Request for Rezoning A letter dated March 27, 1947, received from Edward Chalgren, Attorney for Ralph Olson, owner of Lot 10, Block 8, High Holborn was read, relative to rezon- ing said lot to Commercial to harmonize with its environment. On motion of Trustee Perkins, seconded by Trustee Bolmgren, Mr. Chalgren's letter was referred to the Planning Commission for checking and recommendation by:unanimous vote of the Council. Permit for Commercial Building Mr. Roy G. Carlson, Lyndale Nursery, applied for a building permit for a commercial building which he proposes to erect on the SE corner of Excelsior Boulevard and Webster Avenue. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Building Inspector was authorized.to issue building permit to Roy G. Carlson for erection of commercial building on Lots 44, 45, Block 1, Suburban Homes Company's Addi- tion, by unanimous vote of the Council. 111 Used Car Ordinance On motion of Trustee Perkins, seconded by Trustee- Bolmgren, the Used Car Ordinance was referred to Committee of Whole, by unanimous vote of the Council. G. Utton, Village Engineer. Hennepin County Fair- A letter dated- March 27, 1947 from M. W. Zipoy, Secretary of Hennepin County Agricultural Society was read, inviting the Village to participate in the Hennepin County Fair by making a donation. On motion of Trustee Bolmgren, seconded by Trustee Perkins, a donation of $100.00 as set up in,the 1947 budget was approved for the Hennepin County Fair, and the President and Clerk were authorized to issue a warrant to cover same upon receipt of Verified Claim from the Hennepin County Agricultural Society. Motion was passed by-unanimous vote of the Council. • Bid for Road Tar Awarded The following tabulation of bids received March 24, 1947 for 100,000 gallons more or less of Road Tar Applied was presented by Village Engineer J. C. Utton and read to the Village Council: Bury and Carlson, Inc. $.1394 per gallon - Republic Creosoting Company .1375 " with recommendation from the Village Engineer that the bid of Republic Creosot- ing Company be accepted.' On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of the Republic Creosoting Company received March 24, 1947, for 100,000 gallons more or less of road tar applied © $.1-375 per gallon was determined to be the lowest bid of a responsible bidder, and the President and Clerk were authorized to execute a contract in the name of the Village with the Republic Creosoting Company for the road'_tar needs)forc;1947, by unanimous vote of the Council. Fire Insurance The Fire Insurance Committee reported that $30,400.00 of fire insurance covering buildings and contents is now due as of April 1, 1947 and we have re- ceived from the Associated Agencies covering this amount the following policies: 4-1-47 Northern Insurance Company Policy No. S.O.-D.S.0 214858 $15,200.00 - premium 5 years --- $218.88 4-1-47 Merchants Fire Insurance Company Policy No. S.0.-D.S.0 32969 $15,200.00 - premium 5 years --- $218.88 The Insurance Committee recommends the acceptance of the above mentioned policies. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the recommenda- tion of the Insurance Committee was accepted and the policies listed above were approved, and the Clerk was authorized to sign the 80% Co-Insurance clause for the Village, by unanimous vote of the Council. Petition for Curb & Gutter On motion of Trustee Perkins, seconded by Trustee Bolmgren, petition signed by Edmund G. Mayhall and others, for construction of curb and gutter on the West side of Xenwood Avenue between 33rd Street and the end of present curb and gutter at Lake Street, was referred to the Village Attorney and Village Engineer by un- animous vote of the Council. Petition for Sanitary Sewer On motion of Trustee Jorvig, seconded by Trustee Perkins, petition for lateral sanitary sewer in 35th Street, between Dakota Avenue and Wooddale Avenue, signed by H. E. Whalen and others was referred to the Village Attorney and'Vil- lage Engineer to determine sewer district, by unanimous vote of the Council. Permission for Poles & Anchors, Etc. March 31, 1947 37 5 Permission for Poles, Etc., Conttd. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the request of the Northwestern Bell Telephone Company to place poles and anchors, and under- ground conduit at the following locations was approved by unanimous vote of the Council: Two poles and one anchor on the East side of the alley South of West 27th Street between Florida Avenue and Edgewood Avenue. Two poles in the alley Southeast of West 33rd Street, said alley running parallel to Louisiana Avenue. 111 Place underground cable in West Lake Street' around the corner to Wooddale Avenue. Place two anchors on West Lake Street; one on the • Northeast corner of Wooddale Avenue and Wrest Lake Street, the other on West Lake Street Southwest of Wooddale Avenue. Place five poles and one anchor on the East side of the alley North of 31st Street between Oregon Avenue and Nevada Avenue. Hearing (Two-family Dwellings) A hearing was had on the petition of Fred Cook for special permit to cons- truct 7 two-family dwellings on Lots 1 to 19, inclusive, Block 193, Rearrange- ment of St. Louis Park. Fred J. Cook appeared in favor of his petition. No one appeared in opposi- tion. On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Building Inspector was authorized to issue special permits to Fred J. Cook for 7 two- family dwellings on Lots 1 to 19, inclusive, Block 193, Rearrangement of St. Louis Park, by unanimous vote of the Council, Morningside Road Survey - On motion of Trustee Jorvig, seconded by Trustee Perkins, the Morningside Road survey from Brookside Avenue to Vernon Avenue was referred to the Village Attorney for recommendation, by unanimous vote of the Council. License Bond (Plumbing) On motion of TVustee Perkins, seconded by Trustee Bolmgren, the plumbing license bond with A. R. Levy, DBA 'Humboldt Plumbing & Heating Company as princi- pal, and Commercial Casualty Insurance Company as surety, dated March 31, 1947, in the amount of $4,000.00, was approved by unanimous vote of the Council. Performance Bond - Phelps-Drake Co. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the performance bond with Phelps-Drake Company as principal, and the United States Guarantee Co. of New York as surety, in the amount of $4,055.00, dated December 16, 1946, cov- ering Sanitary Sewer and appurtenances in Sewer District 1-N, was approved and accepted by unanimous vote of the Council. Hearing --- Rezoning ' A hearing was had on the petition of Shursen Realty Company for rezoning of Lots 22 to 35, inclusive, Block 43, Rearrangement of St. Louis Park to Light Industrial. Mr. Shursen appeared and stated that all requirements made by the Planning Commission in their report dated March 5, 1947 has either been taken care of, or would be. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above matter was referred to the Village Attorney to prepare advertisement, by unani- mous vote of the Council. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of the Council: RESOLUTION ORDERING SIDEWALK WHEREAS, the Village Council has been petitioned by a majority of owners of property fronting on the East side of Joppa Avenue adjacent to Lots 19 to 26, inclusive, Block 3, Thorpe Brothers Cedar Lake Heights, for construction of side- 37(3 March 31, 1947 Resolution, Continued: walk at said location; therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said petition is hereby determined to be a sufficient petition signed by a majority of owners of said property, and {i BE IT FURTHER RESOLVED that it is necessary and expedient to construct sidewalk on the East side of Joppa Avenue adjacent to Lots 19 to 26, in said Block 3, such sidewalk to be five feet in width and constructed in accordance with standard Village sidewalk specifications now on file with the Village Clerk, and the Village Engineer is authorized to set stakes designating the exact lo- cation for said sidewalk. BE IT FURTHER RESOLVED that said sidewalk shall be completed my May 30, 1947. BE IT FURTHER RESOLVED that the names of the owners of all lots, parts of lots, and parcels of ground fronting the street where said walk is to be cons- tructed are as follows: NAME PROPERTY OWNED Earl L. Advertise for Bids for Fill On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Clerk was authorized to advertise for bids for not to exceed 10,000 cubic yards of fill for Lot 81, Auditor's Subdivision #301, by unanimous vote of the Council. Letter Re: Complaint On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was instructed to write a letter to Max Renner registering a complaint against his using residential property for commercial use. Motion was passed by unanimous vote of the Council. Hearing A hearing was had on each of the proposed water main extensions described in the following resolution. A letter from Allen M. Sturgeon asking for the water main extension in Colorado Avenue from Minnetonka Boulevard to 27th Street "was read. N. Epstein and Axel Reed appeared in opposition to the Colorado Ave- nue extension, saying however, that they would waive their objections if and when permits for some homes were taken out in the 2900 Block. Helen Wood and Pansy Sykes appeared in opposition to the Oxford Street from Colorado Avenue to Dakota Avenue extension. Mr. Tweet and a representative of the Turner house- hold appeared in favor. No one appeared in regard to the other extensions. Now, therefore,, BE IT RESOLVED by the Village Council ,of the Village of St. Louis Park that it is hereby determined to be necessary to construct Village water main extensions in the public streets of the Village at the locations above described; and, BE IF FURTHER RESOLVED that plans and,specifications for construction of said water mains which have been prepared by the Village Engineer and filed with the Village Clerk are hereby accepted and approved as the plans and specifications for said improvements; and the Clerk is hereby directed to advertise for bids for the construction of said water mains to be opened and considered by the Village Coun- cil April 28, 1947. BE IT FURTHER RESOLVED that the cost of said improvements is to be assessed against property benefited as authorized by.Chapter 425, Laws of Minnesota, 1921, as amended, and said improvements are to be consolidated as Improvement No. M-66.
