Ogren, 3538 Harriet Avenue South, Minneapolis to sell milk from one (1) truck in the Village of St. Louis Park for year 1946 .was approved, and the President and Clerk were authorized to issue same to expire December 31, 1946. Motion was passed by unanimous vote of the Council. 1945 Taxes Canceled On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Clerk was authorized to sign the application for cancellation of real estate taxes on Lots 24 and 25, Block 18, The Bronx for the year 1945, as the Village acquired these lots in December, 1945 and deed was recorded February, 1946. M. with the following Councilmen present at roll call: Trustee Bolmgren Clerk Justad President Erickson Minutes The minutes of meeting held May 13, 1946 were read and approved as read. Petition for Curb & Gutter A petition dated May 9, 1946, signed by U. L. Davis, 3024 Hampshire Avenue and others for the construction of curb and gutter on the West side of Hampshire Avenue between Minnetonka Boulevard and 31st Street was read. On motion of Clerk Justad, seconded by Trustee Perkins, petition was re- ferred to the Village Engineer and Village Attorney for checking and recommenda- tion. Motion was passed by unanimous vote of Councilmen present. Petition for Water Main On motion of Trustee Bolmgren, seconded by Clerk Justad, the petition of Howard Welch and L. Mason, and others for water main extension in North Street between Pennsylvania Avenue and Taft Avenue, St. Louis Park, dated_May 17, 1946, was referred to the Village Engineer and Village Attorney for checking and recommendation by unanimous vote of Councilmen present. Petition for Sidewalk A petition dated May 1, 1946, signed by U. L. Davis, 3024 Hampshire Avenue and others for the construction of sidewalk on the West side of Hampshire Ave- nue between Minnetonka Boulevard and 31st Street; and on the South side of Minnetonka Boulevard between Hampshire and Idaho Avenues was read. On motion of Trustee Bolmgren, seconded by Clerk Justad, above petition was referred to the Village Attorney and Village Engineer for checking and recommendation, by unanimous vote of Councilmen present. —Petition for Sanitary Sewer A petition dated May 13, 1946, signed by J. 0. Johnson, 2905 Brunswick Avenue and others for the construction of sanitary sewer in Brunswick Avenue be- tween Minnetonka Boulevard and 29th Street was read. On motion of Trustee Bolmgren, seconded by Clerk Justad, the above petition was referred to the Village Attorney and Village Engineer for checking and ' recommendation, by unanimous vote of Councilmen present. E. #35 was approved by unanimous vote of Councilmen present. Permission to Place Pole On motion of Trustee Bolmgren, seconded by Clerk Jiistad, the application of the Northern States Power Company for permission to place one (1) pole on West 8(3 May 20, 1946 . 33rd Street between Idaho and Jersey Avenues (Est. No. 62-2203) was approved by unanimous vote of Councilmen present. Grading Bids Accepted Bids for grading and surfacing of Edgewood Avenue from Cedar Lake Road to Great Northern Railroad Right-fo-way, to the lines and grades, complete in every detail, as shown on the plans and specifications on file with the Village Clerk, received May 13, 1946 and tabulated by the Village Engineer were read as follows: • Terry Excavating Company $4,588.96 • M. G. Astleford Company 5,405.25 • On motion of Trustee Bolmgren, seconded by Clerk Justad, the bid of Terry Excavating Company for the grading and surfacing of Edgewood Avenue from Cedar III Lake Road to Great Northern Railroad Right-oft-way, to the lines and grades, com- . plete in every detail was considered the lowest bid of a responsible bidder re- ceived pursuant to advertisement for bids in the St. Louis Park Dispatch, and the- President and Clerk were authorized to enter into_a written contract in be- half of the Village on forms approved by the Village Attorney, by unanimous vote of Councilmen present. . Cigarette License Approved 1 On motion of Clerk Justad, seconded by Trustee Bolmgren, the application of Gordon P. Shaw, 6312 Dupont Avenue South, Richfield, for a license to sell cigarettes at 4700 Excelsior Boulevard was approved, and the President and Clerk were authorized to issue same to expire October 31, 1946. Motion was passed by unanimous vote of Councilmen present. Restaurant License Approved • • On motion of Clerk Justad, seconded by Trustee Bolmgren, the application of Gordon P. Shaw, 6312 Dupont Avenue South, Richfield, for a license to operate a restaurant was approved, and the President and Clerk were authorized to issue same to expire December 31, 1946. Motion was• passed by unanimous vote of Council- men- present. - Gas Station License - On motion of Clerk Justad, seconded by Trustee Bolmgren, the application of Ralph Larson, DBA St. Louis Park Garage, 4825 Excelsior Boulevard, St. Louis Park for a license to operate a two-pump gasoline station was approved, and the.President and Clerk were authorized to issue same to expire December 31, 1946. Motion was approved by unanimous vote of Councilmen present. Plumbing License Approved • - On motion of Trustee Bolmgren, seconded-by Clerk Justad, the application of R. E. Arthurs, DBA R. E. Arthurs Company, Plumbing & Heating Engineers, 2312 West 50th Street, Minneapolis, for a license to do plumbing work in the Village of St. Louis Park-was approved, and the President and Clerk were authorized to issue same to expire December 31, 1946. Motion was passed by unanimous vote of Councilmen present. • Restaurant License Approved . • On motion of Trustee Bolmgren, seconded by Clerk Justad, the application of Clara W. Smith, DBA Colonial Inn at 4301 Excelsior Boulevard, St. Louis Park for-a license to operate a restaurant was approved, and the President_and Clerk were authorized to issue same to expire December 31, 1946. Motion was passed by unanimous vote of Councilmen present. • Hearing • - A hearing was had on petition of Theodore Wilson and others for vacating a portion of alley adjacent to Lot 251, Norwaldo. No one-appeared. Resolution On motion of Clerk Justad, seconded by Trustee Bolmgren, the following III ' resolution was adopted by unanimous vote of all members of the Council present: .....k, RESOLUTION VACATING PORTION OF ALLEY WHEREAS, petition of all of the owners of real property fronting on the line of that portion of alley adjacent to Lot 251, Norwaldo, hereinafter des- cribed has been duly filed with the Village Clerk requesting the vacation of the same, and said Council has met at •the time and place specified in a notice dm- bracing a copy of the said petition duly published and posted and has heard all interested persons, and it appears that said portion of said alley is not used for alley purposes and the alley as platted leaves an insufficient frontage on Zarthan Avenue for Lot 251 and it is desirable that the owner of said lot be May 20, 1946 87 Resolution, Continued: given an opportunity to permanently improve the same, and the owner of adjacent Lot 1 has executed a quit claim deed to the Village dedicating the corresponding tract of land as a portion of said alley; therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that that portion of alley adjacent to Lots 1 and 251, Norwaldo, in the_Village of St. Louis Park as now dedicated and laid out and described as follows, be hereby vacated: - Commencing at the Northwest corner of Lot 251, Norwaldo; thence Northeasterly along the North- westerly line of said Lot 251 a distance of 40 feet; thence Southwesterly approximately 35 feet to a point on the East line of Zarthan Avenue which is 15 feet North of the Northeast corner of said Lot 251;' thence South along the East line of Zarthan_Avenue to place of beginning. Request for Survey A letter dated May 10, 1946 from the Lake Forest Association asking the Village Council to make a survey to investigate the possibilities of converting into a permanent lake the swamp land that lies North of Berdanss Woodridge Addn., and East of the Belt Line and South of Great Northern Railroad and Southwest of 24th Street, was read. On motion of Clerk Justad, seconded by Trustee Bolmgren, the above matter was referred to the Planning Commission by unanimous vote of Councilmen present. Request Black Topping be delayed A letter dated May 16, ,1946 from Hedberg-Freidheim Company was read, asking that the proposed project of black-topping West 36th Street between the Belt Line and Excelsior Boulevard be held up pending further discussion. On motion of Trustee Holmgren, seconded by Clerk Justad, the Clerk was instructed to write Hedberg-Freidheim Company for representation at a meeting of the Council, May 27th, 1946. Motion was passed by unanimous vote of Councilmen present. Friday, May 31st. Holiday On motion of Trustee Bolmgren, seconded by Clerk Justad, Friday, May 31st was declared a holiday with pay for all employees on the Village payroll, subject to making up the time either on a Saturday or overtime. Motion was passed by unanimous vote of Councilmen present. Breaking Street Lights A letter dated May 17, 1946 from the Northern States Power Company regard- ing the breaking of street lights. The Clerk was asked to write the School Superintendent, requesting that he call the attention of children to the danger connected with breaking of street lights. Sidewalk Bond Approved On motion of Clerk Justad, seconded by Trustee Bolmgren, Bond No. 23 467353 for sidewalk, curb and gutter construction furnished by Floyd Larson, 3131 Ala- bama Avenue, St. Louis Park as principal, and New York Casualty Company, a cor- poration of New York, New York, as surety in the amount_of $1,000.00, dated May 18, 1946 was approved by unanimous vote of Councilmen present. Trustee Perkins Trustee Perkins came in at this time - 9:12 P. M. Resolution On motion' of Clerk Justad, seconded by Trustee Bolmgren, the following resolu- tion was adopted by unanimous vote of all members of the Council present by the following roll call vote: Trustee Perkins, Yea; Trustee Bolmgren, Yea; Clerk Justad, Yea; President Erickson, Yea; , RESOLUTION SETTING HEARING FOR STREET AND ALLEY IMPROVEMENTS WHEREAS, the Village Council desires on its own motion to improve the follow- ing named streets and alleys within the corporate limits of the Village of St. Louis Park as authorized by Chapter 382, Laws of Minnesota 1903; therefore, BE IT RESOLVED that it is necessary and expedient to improve the following May 20, 1946 portions of existing streets and alleys of said Village by grading and gravel- ing to grade established by the Village Council: IMPROVE- MENT NO. M. and will at - said time and place hear all interested persons for and against said improvements ' and each of them, a separate hearing to be conducted as to each street, and de- termine whether said improvements, or any of them, shall be made; that in case said improvements, or any of them, shall be made, the total cost thereof, or so much thereof as represents the benefits received as determined by said Council, will be assessed against the lots, parts of lots, pieces or parcels of land bene- fited by said improvements. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION FOR CONSTRUCTION OF JOINT DISTRICT SEWER --WHEREAS, it appears necessary and in the public interest that a joint district sewer be constructed for Joint Sewer District No. 2, therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that joint district sewer be_ constructed for Joint Sewer District No. 2 of said Village in accordance with the plans and specifications therefor which have been prepared by the Village Engineer and filed with the Village Clerk, which plans and specifications are hereby approved together with attached Form of Contract and Instructions to Bidders, and - BE IT FURTHER RESOLVED that it would be mutually advantageous to the Village of St. Louis Park and Hopkins to enlarge the capacity of said joint sews distriT from the intersection of Wooddale Avenue and Excelsior Boulevard to the intersec= tion of France Avenue and 39th Street in order that the Village of Hopkins may have an outlet for its sewage into the Minneapolis Sewer System, and BE IT FURTHER RESOLVED that agreement for connection of the Sewer System of the Village of Hopkins to the Sewer System of the Village of St. Louis Park prepared by the Village Attorney be executed in behalf of the Village by the 111 Preside.t and Clerk, and alternate plans and specifications for said portion of Joint MDDistric _ providing a sewer of enlarged capacity as contemplated in said agreemen , : • which have been prepared by the Village Engineer and filed with the Village Clerk be hereby approved, and BE IT FURTHER RESOLVED that upon approval of said-alternate plans and speci- fications by_the Minnesota State Board of Health, the City of Minneapolis, and the Village of Hopkins, that the Clerk advertise for bids forthwith. Ordinance On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following Ordinance #240 was passed by the unanimous vote of Council members present: May 20, 1946 89 ORDINANCE NO. 240 AN ORDINANCE CREATING SANITARY SEWER DISTRICT NO. 1 I. The Village Council of the Village of St. Louis Park do ordain as follows: Section 1. There is hereby created and established a sanitary lateral sewer district in the Village of St. Louis Park to be known as Sanitary Sewer District No. 1 L",' the area of which shall be as follows: Lots 20 to 32 inclusive, Block 17, Park Manor 111 Lots 1 to 13, inclusive, Block 18, Park Manor Lots 4 to 15 inclusive, Block 15, Park Manor Lots 16 to 27 inclusive, Block 16, Park Manor Section 2. This ordinance shall take effect from and after its publication. Resolution On motion of Trustee Bolmgren, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION FOR LATERAL SEWER CONSTRUCTION-DISTRICT 1 Li WHEREAS it appears necessary and in the interest of the public that a lateral sanitary sewer be constructed in Alabama Avenue from Minnetonka Boulevard to 28th Street for Sewer District No. 1 J ,. therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that sanitary lateral sewer be constructed in Alabama Avenue from Minnetonka Boulevard to 28th Street, and BE IT FURTHER RESOLVED that plans and specifications for said sewer prepared by the Village Engineer be hereby approved and the Engineer's estimated cost of construction of such sewer filed with the Clerk, and 'BE IT FURTHER RESOLVED that the Clerk be directed to advertise for bids for construction_of said sewer, Advertise for Sewer Bids On motion of Trustee Perkins, seconded by Trustee Bolmgren, the plans and specifications for lateral sewer in Kipling Avenue from 26th Street to 27th Street, together with connecting sewer in 27th Street from Kipling to Lynn Avenues be hereby approved, and the -Clerk was authorized to advertise for bids jointly with lateral sewer in Alabama Avenue from Minnetonka Boulevard to 28th Street. lotion was passed by unanimous vote of Council members present. Request to Maintain Road To Minneapolis Golf Club On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Village Engineer was instructed to maintain road running North from Cedar Lake Road towards the Minneapolis Golg Club; and the Village Attorney to check Village's interest in this road. Motion was passed by unanimous vote of Council members present. Sodding Slopes on Vernon Avenue Authorized On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Village Engineer was authorized to do the necessary sodding of slopes on Vernon Avenue by unanimous vote of Councilmen present. • Westridge Plat Approved On motion of Trustee Jerkins, seconded by Trustee Bolmgren, the Plat of Westridge presented by Douglas Rees was approved, subject to the receipt of Bond, the amount to be set by the Village Engineer for finishing of streets, and the President and Clerk were authorized to sign Plat in the name of the Village. Motion was passed by unanimous vote of Councilmen present, Increase Donation to Co. Fair On motion of Trustee Bolmgren, seconded by Clerk Justad, the donation to the Hennepin County Agricultural Society for the County Fair was increased to $100.00 by unanimous vote of Council members present. " u 310.40 H It It u 19.50 Black-topping West 36th Street Mr. Hedberg of Hedberg & Freidheim appeared in regard to the black-topping of West 36th Street, requesting that same not be done this year. They have approximately 1700 ft. frontage and stated that the droppings from their trucks would cover the black-top quickly. President Erickson said the matter would be given attention. III Trustee Jorvig Trustee Jorvig came in during above discussion - about 9:00 P. M. Petition Against Sidewalk Alvin Dahl and David A. Andreen, owners of Lots 13 and 14, Block 2, Lenox Addition appeared with a petition against sidewalk construction on the East side of Florida Avenue which was ordered by resolution April 29, 1946. President Erickson said the matter would be referred for consideration. North Star Theatre Plan Robert Gaus of the North Star Drama Mild, Inc. appeared in regard to a - new plan for his theatre showing changes which had to be made due to shortage of certain materials. The Council members agreed that they could se no objections to present plans and told Mr. Gaus that it was up to his group to build a theatre that will be of the best material available.
