No. 1-Q • that lateral sanitary sewer be constructed in Alabama Avenue from Minnetonka Boulevard to 490 feet South thereof, and BE IT FURTHER RESOLVED that plans and specifications for said sewer pre- pared by the Village Engineer be hereby approved and the Engineer's estimated cost for construction of said sewer be filed with the Clerk, and BE IT FURTHER RESOLVED that the Clerk be directed to advertise for bids for construction of said sewer. Mr. Wilkinson of Crestview Addition spoke in opposition to same. He requested that an ordinance be passed to prohibit shooting of fire arms (He suggested that this ordinance prohibit shooting within two miles of St. Louis Park to protect the people of Golden Valley and other adjacent Villages) . President Erickson explained that we have no jurisdiction outside of the Village limits. Mr. Eaton, developer of Crestview spoke in opposition. Mr. Evans of the Minneapolis Golf Club spoke in favor of the trap shoot- ing. He feels they should be allowed to carry on and would like to provide for hours for shooting that would not interfere with the peace and safety of the neighborhood. Mr. Wilkinson stated that there were lots in Crestview Addition about 150 feet from the shooting location, and feels that the owners would not want to build there because of the shooting. Mr. Sundt of Crest- view Addition Sales said there was lack of interest in lots due to the trap shooting. Mr. Evans was asked how many members of the Minneapolis Golf Club had purchased lots. The answer was four, and they were all interested in using the trap for shooting. Mr. Wilkinson says this is not all against the Minneapolis Golf Club, but the Village is too big to permit trap shooting. Trustee Jorvig talked about shooting trouble in the Village, saying it has become a nuisance all through the Village, and suggested that the matter be referred to the Committee of the Whole with a view of bringing in an ordi- nance that will control shooting of all kinds in the Village. - On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above matter was referred to the Committee of the Whole, by unanimous vote of Coun- cilmen present. . Mr. Wilkinson suggested that an order be placed to stop the shooting uptil an ordinance can be perfected -- Mr. Eaton answered by asking that the Village Council have an opportunity to frame an ordinance. Hearing/Double Bungalows A hearing was had on the request of Albert Monson for a special permit to erect double bungalows on Lots 1, 2, 3, 4, 5, -Block 2, Minikanda Vista 2nd addition. Mr. Goranson appeared-and asked about storm sewer, but said he was not -opposed to the special permit. On motion -of Trustee Bolmgren, seconded by Trustee Jorvig, the request of Albert Monson was granted, and the .Building Inspector was authorized to issue building permits to Albert Monson to erect double bungalows or two-family dwellings on Lots 1, 2, 3, 4, 5, Block 2, Mini- kanda Vista 2nd Addition, by unanimous vote of Councilmen present. Bus -Transportation - - A roomful of citizens were present to discuss bus transportation---also present was Mr. Carr and Mr. Bjorke of the Minneapolis Street Railway Company. The -discussion was started by Trustee Bolmgren by reading a letter dated March 11, 1947, that he as Chairman of the Bus Committee wrote to the Minnea- polis Street Railway Company regarding the bus transportation service in the Village. • Mr. Carr gave a report of a survey they -had made. He suggested that the first move would be bus service out Minnetonka Boulevard to Georgia Avenue. This bus would go through Kenwood as planned now. It was suggested that this bus -run direct to Hennepin and Lake by Mr. Epstein, to save the transferring at 41 October 6, 1947 Bus Transportation, Cont'd. France Avenue and at Lake Street. Mr. Ferrier suggested that this bus be extended to Louisiana Avenue. Mr. Carr answered that the Railroad and Warehouse Commission have control of terminals. Trustee Jorvig said that the people in the neighborhood of Highway No. 18 and Minnetonka Boulevard would like the bus line extended to Highway No. 18. Mr. Carr suggested that the Village Council take this request and Mr. Ferrier's request up with the Railroad and Warehouse Commission, as their limit at the present time is Georgia Avenue. Mr. Carr stated that they did not have permission to run on Minnetonka Boulevard to Georgia Avenue but that the Deephaven Bus Company has made the statement that they would not oppose the extension to Georgia Avenue by the Minneapolis Street Railway Company. Trustee Jorvig said he understood that it was the Minneapolis Street Railway Company that controlled. Mr. Carr said that during the -War the Deephaven Bus Company was allowed to operate as far East as Blackstone Avenue. Robert Hankins suggested that we accept the offer to Georgia Avenue now, and then go to bat and work for service out Minnetonka Boulevard to Highway No. 18. Mr. Krupp, 3446 Brunswick Avenue said the service is too slow - doesn't like going through Kenwood and suggested that St. Louis Park be given an Express Bus, stopping only in St. Louis Park. Mr. Lundberg suggested that the Express Buses be run during rush hours (morning and evening), with no stops from 12th Street and Hennepin Avenue to Lake Street and France Avenue, coming out. Dr. McNeil, Texas Avenue and Highway #7 spoke of Express Service on Highway #7 - one bus to Minneapolis in the morning and one in the evening to Tonka Bay. A representative from the neighborhood of Cedar Lake Road stated that there was no bus service on Cedar Lake Road. Mr. Wilson from Northside said there is plenty of business along Cedar Lake Road, and any service would be appreciated. Mr. Zimmerman, Natchez Avenue and Cedar Lake Road said that service would not be appreciated, but a service built for them would. Trustee Jorvig suggested that the entire Village bus service should be voiced here this evening while everyone is present. He asked for Oak Hill bus service. Mr. Fifield, 3617 Quebec Avenue asked Mr. Carr why the present Lake Street service could not be extended to Texas Avenue and Highway No. 7. Mr. Carr said that bus service can be extended whenever fares pay out. Trustee Jorvig spoke about petitions for bus service to Oak Hill received during the War, and said service out Walker would bring in revenue. Trustee Bolmgren asked Mr. Carr if he was getting any new buses. Answer was yes, but that some of their present buses will have to be shelved. Mr. Fifield suggested staggering the service during the day and give regular service during morning and evening rush hours. Mr. Fifield asked Mr. Carr what we would have to do to get this service --- that he had signed two petitions, but no action has been taken. Mr. Carr answered that a survey is now being made in Oak Hill and would be ready for a report soon. President Erickson agreed to inform Mr. Fifield when this report is received. Mr. Ecklund suggested that a trial run to Oak Hill be made to prove that it will pay. Mr. Hall said that there are 55 houses being built between Lake Street and Highway #7; and Texas Avenue and Pennsylvania Avenue. Trustee Bolm- gren suggested that we accept this proposed trial run to Oak Hill and then urge trial runs to Highway No. 18. Trustee Bolmgren asked Mr. Carr when the service on Minnetonka Boulevard to Georgia Avenue could begin. Mr. Carr stated that this must go through the Railroad and Warehouse Commission, and a resolution from the Village Council approving this extension would be a great help to the Minneapolis Street Railway Company. Mr. Carr was asked if they would be willing to put on a trial run to Oak Hill now. Mr. Carr answered that he would like to finish the present survey being made before a trial run is made. Trustee Bolmgren suggested that the Oak Hill group get together and form a committee of three who can be reported to. The following names were given: Leonard C. Swedlund, 7911 Division Street, Harry J. Olson, 3620 Rhode Island Avenue, and Robert G. Fifield, 3617 Quebec Avenue. Mr. T. Gardner said Brookside is getting good service and suggested that other parts of the Park be given better service. President Erickson thanked the groups for coming to the meeting. Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of Councilmen present: 4 October 6, 1947 0.01-4 Resolution/Cont'd. RESOLUTION BUS TRANSPORTATION_ WHEREAS, numerous requests have been made by residents of the Village of St. Louis Park residing in the area adjacent to, Minnetonka Boulevard between West Lake Street and Georgia Avenue that bus service now furnished in this Vil- lage on West Lake Street by the Minneapolis Street Railway Company be extended on Minnetonka Boulevard from West Lake Street to Georgia Avenue, and WHEREAS the Minneapolis Street Railway Company is willing to make such desired extension in its bus service, which bus transportation service will provide passengers in that area with a convenient means of transportation within the Village of St. Louis Park and between St. Louis Park and Minneapolis; the fare for a ride wholly within the limits of the Village of St. Louis Park being the authorized bus fare, and the fare for a ride between any point within the Village of St. Louis Park and any point within the City of Minneapolis being a combination of the authorized bus fares in St. Louis Park and Minneapolis, now therefore, HE IT RESOLVED by the Village Council of the Village•of St. Louis Park that it approves the application of the Minneapolis Street Railway Company for a Certificate of Convenience and Necessity to extend the Bus Line Extension at said location, and hereby requests the Railroad and Warehouse Commission of the State of Minnesota to approve said application and issue its order granting a Certificate permitting the operation of said bus line extension in accordance with the terms and conditions recited in this resolution, and as set forth in said application. - Ordinance/Gas Company A discussion was had regarding the new Gas Company ordinance with the Minneapolis Gas Light Company's Attorney, Mr. Farnham, and he was told that the Village Council was not ready to act on same this evening. He was asked is he wanted the present ordinance extended 60 days, and he stated that he didn't know if it would mean anything. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following ordinance was passed by unanimous vote of. Council- men, present: ORDINANCE NO. 282 AN ORDINANCE EXTENDING THE PROVISIONS OF ORDINANCE NO. L GRANTING • A FRANCHISE TO THE MINNEAPOLIS GAS LIGHT COMPANY ------ The --�The Village Council of the Village of St. Louis Park do ordain as follows: Section 1. The provisions of Ordinance No. L entitled "An Ordinance Granting to the City of Minneapolis Gas Light Company, Its Successors and Assigns, the Right to Manufacture, Sell and/or Distribute Gas for Heating, Illum- inating, and Other Purposes in the Village of St. Louis Park, and to Use the Streets, Avenues and Alleys thereof for that Purpose", adopted by the Village Council, August 6, 1927, are hereby extended and made effective for a period to, and including November 3, 1947; provided, that the Minneapolis Gas Light Company accept the provisions of this Ordinance by letter filed with the Village Clerk within ten days from the date of adoption of this 'Ordinance. Hearings/Sewer Assessments Separate hearings were had upon each of the proposed assessments for sewers described in the following resolution. No one appeared. • Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by u4animous, vote of Councilmen present: RESOLUTION LEVYING ASSESSMENTS FOR SANITARY SEWERS WHEREAS, pursuant to notice published in the St. Louis Park Dispatch, September 19, 1947, the Village Council has met and passed upon all objections to the proposed assessments for construction of sanitary sewers for Sanitary Sewer Districts Nos. 2-A, 1-L, 1-M and 1-N, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that each of said proposed assessments is hereby affirmed and adopted and shall 43 ' October 6, 1947 Resolution/Sewer Assessments, Cont'd. constitute a special assessment against the lands named therein, and each lot, piece or parcel of land included in said assessments is hereby found to be benefited by the respective improvement in the amount of the assessment levied against it, and HE IT FURTHER RESOLVED that such assessments shall be payable in equal annual installments over a period of ten years, the first of said installments to be payable on the first day of January, 1948, and succeeding installments on the first day of January in each year thereafter until the full amount of said assessments are paid. Said special assessments and each installment thereof shall bear interest at the rate of 5% per annum from the date of this resolution. Said special assessments with the accruing interest thereon shall be a para- mount lien upon the property included therein from the date of the adoption of this resolution and shall remain such lien until fully paid as authorized by Chapter 312, Laws of Minnesota 1903 as amended, and BE IT FURTHER RESOLVED that all moneys collected on any such special assessments shall constitute a fund for the payment of the cost of the improve- ment for the respective districts for which such assessments were made and the same shall be credited to the proper sewer district fund. Hearing/Sewer Assessments-Dist. #2 A hearing was had upon proposed assessment forte construction of joint district sewer for r Joint Sanitary Sewer District No. 2. No one appeared. Resolution On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION LEVYING ASSESSMENTS FOR JOINT SANITARY SEWER DISTRICT NO. 2 WHEREAS, pursuant to notice published in the St. Louis Park Dispatch September 26, 1947, the Village Council has met and passed upon all objections to the proposed assessments for construction of joint district sanitary sewer for Joint Sanitary Sewer District No. 2, therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said proposed assessment is hereby affirmed and sdopted and shall consti- tute a special assessment against the lands named therein, and each lot, piece or parcel of land included in said assessment is hereby found to be benefited by said improvement in the amount of the assessment levied against it, and BE IT FURTHER RESOLVED that -such assessments shall be payable in equal annual installments over a period of ten years, the first of said installments to be payable on 'the first day of January, 1948, and succeeding installments on the first day of -January in each year thereafter until the full amount of said assessments is paid. Said special assessments and each installment thereof shall bear interest at the rate-of 3% per annum from the date of this resolution. Said special assessments with the accruing interest shall be a paramount lien upon the property included therein from the date of the adoption of this reso- lution and shall remain such lien until fully paid as authorized by Chapter 312, Laws of Minnesota 1903,_ as amended, and BE IT FURTHER RESOLVED that all moneys collected on such special assess- ments shall constitute a fund for the payment of the cost of said improvement for the said Joint Sewer District and the same shall be credited to the fund for Joint Sewer District No. 2. Hearings/Storm Sewer Assessments (15 & 16) Separate hearings were had upon each of the proposed assessments for sewers described in the following resolution. No one appeared. LOUIS PARK SEWER WARRANT 1947 - • SEWER PROJECTS SERIES Noy $1,000.00 The Village Treasurer of the Village of St. Louis Park, Hennepin County, Minnesota, is ordered and directed to pay the bearer out of the 1947 Sewer Projects Fund the sum of $1,000.00 on the 15th day of November, 1949,• and to pay interest thereon at the rate of % per annum before and after maturity, payable semi-annually on the 15th day of November and the 15th day of May in each year, interest to maturity being represented by separate interest coupons hereto attached. Both principal and interest are payable at Northwestern National Bank of Minneapolis in any coin or currency which at the time of payment is legal tender for public and private debts. This is one of an issue of said sewer warrants of like date and tenor except as to maturity issued by the Village of St. Louis Park under provisions of Chapter 312, Laws of Minnesota, 1903 and amendments thereto, in anticipation of the collection of special assessments heretofore or hereafter to be duly levied on the property benefited by the construction of sanitary sewers in sani- tary Sewer Districts Nos. 2-A, 2-B, 1-N, 1-0, 1-L, 1-M, and Storm Sewer in Storm Sewer District No. 15 in said Village, and the full faith and credit and taxing powers of the Village have been and are hereby irrevocably pledged to the payment of the principal andinterest hereof. • It is hereby certified:and recited that all acts, proceedings and things required by the Constitution and Laws of the State of Minnesota to be done and performed precedent to and in the issuance of this warrant have been done and - performed at the time and in the' manner as required by law and that the issuance of this warrant will pot cause the indebtedness of the Village to exceed any constitutional dr statutory limitation of indebtedness. Resolution On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following resolution was adopted ,by unanimous vote of all members of the Council present: RESOLUTION LEVYING ASSESSMENTS FOR GARBAGE AND REFUSE COLLECTION WHEREAS, the Village Council on September 29, 1947, duly determined by Ordinance that the respective owners of each lot or parcel of land served by the regular garbage and refuse collection service provided by the Village by con- tract are obligated to pay to the Village the sum of $7.92 each for the period from September 1, 1946 to August 31, 1947, said sum to be due and payable October 1, 1947 and in default of payment the same is to be assessed against said property, and WHEREAS, no payment has been made of any of said sums, and WHEREAS, the Village Clerk has prepared a proposed assessment roll provid- ing for assessment against each lot or parcel of land so served for which said service charge is unpaid, therefore, HE IT RESOLVED by the Village Council of the Village of St. Louis Park that there is hereby levied and assessed against each lot or parcel of land set forth and described in said assessment roll an assessment in the sum of $7.92 rep- resenting the proportionate cost of such service to the respective properties, said assessments to be due and payable concurrently with texes levied in the year 1947 and payable in the year 1948 as authorized by Chapter 223, Laws of Minnesota 1943. Hearing Date Set/Vacation of Portion of Xenwood On motion of Trustee Jorvig, seconded by Trustee Bolmgren, October 27th, 1947 was date set for hearing on petition of Chicago, Milwaukee, St. Paul and Pacific Railroad Company for the vacation of portion of Xenwood Avenue lying South of the original sixty foot right-of-way of said Railroad and North of a line parallel with and eighty feet South of the Southerly line of said right of way, dated October 2, 1947. Motion was passed by unanimous vote of Councilmen present. Fire Civil Service Report Appointment of Firemen - A report from the Fire Civil Service Commission, dated October ,2, 1947 showing the results of the examinations conducted September 17, 1947 was read as follows: «The Council of the Village of St. Louis Park having requested the Civil Service Commission for the Fire Department of the _ Village of St. Louis Park to examine and certify candidates for the position of (1) fire chief, (2) assistant fire chief, (3) four common firemen. It is my privilege to report and certify as follows: Examina- tions, both written and oral have been held, and the said Civil Service Commission for the Fire Department of the Village of St. Louis Park hereby certifies: 1. The winter session of the Legislature voided those examinations in order that all returning veterans might have an opportunity to take civil service examinations in fire departments. Consequently the examinations had to be held over again. It is a great compliment to all con- cerned and should be most reassuring to all of the residents of the Village that the boys themselves recognized the abilities-. and leadership of these two men and not a single qualified person, and there were many, filed against them for these positions.
