue Phil Erickson, 4701 West 40th Street. • Dangerous Condition, Lot 80, Norwaldo The condition of Lot 80, Norwaldo, owned`by•Julia Steele was discussed with owner of Lots 79 and 81. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Village Council determined'that the premises at Lot 80, Nor*aldo are a nuisance on account of the dangerous condition of fire ruins and the-presence of rats and other unsanitary materials, and the Health Officer of the Village be requested to issue an abatement'order, by unanimous vote of the Council. Bid Awarded - Sanitary Sewer 2A On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Bonander and Company on construction of Sanitary Sewer #2 A was deemed the lowest bid of a responsible bidder received June 2, 1947, and the President and Clerk were authorized to execute contract with them for construction of said Sewer in the name of the Village. Motion was passed by unanimous vote of the Council. Fire Civil Service Examinations On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Fire Civil Service Commission were requested to hold examinations for Common Fire- man, Chief and Assistant Chief at as early a date as is possible, by unanimous vote of the Council. Police Civil Service Examinations On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Police Civil Service Commission were requested to hold examinations for Patrolman at as early date as is possible, by unanimous vote of the Council. Legal Opinion on New Laws On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Village Attorney was instructed to furnish an opinion on new laws as to how much the Village is entitled to from new liquor and cigarette taxes (and others), passed by 1947 Legislature, and what procedure we follow to collect same. Motion was passed by unanimous vote of the Council. Fire Zoning The Council discussed the matter of Fire Zoning for the purpose of es- tablishing and enforcing minimum standards of design, construction, maintain- ance, etc. for various types of construction in St. Louis Park; it being agreed and understood that the Fire Chief and Building Inspector work out a General Code to be reviewed as to legal status by the Village Attorney, -and finally submitted to the Council for adoption or approval. Request to Erect Signs Denied On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the request of Naegele Advertising Company, Inc. for permission to-erect four of their small Ad-ver-tis-er signs, 5 feet x 12 feet, each in the V-shaped construction, on the NE corner of Inglewood and Minnetonka Boulevard was denied by unanimous vote of the Council. Licenses Approved On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following applications for 1947 licenses were approved, and the President and Clerk were authorized to issue licenses to expire December 31, 1947, by unanimous vote of Counbilmen present: June 16, 1947 439 Licenses, Continued: Richard E. Jones, HBA, Nordby Heating & Plumbing Company Plumbing Howard W. Wright Gas Station (3 Pumps) Licenses Transfered On motion of Clerk Justad, seconded by Trustee Perkins, the application of Evelyn H. Lawyer, DBA Lilac Way Dairy Bar for a transfer of 1947 License #259 to sell cigarettes and 1947 License #260 to operate a restaurant, from 6510 Walker Street to 5922 Excelsior Boulevard, was approved by unanimous vote of the Council, without fee. Special Permit (Building) Dr. Wesley V. Buck applied for a special permit to construct and use residence with Physician's and Dentist's Office, to be erected on Lots 1 and 2, Block 3, Hanke's Minikanda Terrace Addition. On motion of Trustee Perkins, seconded by Trustee Bolmgren, a special permit was granted to Dr. Wesley V. Buck to construct a residence with Physician's and Dentist's Offices included in accordance with plans filed with the Build- ing Inspector, on Lots 1 and 2, Block 3, Hanke's Minikanda Terrace, upon the approval of the-Building Inspector, and use of said residence by the Occupant together with an associated Physician or Dentist is hereby permitted and determined to be consistant with the general purpose of the Zoning Ordinance. Motion was passed by four Yeas and one Nay (Clerk Justad voting Nay). Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of the Council: RESOLUTION CANCELING GARBAGE COIJ.ECTION ASSESSMENTS BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the following assessments levied pursuant to resolution adopted September 16, 1946, be hereby canceled, for the reason that said lands were used either for business or were vacant lands and were not served by the garbage collection ser- vice of the Village, and the President and Clerk are hereby authorized to refund the amount paid on receipt of a verified claim signed by the taxpayer. License Bonds - HeatinG On motion of Clerk Justad, seconded by Trustee Bolmgren, the following heating license bonds were approved by unanimous vote of the Council: W. N. Olson, DBA General Heating and Insulating Company, as principal; United States Fideligy and Guaranty Company, as surety, dated May 20, 1947, in the amount of $1,000.00 Roy T. Gustafson, DBA T. D. Gustafson Company as principal; United States Fidelity and Guaranty Company as surety, dated June 5, 1947, in the amount of $1,000.00 Gage-Reeves Company, principal; National Surety Corporation as surety, dated May 26, 1947, in the amount of $1,000.00 License Bond - Plumbing On motion of Clerk Justad, seconded by Trustee Perkins, the plumbing license bond with Roy T. Gustafson, DBA T. D. Gustafson Company as principal, and the United States Fidelity and Guaranty Company, as surety, dated June 5th, 1947, in the amount of.°$4,000.00, was approved by unanimous vote of the Council. 440 June 16, 1947 Resolution On motion of Trustee Bo]mgren, seconded by Trustee Perkins, the follow- ing resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION ORDERING SIDEWALK CONSTRUCTION BE I% RESOLVED by the Village Council of the Village of St. Louis Park that it is necessary and expedient to construct sidewalks at each of the following locations in said Village: On South side of 41st Street from Webster Avenue to Zarthan Avenue. On the East side of Dakota Avenue from 28th Street to 29th Street. On West side of Toledo Avenue from 41st Street to Wooddale Avenue. Petition - Alley Vacation On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Petition of Board of Education of Ind. School District of St. Louis Park, owners of Lots 1 to 14 inclusive, and Lots 23 to 29 inclusive, Block 4, Lenox Addition, dated June 12, 1947, for vacation of alley adjacent to said lots was read and re- ferred to the Planning Commission for checking and recommendation, by unanimous vote of the Council. Petition for Rezoning The petition of Glenn H. Martz and Carlton Cravens, dated June 10, 1947, for the rezoning of Lots 1 through 24 inclusive, Block 305, Rearrangement of St. Louis Park and Lots 25 through 48 inclusive, Block 306, Rearrangement of St. Louis Park, from residential to light industrial, was read. On motion of Trustee Perkins, seconded by Trustee Jorvig, the above petition was referred to the Planning Commission for recommendation by unanimous vote of the Council. Hearing Set for Rezoning On motion of Trustee Perkins, seconded by Trustee Bolmgren, July 21, 1947 was set as date of hearing on petition of Max Renner for rezoning Lots 12, 13, 14, 15, 16, 17, and 18, Oak Manor from Residential to Commercial Use. Motion was passed by unanimous vote of the Council. Hearing Set for Rezoning On motion of Trustee Perkins, seconded by Trustee Bolmgren, July 28, 1947 was set as date of hearing on petition of St. Louis Park Theater Company for rezoning that part of the East 250 feet of the West 5/8 of the Northeast * of the Northwest *, except road, and State Highway, Section 6, Township 28, North pf Range 24 West lying Southerly of the South line of Thirty-first Street pro- jected in a Westerly direction. Motion was passed by unanimous vote of the Council. Hearings Postponed On motion of Trustee Bolmgren, seconded by Trustee Perkins, hearings scheduled for June 23, 1947 were postponed to June 30, 1947, by unanimous vote of the Council. Plans & Specifications, Grading,Approved On motion of Trustee Perkins, seconded by Trustee Jorvig, the plans and June 16, 1947 443 Plans & Specifications, Grading, Cont'd. specifications prepared by the Village Engineer, J. C. Utton for the grading and graveling of the following streets were approved and the Clerk was author- ized to advertise for bids for the work to be done, bids to be opened July 21, 1947. R. W. O'Hara, A. H. Reed, N. H. Epstein and Mrs. I. J. Oborn appeared in opposition to construction of curb and gutter on the East side of Dakota Avenue from 29th Street to Minnetonka Boulevard. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of the Council: RESOLUTION FOR CURB AND GUTTER CONSTRUCTION WHEREAS, the Village Council has met at the time and place specified in notice to all property owners whose property is liable to be assessed for the following curb and gutter improvements published in the St. Louis Park Dispatch, May 30th and June 6th, 1947, and has heard all persons appearing at said time, separate hearings having been conducted as to each improvement, and petitions for each of said improvements being determined sufficient, therefore, HE IT RESOLVED by the Village Council of the Village of St. Louis Park that it is necessary and expedient to construct curb and gutter at the follow- ing locations in said Village, with one foot gutter, in accordance with plans and specifications therefore prepared by the Village Engineer: West side of Xenwood Avenue between 33rd Street and the North line of Lot 122, Norwaldo. West side of Dakota Avenue from 28th Street to 29th Street. East side of Dakota Avenue from 28th Street to 29th Street. West side of Toledo Avenue from 41st Street to Wooddale Avenue. • West side of Idaho Avenue from 31st Street to 32nd Street East and West sides of Raleigh Avenue from 27th Street to 28th Street West side of Xenwood Avenue from 33rd Street to end of existing curb South of Lake Street. BE IT FURTHER RESOLVED that the Clerk advertise for bids for construction L of said curb and gutter improvements, to be opened by the Village Council, July 7, 1947.
