REGULAR MEETING - AUGUST 19, 1946
A meeting of the Village Council was called to order by President Erickson
at 8:20 P. M. with the following Councilmen present at roll call:

The minutes of meeting held August 12, 1946 were read and approved as read.
Verified Claims
On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following
verified claims were approved and the President and Clerk were authorized to issue
warrants for same, by unanimous vote of the Council by the following roll call:

Bid for Moving Dirt
A bid was received from Terry Brothers for moving 4,500 cu. yds. of dirt
to Lot 81, Auditors Subdivision No. 301.
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of
Terry Brothers for 4,500 cubic yards of excavation from Lots 16, 17, 18, Auditors
Subdivision No. 301 on Glenhurst Avenue North of West 39th Street and placing
same on Lot 81, Auditors Subdivision No. 301 South of 39th Street between Ingle-
wood and Huntington was referred to the Park Board and Village Engineer by un-
animous vote of the Council.
Generator for Police Car
On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Police
Department was authorized to purchase a generator for Police Car No. 1 at an
estimated cost of $138.00, by unanimous vote of the eouncil.
Bid on Lots Accepted
The following proposals were received to_ purchase Lots 1, 2, 3, 4, 5, 8, 9,
10, Block 194, Rearrangement of St. Louis Park Addition:

On motion of Trustee Bolmgren, seconded by Trustee Perkins, the offer of
Paul -R. Nelson of $950.00 for Lots 1, •2, 3, 4, 5, 8, 9, 10, Block 194, Rearrange-
ment -of St. Louis Park Addition was accepted and the President and Clerk were
authorized to execute and deliver Quit Claim Deed in behalf of the Village, con-
, veying above listed lots. Motion was passed by-unanimous vote of the Council.
Hearing - Rezoning •
• A hearing was had on the petition of Kenneth A. Nelson for rezoning the
following described property: That part of the Northwest quarter of the Northwest
quarter, Section 7, Township 28, Range 24, lying South of the North 443.71 feet
of said Northwest quarter of the Northwest quarter and within the West 135.84 •
feet -thereof. No one appeared.
Ordinance •
- On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
Ordinance was passed by unanimous vote of the Council:

AN ORDINANCE AMENDING THE ZONING ORDINANCE •
OF THE VILLAGE OF. ST. LOUIS PARK
. The Village Council of the Village of St. •Louis Park do ordain as follows:
• Section 1. The Zoning Ordinance of the Village of St. Louis Park adopted -
by the Village Council January 20, 1932 as heretofore amended is hereby amended
by deleting the following described portion of the Village included within the
Nultiple Dwelling Use District and including the- same within the Commercial Use
District as defined in said Ordinance:

• "That part of the Northwest quarter of the- Northwest quarter, Section 7,
Township 28, Range 24, lying South of the North 443.71 feet of said Northwest
quarter of the Northwest quarter and within the West 135.84 feet thereof".
- Section 2. This Ordinance shall take effect from and after its publication.
Transfer Taxicab Licenses •
- A letter dated August 19, 1946, from John R. Smith operating the Green
and White Cab Company was read, in which he requested that his taxicab licenses
be transferred to Clarence C. Mc Kay and Willard Berg, both veterans.
. On motion of Trustee Perkins, seconded by Trustee Jorvig, the above request
for transfer of licenses was approved subject to• the approval of the Police
Department, by unanimous vote of the Council. •

Protest Gravel Excavation -
, A petition signed.by Henry Mauel, 3343 Gorham Avenue and others protesting
the proposed State Highway Department gravel excavation in Block 174 from Alley
to Walker Street and from Lake Street to 1st Street NW was presented. The matter
was laid over to September 3rd and the Village Attorney was asked to bring in an
opinion as to what action the Council could take-to stop the opening of gravel
pit. .

Complaints - McAlpine, Longley
Properties
Mr. Wilson of the Northside Improvement Association and others appeared
in opposition to activities of Walter McAlpine at 13th & Kentucky; also at the
Longley garage at Maryland & Franklin. The Village Attorney was asked to write
to Alfred E. Lindahl, 5612 Vermont Street regarding the activities at Longley's
garage property and the Clerk was asked to write to Mr. McAlpine asking him to
appear at the next Council meeting, August 26, 1946 to discuss commercial acti-
vities being carried on on Kentucky Avenue between Wayzata Boulevard and 14th
Street.
President Erickson Leaves
President Erickson left the meeting at this time - 9:45 P. M. Trustee
Perkins presided during the balance of the meeting.
Halvorsen' Garage
Mr. Brown appeared and asked what progress was being made on the moving of
Mr. Halvorsen' s garage. The Village Attorney was asked to proceed as directed
in meeting of August 12, 1946.
Government Lot Line
N. W. Joubert appeared regarding Earl Clark's request regarding Government
Lot Line on 42nd Street. On motion of Trustee Bolmgren, seconded by Trustee
Jorvig, the Village Engineer was instructed to establish Government Lot Line be-
tween Lots 8 and 5, by unanimous vote of Councilmen present.
Hearing - Sewer Assessment _
A hearing was had on the sewer assessments described in the following reso-
lution. No one appeared.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all members of the Council present:
RESOLUTION LEVYING ASSESSMENT FOR SEWER DISTRICT
NO. 1-H & 1-J
WHEREAS, pursuant to notice published in the St. Louis Park Dispatch,
August 2, 1946, the Village Council has met at the time and place specified there-
in and no objections have been filed to proposed assessments for sanitary sewers
constructed for Sanitary Sewer District No. 1-J, in Utica Avenue from the South
line of Block 2, American Security Investment Company's Oak Terrace to 28th St.;
and for Sanitary ?Sewer District No. 1-H in Dakota Avenue from Minnetonka Blvd.
to 28th Street, and in Xenwood Avenue from a point 270 feet North of 29th Street
to the existing Joint District Sewer, therefore,
BE IT RESOLVED by the Village. Council of the Village of St. Louis Park that
said proposed assessments be hereby affirmed and adopted and shall constitute
the special assessment against the lands named therein, and each lot, piece or
parcel of land included in said assessments is hereby found to be benefited by
said improvements in the amount of the assessment levied against it, and
BE IT FURTHER RESOLVED that such assessments shall be payable in equal
annual installments over a period of ten years, the first installment to be pay-
able on the first day of January, 1947, and succeeding installments on the first
day in each year thereafter until the full amount of said assessment ,is paid.
Said assessments and each installment thereof shall bear interest at the rate of
four (4%) per cent per annum until fully paid, said interest to be computed from
the date of this resolution. Said special assessments with the accruing interest
thereon shall be a paramount lien upon the property included therein from the
time of the adoption of this resolution and shall remain such lien until fully
paid, as authorized by Chapter 312, Laws of Minnesota, 1903, as amended, and
BE IT FURTHER RESOLVED that all moneys collected or any such special
assessments shall constitute a fund for the payment of the cost of the said
improvements for the respective Districts for which such assessments were made,
and the same shall be credited to the proper sewer district fund under the
designation: Fund of Sewer District No. 1-J and 1-H, respectively.
Advertise for Bids
Motor Grader
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Clerk was
authorized to advertise for bids on motor grader as per specifications on file in
office of the Village Clerk. Motion was passed by unanimous vote of Councilmen
present.

Petition for Curb & Gutter
c A petition dated August 14, 1946, signed by W. Y. Ormond, 3050 Dakota
Avenue, St. Louis Park and others for construction of curb and gutter on the West
side of Dakota Avenue between Minnetonka Boulevard and West 31st Street was read.
' On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above petition
was referred to the Village Attorney and Village Engineer for checking and recom-
mendations, by unanimous vote of Councilmen present.
Petition to Vacate Street
A petition dated August 15, 1946, signed by National Lead Company, St. Louis
Park, Minnesota and others for the vacation of South Street (adjacent to Lots 15
to 26, inclusive, Block 38, Rearrangement of St. Louis Park; Lots 28, 29,-Block
37, Rearrangement of St. Louis Park, and Lot 2, Block 51, Rearrangement of St.
Louis Park) from Hampshire Avenue East of Minneapolis, Northfield and Southern
Railroad Tracks, was read.
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above peti-
tion was referred to the Planning Commission for checking and recommendation, by
unanimous vote of Councilmen present.
Permission to Set Poles On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Northern
States Power Company's request to set 1 pole on 35th Street at Sumpter Avenue,
and 1 pole on 35th Street at Rhode Island Avenue, was granted by unanimous vote
of Councilmen present.
Estimates Approved
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
estimates for contract work presented to the Council by Village Engineer, J. C.
Utton were approved, and the President and Clerk were authorized to issue checks
to cover same, by unanimous vote of the Councilmen present.

Livery Stable License
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the request of
Miss A. C. McLaury, dated July 30, 1946 to change the name on Livery Stable Lic-
ense of A. C. McLaury to "AAA Stable, Incorporated" was granted, and the President
and Clerk were authorized to issue new license to read "AAA Stables, Incorporated"
to expire December 31, 1946. Motion was passed by unanimous vote of Councilmen _
present.

A letter signed by National Lead Company and others for a street sign at

for checking and recommendation by unanimous vote of Councilmen present.

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all members of the Council present:
RESOLUTION FOR ISSUANCE OF CERTIFICATES OF
INDEBTEDNESS FOR WATER MAIN CONSTRUCTION
111 WHEREAS, pursuant to resolutions of the Village Council heretofore adopted
the following water main improvements have been completed by contract, and hear-
ing on assessments covering the cost thereof has been duly set for September 9,

authorized by Chapter 425, Laws of Minnesota, 1931, as amended.
Such certificates shall be dated September 15, 1946 and shall be in denomi-
nations of $1,000.00 each with maturities as follows:
$4,000 thereof due on the 15th day of September, 1947, and
$4,000 thereof due on the 15th day.of September of each
succeeding year through and including the 15th day of
September, 1958

Said certificates will bear interest at the rate not to exceed 3% per annum
and shall be in form as follows:

interest thereon at the rate of per cent per annum,
payable semi-annually on the 1st day of September and the
1st day of March, on presentation and surrender of the
annexed interest coupons, both principal and interest pay-
able at the office of the Village Treasurer.
This certificate is one of a series of certificates
of like tenor, amount in the aggregate to Fifty-three Thousand
Dollars, issued pursuant to Chapter 425, Laws of Minnesota,
1921, and all amendments thereto, for water main construction
in said Village.
IT IS HEREBY CERTIFIED that all acts, conditions, and
things required to be done precedent to and in the issuance
of this certificate have been done and performed as required
by law.
The full faith, credit, and resources of the Village of
St. Louis Park are hereby irrevocably pledged for the prompt
payment of the principal and interest of this certificate
according to its terms.
• IN -WITNESS WHEREOF this certificate has been signed by
the President of the Village Council and the Clerk and the
corporate seal of said Village has been affixed hereto this
15th day of September, 1946.

• BE IT FURTHER RESOLVED that the Clerk is directed to publish notice in the
St. Louis Park Dispatch fixing September 9, 1946 at 8 o'clock P. M. at the Vil-
lage Hall as the time and place where bids for said certificates will be opened
and considered. The Council reserves the right to reject any and all offers,
and,
BE IT FURTHER RESOLVED that a special assessment fund is hereby created for
these improvements and the proceeds from the sale of the certificates herein
authorized shall be placed in such fund. into such fund shall be placed all moneys
received from the payment of any assessment levied on account of this fund. A
sufficient amount of moneys to provide for the payment of the principal and in-
terest of said certificates as they severally mature shall be without further
authority transferred by the Village Treasurer into such fund from the general
fund when the special assessment fund is insufficient to pay the principal and
interest of said certificates as they severally mature, but',the fund from which
said moneys have been taken or used for the payment of the principal or interest
shall be reimbursed with interest at 6% per annum from the collection of unpaid
assessments on account of such improvements.

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all members of the Couhcil present:

BE IT RESOLVED by the Village Council that resolution adopted July 22, 1946
setting hearings for curb and gutter assessment for Improvement No. L-37 be here-
by amended so as to set the assessment hearing therein provided for September 9,
1946.

resolution was adopted by unanimous vote of all members of the Council present:

BE IT RESOLVED by the Village Council of the Village of St. Louis Park that
said completed improvements be hereby accepted and that said Council will meet
on the 23rd day of September, 1946 at 8 otclock P. M. at the Village Hall in said
Village, and ascertain the amount of special benefits received by any properties
in said Village by reason of the construction of said improvements and hear the
testimony in that connection of all persons interested or whose property is
affected, who may appear in person or by attorney and present witnesses for ex-
amination.
Resolution
On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following
resolution was adopted by unanimous vote of Councilmen present:
RESOLUTION AMENDING RESOLUTION FOR CONSTRUCTION
OF SANITARY SEWERS

RESOLVED by the Village Council of the Village of St. Louis Park that
resolution adopted August 5, 1946 for construction of sanitary sewers in Sanitary
Sewer District 1-M be amended so as to provide for opening of bids September 16,
1946.
Resolution
On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following
resolution was adopted by unanimous vote of all members of the Council present:
RESOLUTION SETTING ASSESSMENT HEARINGS FOR
CURB AND GUTTER
WHEREAS, pursuant to resolution adopted by the Village Council June 17, 1946
curb and gutter improvements L-73 on the East side of Browndale Avenue from the
South line of Lot 24, Block 2, Browndale Park to Morningside Road, L-71 on the
West side of Hampshire Avenue from Minnetonka Boulevard to 31st Street, and L-72
in Inglewood Avenue adjacent to Lot 9, Block 2, Minikanda Terrace have been com-
pleted, the Clerk with the assistance of the Engineer, has calculated the proper
amount to be specially assessed for each of said improvements against every lot,
piece or parcel of land abutting upon the respective streets where said improve-
ments were made, as provided by law. Each proposed assessment is now on file
with the Clerk and open to public inspection; therefore,

BE IT RESOLVED by the Village Council that said curb and gutter improve-
ments be hereby accepted -and the Clerk be directed to cause notice to be published
in the St. Louis Park Dispatch that said Council will meet September 9, 1946 at
8 o'clock P. M. and pass upon said proposed assessments.
Hearing - Rezoning
A hearing was had on the application of Christian Stiener for rezoning of
the Northwest corner of Natchez Avenue and Minnetonka Boulevard. No one appeared.
Chairman referred this matter to the Committee of Whole.
Meeting Ajourned
The meeting was adjourned by President H. W. Perkins, pro tem at 11:30 P. M.

A special meeting of the Village Council was called to order by President
Erickson pursuant to due notice, August 26, 1946 at 8:00 P. M. with the follow-
ing Councilmen present at roll call:
Trustee Bolmgren Trustee Jorvig
President Erickson
In the absence of the Village Clerk, E. T. Montgomery, Village Attorney
was asked to act as Clerk of the meeting by President Erickson.
Sewer Bids - District #2
Bids for construction of a joint district sewer for Sanitary Joint District
Sewer #2 were received and opened as follows:

On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the foregoing
bids were referred to the Village Engineer and Sewer Committee for examination and
report by unanimous vote of Councilmen present.
Bids - Laterals, District #1-I
Bids for construction of lateral sanitary sewers in Sanitary Sewer District
1-I were received and opened as follows:

On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the foregoing
bids were referred to the Village Engineer and Sewer Committee for examination
and report by unanimous vote of Councilmen present.
Hearing .- Curb&Gutter
Separate hearings were had on petitions for curb and gutter construction
described in the following resolution. No one appeared.
Resolution -
On motion of Trustee Bolmgren, seconded by Trustee Jorvig; the following
, resolution was adopted by unanimous vote of all Council members present:
RESOLUTION FOR CURB AND GUTTER CONSTRUCTION
WHEREAS, sufficient petitions in writing have been filed with the Village
Clerk requesting construction of curb and gutter on the West side of Wooddale
Avenue between 40h Street and 41st Street and on both sides of Georgia Avenue
between 32nd Street and 33rd Street, and the Village Council has met at the
time and place specified in a notice to all property owners published in the
