On motion of` Trustee Bolm�ren, seconded by Trustee Perkins, January "' , 191+$ was set as the date of joint meeting of the Council and�Planning Commission, at 5:30 P. ii. at the Village Hall, by unanimous vote of Councilmen present. Pa�ks and Playgrounds ' A letter dat�d December g, 191�7 from the Village Planning Commission regarding parks and playgrounds was read and discussed. �'he part relating to th� acquisitian of certain lots recommended by the Planning Commission in 1943, wa� given to Trustee Jorvig to take up with the Park Board. Another portion of the letter relating to b�innehaha Creek Improvement was discussed. OFcDIN�TCE N0. 2$6 AN GRDINt1NCE i`�GULATING THE USE AND DISCHARGE OF FIREf�RI+�1S AND �IR RI�S ?'dITHIN THE VILL�IGE OF ST . LOUIS PARK The Village Council of the Village of St. Louis Park do ordain as follows: Section l. �:o person shall shoot or discharge any firearm or air rifle within the corporate l�mits of the Village of ;t. Louis Park except as follows; (a) Yersons duly autriorized to act as law enforcement officers, or members of military forces of the United States or the State of P�ri.nnesota in the discharge of their duties; (b) �ersons engaged in target shooting, with inanirnate objects as targets, within a building or structure safely enclosed where the sound of the shooting or discharge will not be a nuisance to persons occupying adjacent property; (c) Persons engaged in target or trap shooting on target or trap shooting ranges licensed as such by the�Village Council as herein- after provided; � (d) Persons acting in self-defense when the use of firearms for that purpose would not be unlawful under the laws of the State of ?<finne sota; � � "(e) For the destruction of diseased, irijured or dangerous birds, " animals or reptiles by persons specifically authorized to do so by ' the Chief of Police, the �resi�ent of the Villa�e Council, or the Village Council. ` Section 2. The Village Council ma.y license the use of firearms and air rifTes for target shooting and trap shooting at any suitable place within the Vill`age upon application of the owner or occupant of the premises to be licensed and payment of a license fee of �2.00 per year. All such licenses shal�l expire on December 31 of the year in which granted. No such license sha11 be granted until the Chief of Police anci the Village Council shall be satisfied that tar�et shooting or trap shooting at the place to be licensed vrill not be a hazard to persons or ani•nals on the licensed property or adjacent premises, and no such license shall be granted with respect to a place Nrithin a safe distance of a public street nor any place where the sound of the shoot- ing will be a nuisance to the residents of land in the vicinity. IvTo firearm � llecember 15, 1947 Ordinance No. 2�6, Continued or air rifle shooting a single projectile shall be discharged at any time at an elevation in excess of ten (lOj d�grees from the horizontal or at any aerial target. In grantinG such a license the Village Council rr�.y prescribe the hours during which shooting will be permitted and the caliber of rifles or other firearms which may be used. Any such license may be terminated by the Village Council at any time after reasonable notice to the licensee and hearing, if the Village Council shall find that any provision of the license has been violated or that use of the target or trap shooting range has become hazardous to any persons or animals or a nuisance. ��� 58ction 3. The President of the Village Council and the Chief of Folice ! may grant a perrni.t to any person on application for the use of appropriate ' firearms or air rifles for destruction of a diseased, dangerous or injured ' animal, but no such �rmit shall be valid for longer than twenty-four (21�) hours after given. Section !�. Nothing in this ordinance shall authorize the use of any firearm or air rifle in a manner which vrill endanger any human being or property, and no permit or license granted hereunder shall in any way relieve the person acting thereunder from civil liability for any damage resulting from such use of any firearm or air rifle. Section 5. Any person who shall violate any provision of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than One Hundred Dollars (:�1U0.00) or imprisonment not exceeding ninety (90) days. Section 6. This ordinance shall take effect and be in force from and after its publication. Dog Problems Mss. Goldie Carlson, 5500 �':innetonka Boulevard was present and appealed to the Village Council to do something about the dog situation in St. I,�uis Park. She said that her eight year old daughter Patty had been attacked by a dog in front of 5600 P�innetonka �oulevard while she was on her way to school. �Tr. Harry E. ��ttwood, 2921� �enwood Avenue who saw the attack was also present and requested action by the Council on three counts - l. That the provisions of the Grdinance concerning dogs be enforced, 2. Tha.t maintenance of records on licensed dogs be improved. 3. That a dog catcher be employed to control the situation. The rrincipals of the grade schools and i�::iss ��,'thel Baston spoke about the large number of dogs which are allowed to roam the school grounds and often molest the school children. President Erickson explained at length the attempts made to get a dog catcher and other means that have been employed to control the dog situation. Trustee Bolmgren went on record as being in favor of employing a dog catcher even if it ��ere necessary to pa.y hi.m =;y5.00 for every dog he picked up; also that it may be necessary to increase the license fee. Gn motion of 'I'rustee Jorvig, seconded by Trustee Perkins, the r�atter of dog care was reierred to the Corr�nittee of the u,'hole for definite action, by un- animous vote of the Council. ._.. ' Petition Against Commercializino Yroperty (�djacent to Vernon & l�2nd) A petition from Lawrence Ohl, 1F1 0 Utica �venue and others against the co;7unercializing property adjacent to Vernon Avenue and l�2nd Street was read and ordered filed. Construction of Steps Ordered On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Village �ngineer was instructed to construct steps in front of Felber�s home on t�xford Street up from street to sidewalk, by unanimous vote of the Council. Request for On-�ale Liquor License On motion of Trustee Perkins, seconded by Trustee BoLngren, the letter from I�Ticholas B.
