SPECIAL MATING --- JANUARY 13, 1947
,, A meeting of the Village Council was called to order by President Erickson
at 8:15 P. M. with the following Councilmen present at roll call:

Advertise for Bids on Pump
On motion of Trustee Bolmgren, seconded by Trustee Perkins, all bids on
pumping equipment received and opened January 6, 1947 were rejected and the
Clerk was instructed to advertise for new bids to be opened February 3, 1947,
by unanimous vote of Council.
Rezoning - Adolph Fine Addition
A hearing was had on the rezoning of Adolph Fine Addition from residential
to commercial and multiple dwelling use. _
IIIA petition signed by Walter H. Johnson and others was presented and read,
opposing this rezoning. A letter from Minneapolis, Northfield and Southern
Railroad in opposition to the rezoning of Lots 1 to 11, inclusive, Block 1,
Adolph Fine Addition and asking for commercial and industrial rezoning was read.
Letters from Fannie M. Worthington and D. H. Coonradt in opposition were read.
John J. Kelly, Attorney for Adolph Fine spoke in favor of rezoning. He
stated that there would be $$1,000,000.00 in new rental buildings. Mr. Fine pro-
posed to build modernistic type of buildings with four or five apartments each;
18 duplexes, 13 single dwellings, 1 commercial building.
Mr. Epstein asked how many single homes. Answer, 62, if all single homes
were built. Mr. Epstein said the area is crowded now and 162 additional build-
ings would make it more so. Mrs. Thoring appeared and opposed multiple dwel-
lings across from her home at 6200 Minnetonka Boulevard. C. W. Martzell, a
Veteran, 2941 Dakota Avenue feels that present values would go down if zoned
multiple dwelling and is opposed. H. F. Kennedy, 3124 Dakota Avenue stated that
this is the center of a large residential area and all signatures on petition
are bonafide. Mr. Epstein claimed that multiple dwelling areas blighted earlier
than residential areas. Mrs. Ormond, 3050 Dakota Avenue said she didn't see
why we need a congested area in a residential area with all the space available
in the Village. Said she moved to St. Louis Park to get away from a congested
area in Minneapolis.
F. C. Worthington; 3028 Dakota Avenue said he opposed the multiple dwelling
111 and commercial zoning as it makes for congestion and lowering of social condi-
tions. Mr. I. J. Oborn, 2921 Dakota Avenue said he moved here because of the
congestion in Minneapolis, and was was opposed to the rezoning.
Adolph Fine said that the proposed buildings are such that at no time
is more than 25% of land used per lot per building. The four-room apartments
are one bedroom only. Veterans have preference and building will have to stay
open for 60 days before a non-veteran can take over. Rents in other apartments
he has built are from $60.00 to 65.00 per month.
Dr. Bigelow, 6220 Minnetonka Boulevard opposes the rezoning. C. E. Damron,
2945 Brunswick Avenue bought a new house with the assumption that the area
would remain residential. Glenn Farmer, 2901 Oregon asked about the arrange-
ment of garages for the Appartment _Buildings. Mr. Fine said the garages would be
built along the railroad and back of the buildings.

Mr. Farmer said he could not see why we need apartments as we have no
large factories or office buildings. Mr. Solie, 3046 Dakota Avenue asked what
it would do to their property. A. H. Reed said he likes the Park because it
is residential and feels that it should be kept that way. Mr. N. W. Joubert
called by !phone to voice his objection to the A. Fine rezoning project. Mr.
Lundberg, 3038 Dakota Avenue said he feels that apartments would bring heavier
traffic and our streets are safer the way they are. Mr. Weber, 3042 said he
feels that home owners are more interested in the community than apartment
dwellers. Mr. Skoglund, 2924 Brunswick Avenue said he feels that a residential
district is better than multiple dwelling and he would like to see if kept
that way.
There were approximately fifty people present.
Mr. Harris, 2940 Brunswick Avenue said he built his own home. Mentioned
the familiar ring regarding Park offer. Mr. Kennedy asked about method of
rezoning. Mr. Fine said rents will be set by FHA. It is his desire to '
build a nice district, that would furnish a number of homes and make a good '
deal for himself. Mr. DeVere asked everybody to stand who were opposed to the
rezoning. About 50 stood up.
On motion of Trustee Jorvig, seconded by Trustee Perkins, the above matter
was referred to the Committee of the Whole for checking and recommendation to
be.acted upon January 20, 1947, by unanimous vote of the Council, by roll ,call:

Mc Alpine Property -
Jack Wilson asked about the cleaning up of Mc Alpine property. He also
,requested that a light be placed on skating rink at pond located near the West-
wood Hills Golf Course, and snow cleaned off.
On motion of Trustee Jorvig, seconded by Trustee Perkins, the Northern
States Power Company was authorized to place a light at the Westwood Hills
Golf Course skating pond, by unanimous vote of the Council.
Light Survey
A light survey for North Side between-Cedar Lake Road and Wayzata Boulevard
ancPZartham and a Idaho Avenues; also on 14th Street_ from Louisiana" Avenue to
Oregon Avenue, was referred to the 'Street Department by unanimous vote of the
.Council.
Longley Garage -
Mr. English was in regarding the Longley garage. Village Attorney E. T.
Montgomery said he has an agreement drawn .up ready for signatures.
Lease Property for Parks
A letter dated January 13, 1947 from Minneapolis Northfield and Southern
Railway was read regarding lease of Lots 7 to 13, inclusive, Block 3, Del Monte
Heights Addition, St. Louis Park for Park purposes, and referred to the Park
Committee for recommendation.
Park Board Budget
A discussion regarding the 1947 Park Board budget was had with members of
the Park Board and it was suggested that an itemized budget be turned in to
the Village Clerk by January 20,° 1947.
Permission to Place Pole
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Northwest-
ern Bell Telephone Company was given permission to place one pole and anchor at
4501 West 38th Street, by unanimous vote of the Council.
Permission to Place Poles
N. S. Power Company
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Northern
States Power Company was authorized to place one pole on Inglewood Avenue be-
tween Excelsior Boulevard and 37th Street; and 2 poles on France Avenue between
' '24th Street and Basswood Road (new street), by unanimous vote of the Council.-- -

On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
verified claims were approved and the President and Clerk were authorized to

Ordinance -
On motion of Trustee Perkins, seconded by Trustee Bolmgren-, the following
Ordinance was passed by unanimous vote of the Council:
ORDINANCE No. 256
AN ORDINANCE TO PERMIT AND PROVIDE FOR THE INSTALLATION
AND MAINTENANCE OF BENCHES ON PUBLIC WALKS AND WAYS, AND ,
FOR THE REGULATION THEREOF
The Village Council of the Village of St. Louis Park do ordain as, follows:

Section 1. Courtesy Benches
A permit to install and maintain a courtesy bench on and along any public
sidewalk or way may be issued to a person by complying with the following require-
ments::
(a) Written application shall be made to the Village Clerk showing the
locationdetailed plans and specifications of each proposed bench,
advertising matter, if any, to appear thereon and such other in-
formation as shall be required by the Village Engineer.
(b) Each application shall be accompanied by a writing in such form as
the Village Attorney shall require, signed by the owners or Lessees

of the property adjacent to the portion of the street or sidewalk where each
bench is proposed to be located giving such owner's or lessees' consent to the
installation and maintenance of such bench at .the proposed location. The appli-
cant sha11, furnish therewith such evidence of ,ownership of lease as shall be
required by the Village Attorney.
(c) Each application shall be accompanied by an inspection fee of One ($1.00)
Dollar payable to the Village Treasurer for each such bench.
(d) If the application be granted, an additional permit fee of Two ($2.00)
Dollars shall be paid to the Village Treasurer for-each bench at the time the
permit is issued.
(e) All permits shall expire as of the December 31st next following the date
of issuance thereof unless renewed. Upon renewal a Two ($2.00) Dollar renewal
fee shall be payable when application for renewal is filed.

requireprior to -the expiration date of the pre-
ceeding permit. Renewal permits may be issued without further consent of the
owner of the land or lessee of the property upon which such bench is located
unless written objection to such renewal of permit shall be filed by the owner,
or lessee, with the Village Clerk not later than the first day of December
preceeding the date of expiration of the existing permit in each case.
(g) Whenever a bench for which a permit has .been issued is sold or title or
control thereof transferred or assigned, a new permit shall be required and
obtained for its maintenance.
(h) One application may be made by the same owner for issuance of permits
for several benches at similar or different locations, but a separate number
and permit shall be assigned and issued for each bench authorized to be in-
stalled and each such permit issued shall be valid only for the particular
location designated therein.
SECTION 2. BENCHES - WHERE PROHIBITED
No permit shall be issued for the installation or maintenance of any such
bench:
(a) at any location which in the judgement of the Village Council would inter-
fere with the use of the street or -sidewalk and any alley or driveway;
(b) at any location where the distance from the face of the curb to the in-
side sidewalk line is less than eight (8') feet;
(c) at any location distant more than fifty (50' ) feet from the nearest point
of intersection with a street; providing, however, _that when, in the opinion of
the Village Engineer, observance of this requirement would result in inconven-
ience or hardship, the Council may waive such requirement.
SECTION 3. DENIAL OR REVOCATION OF PERMITS -
(a) The application shall be denied if the Village Engineer shall find that
the maintenance of the bench at the proposed location would tend unduly to ob-
struct passage along any public sidewalk or public way, or to create a hazard,
or otherwise to be detrimental to the public safety, convenience or welfare.
(b) Any permit may be revoked, or the application for renewal thereof denied,
for failure to comply with the provisions of this ordinance, or for misrepresent-
ation of any material facts in the application, or for any reason which would
have been ground for denial of the original application. No revocation or de-
nial shall be made arbitrarily or inequitably as between different applicants.
(c) If the owner, or lessee of any adjacent property, shall by writing filed
with the Village Clerk on or before the first day of December preceeding the
expiration of any permit, withdraw his consent to the renewal thereof after such
expiration, the Village Clerk shall promptly notify the permittee of the filing
of such writing and shall deny the renewal of such permit unless and until such
owner or person in possession or control, shall in writing consent to such re-
newal permit being issued.
SECTION 4. INSTALLATION AND MAINTENANCE OF BENCHES
(a) When a permit is issued each such courtesy bench shall be installed

parallel with the curb and set back not less than eighteen (18") inches from_
the face of the curb.
(b) No bench shall be more. than forty-two (42") inches high nor more than
thirty (30") inches wide or seven (7') feet long over all.
(c) Each bench shall have displayed- thereon,• in a conspicuous place, the per-
.mit number.
(d) It shall be the duty of the permittee to maintain each bench at all times
111 in a safe condition at its proper location and to inspect each bench periodi-
cally in order that it may be properly maintained.
SECTION 5. ADVERTISING AND SIGNS
(a) No advertising matter or sign shall be displayed upon any bench except
only upon the front and rear surfaces of the backrest. No obscene, immoral or
indecent advertising nor political advertising of any character shall be permitted,
and all advertising shall be subject to the approval of the City Council.
(b) No advertising matter or sign on any bench shall display the words "STOP",
"LOOK", DRIVE IN", "DANGER", or any other word, phrase or symbol which might -
interfere with, mislead, or distract traffic.
SECTION 6. REMOVAL OF BENCHES
(a) Upon the revocation or expiration of any permit without renewal, if the
permittee fails promptly to remove a bench, the Village Engineer may do so within
ten (10) days after written notice given by mail directed to the address of the
permittee on file and, if the permittee shall fail .to pay the cost of removal
and storage thereof within a period of sixty (60) days after the giving of such
notice, the permittees rights in said bench shall be forfeited, but such for-
feiture shall not excuse the permittee from the payment of the cost of removal
and storage of said bench.
111 SECTION 7. BOND OR INSURANCE POLICY
(a) Before a permit shall be issued the applicant shall post or maintain with
the Village Treasurer a bond or policy of public liability insurance approved
by the Village Attorney and conditioned substantially as follows: that the per-
mittee will indemnify and save harmless the Village of St. Louis Park, its
officers, agents, and employees from any and all loss, costs, damages, expenses,
or liability which may result from or arise out of the granting of such permit,
or the installation or maintenance of such bench for which a permit is issued,
and that the permittee will pay any and all loss or damage that maybe sustained
by any person as a result of, or which may be caused by, or arise out of, such
installation or maintenance. The bond or.policy of insurance shall be maintained
in its original amount by the permittee at his expense at all times during the
period for which the permit is in effect. In the event that two or more permits
are issued to one permittee, one such bond or policy of insurance may be fur-
nished to cover two or more benches, and each such bond or policy shall be.of a
type in which coverage shall automatically be restored immediately after the
occurrence of any accident or loss from which liability may thereafter accrue.
(b) The limit of livability upon any bond or policy of insurance so posted
shall in no case be less than Five Thousand and no/100 ($5,000.00) Dollars for
a loss, bodily injufies to or death occurring to one person. The permissable
limit of liability for loss, bodily injuries, death of more than one person shall
depend upon the number of bench permits covered thereby and shall not be less
than the amount specified in the following schedule:

SECTION 12
This ordinance shall take effect and be in force from and after its publi-
cation.

Proposals Accepted •
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Plehal
Heating Company's proposal to install one Propellair 16" Type CD exhaust fan
in the garage at Street Department Building, for venting the gasses off the
floor of the building, to be connected to a 12" x 20" duct which will run down
to the floor to exhaust the heavier fumes, of $205.00, including wiring and
complete installation.was accepted; and the proposal of the Minneapolis Gas
Light Company for furnish and install a 20 gallon hot water heater in the same
building at a total cost of $114.50 ($91.00 for heater, $23.50 for installa-
tion) was accepted. Motion was passed by unanimous vote of Councilmen present.
Trustee Jorvig
Trustee Jorvig left the meeting at this time.
Ordinance
On motion of Trustee Bolmgren, seconded by Clerk Justad, the following
ordinance was passed by unanimous vote of Councilmen present:
ORDINANCE NO. 257
AN ORDINANCE AMENDING ORDINANCE NO. 219 RELATING
TO SICK LEAVE OF VILLAGE EMPLOYEES
The Village Council of the Village of St. Louis Park do ordain as follows: "
SECTION 1. SUBSECTION (C) OF SECTION 5, OF ORDINANCE NO. 219 entitled
"An Ordinance Establishing Conditions of Employment for Non-elected Officers
and Employees of the Village", adopted by the Village Council February 5, 1945,
is hereby amended to read as_follows:
" (C) SICK LEAVE. After an officer or employee has served continuously
for one year, the Council will grant him leave with full pay for actual illness,
temporary physical disability, serious illness in his immediate family, or
quarantine, not,to exceed twelve working days in one year, and an additional
leave of abscense with full pay not to exceed three working days may be granted
on account of a death in the immediate family of an officer or employee. Sick
leave not used will accumulate from year to year not to exceed sixty days.
The Council may require medical certificate of illness at any time." .
Heating & Plumbing Bonds
On motion of Clerk Justad, seconded by Trustee Bolmgren, the two bonds
with Grudem Brothers, Incorporated as principal, and the American Surety Co.
as surety, in the amount of $4,000.00 for plumbing and $1,000.00 for heating,
dated January 6, 1947; and the bond of Noble-Jenson Company as principal and
Aetna Casualty Company as surety, in the amount-of $1,000.00 for heating,
dated January 3, 1947, were accepted and approved by unanimous vote of Council-
men present.
Contractor's Bond (Mc Manus Const. Co.)
On motion of_Trustee Bolmgren, seconded by Trustee Perkins, the Contractor's
bond with Mc Manus Construction Company as principal and Western Surety Company,
Sioux Falls, South Dakota as surety, in the amount of $12,700.00, dated December
23, 1946; was approved by unanimous vote of the Council.
Petition - Alley Vacation
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the applica-
tion of Chicago, Milwaukee, St. Paul & Pacific Railroad and H. R. Burton, Inc.
for the vacation -of alley in Block 29, Rearrangement of St. Louis Park adjacent
to Lots 11 through 23 was referred to the Village Attorney and Village Engineer
for checking and recommendation by unanimous vote of Councilmen present.
Permit to Erect Sign
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the applica-
tion of Naegele Advertising Company for a permit to erect a bulletin board
(illuminated), size 14" x 51" on the East side of the Oscar Johnson building at
5508 Excelsior Boulevard, was referred to the Street Department for checking
and recommendation by -unanimous vote of Councilmen present.

Base Salary - Kenneth -Johnson
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the base
salary rate of Kenneth Johnson was set at $241.00 as of December 31, 1946, by
unanimous vote of Councilmen present.

On motion of Trustee Perkins, seconded by Trustee Bolmgren, the follow-
ing applications for 1947 licenses were approved, and the President and Clerk
were authorized to issue licenses to expire December 31, 1947, by unanimous vote

REGULAR MEETING -- JANUARY 20, 1947
A meeting of the Village Council was called to order by President
Erickson at 8:17 P. M. with the following Councilmen present at roll call:

Petition for Rezoning Denied
(Adolph Fine Property)
The Committee of the Whole recommended that the petition of Adolph Fine
for rezoning property bounded by Minnetonka Boulevard, 32nd Street, Dakota Ave-
nue and Minneapolis, Northfield and Southern Ry. tracks, from Residential to
Commercial, Multiple and Two-family Dwelling Use, be denied.
Trustee Jorvig
Trustee Jorvig arrived at this time.
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the report
of the Committee of the Whole was accepted and the petition of Adolph Fine for
rezoning property bounded by Minnetonka Boulevard, 32nd Street, Dakota Avenue
and Minneapolis, Northfield and Southern Ry. Tracks from Residential to Com- ,
mercial, Multiple and Two-family Dwelling Use, dated December 4, 1946, was
denied by unanimous vote of the Council.
Attorney Kelly asked to speak before above motion was passed, stating
again that Adolph Fine would like to build four places along the tracks. No
action was taken.
Permit for Sign Approved -
On motion of Trustee Perkins, seconded by Trustee Bolmgren,• the applica-
tion of the Naegle Sign Company for a permit to place a sign on the East wall
of the Oscar Johnson store building located at Excelsior Boulevard and Highway
No. 100 was approved by the following roll call vote: Trustee Bolmgren, Yea;
Trustee Perkins, Yea; Trustee Jorvig, Nay; President Erickson, Yea; Clerk
Justad, Yea. -
Petition for Water Main
On motion of Trustee Bolmgren, seconded by Trustee Perkins, petition
dated January 17, 1947, signed by Grant-Burke Company and others for the laying
of water main on Pennsylvania Avenue between West Lake Street and Highway No.
7, was read, and referred to the Water Department and Village Engineer for
checking and recommendation by unanimous vote of the Council. -
