Hill for a com- mercial building to be erected on the West 58 feet of Lots 24 through 30, Block 5, Rearrangement of St. Louis Park with setback in line with house on Hamilton Street, by unanimous vote of the Council, Building Permit-Commercial Building On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Building Inspector was authorized to issue a building permit to Ed. Hlavcek for a commercial building to be erected on the SW corner of Kipling Avenue and Excelsior Blvd. with setback on Excelsior Boulevard to conform with present buildings at 4407 and 4409 Excelsior Boulevard, using lot line on Kipling Avenue as building line. Motion was passed by unanimous vote of the Council. Bid for Dirt Fill Awarded The Village Engineer's tabulation of bids for dirt fill for Lot 81, Auditor's Subdivision 301 received April 14, 1947, with his recommendation of the Terry Excavating Company bid at 30¢ per cubic yard was read to the Village Council. On motion of Trustee Jorvig, seconded by Trustee Perkins, the bid of Terry Excavating for not more than 10,000 cubic feet of dirt fill for Lot 81, Auditor's Subdivision 301 at 300 per cubic yard was determined to be the lowest bid of a responsible bidder, and the President and Clerk were authorized to enter into a A contract for the Village with Terry Excavating Company for the fill was passed by unanimous vote of the Council. License Bond (Heating) On motion of Clerk Justad, seconded by Trustee Bolmgren, the heating license , bond with Frank H. Hutchinson and William R. Carlson, DBA Hutchinson & Carlson as principal, and United States Fidelity and Guaranty Company as surety, dated March 31, 1947, in the amount of $1,000.00, was approved by unanimous vote of the Council. Letter Re: Rates for Legal Publications The following letter from the St. Louis Park Dispatch, signed by J. L. Markham, dated April 19, 1947, was read: "This letter will confirm our telephone conversation of yesterday re- garding the new law pertaining to rates for legal publications. The present legislature passed a bill, which was signed by the Governor and which became effective as of April 15, 1947, setting the legal rate for first publications at $1.20 per folio; for subsequent publications at 60 cents per folio; and for tabular matter at 40 cents per folio additional. The measure encountered no opposition anywhere, in either house or by the governor, since the tremendously increased cost of news- paper production in the war years justified it completely. I have for- gotten the exact year, but the legal rate of 90 cents for first and 45 cents for subsequent, with 25 cents additional for tabular matter, had not been revised upward for many, many years. My recollection is that the 90 cent rate was established in the nineteen twenties. Thanking you sincerely for the splendid treatment you have given The DISPATCH, and assuring you that our determination is to reciprocate with every cooperation within our means, we remain," Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of Councilmen present: RESOLUTION CANCELING CERTAIN TAR ASSESSMENTS BE IT RESOLVED that the tar assessment on the following described property; Section 31, Township 29, Range 24 - Commencing at a point 1020.1 feet East from a point 435.6 feet North from the center section; thence East 44.7 feet; thence South 187.5 feet; thence West 44.7 feet; thence North 187.5 feet to beginning - Job No. 113-A, passed by the Village Council. October 13, 1941 be canceled for the reason that no tar was applied in front of said lot, and the President and Clerk are hereby authorized to refund amount paid on receipt of a certified claim signed by owner. 1942 $14.50 1943 15.00 1944 14.21 $43.71 April 21, 1947 Resolution On motion of Clerk Justad, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of the Council: RESOLUTION CANCELING GARBAGE COLLECTION ASSESSMENT BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the following assessment levied pursuant to resolution adopted September 16, 1946, be hereby canceled, for the reason that said lands were used as a farm and were not served by the garbage collection service of the Village of St. Louis Park, and the President and Clerk are hereby authorized to refund the amount paid on receipt of a certified claim signed by the owner. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the President and Clerk were authorized to sign work request for connecting transformers temporarily for 440 volts to allow pump test with one hundred horsepower motor; transformer to be reconnected to 230 volts; and to sign the letter dated March 21, 1947 to modify the contract so as to include such new location at Texas Avenue and 34th Street, for supply. Motion was passed by unanimous vote of the Council. Letter to Gas Company On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was authorized to write to Minneapolis Gas Light Company for information concerning the number of miles of gas mains in Village, number of users; rate comparison with Minneapolis and whether or not they will be able to furnish additional service for heating and cooking next fall and winter (1947). Motion was passed by unanimous vote of the Council. Voters Registration On motion of Trustee Bolmgren, seconded by Clerk Justad, the Village Attorney was instructed to prepare an ordinance covering registration of voters, by unanimous vote of the Council.
