Lampe for grading of Brunswick Avenue North of Excelsior Boulevard was referred to the Village Attorney and Village Engineer for check- ing and recommendation, by unanimous vote of the Council. Water Main Extension Florida Ave. Opposed A group of citizens from Florida Avenue, between Minnetonka Boulevard and 29th Street asked if the water main extension in that block could be stopped III for the present. Those appearing were Ed. G. Bates, 2912 Florida Avenue R. H. Johnson, 2916 " " G. R. Remaner, 2904 " " , Harold Johnson, 2913 n " H. E. Stoterau, 2908 " " It was explained that this extension was petitioned for in 1945 and a hear- ing was held on September 17, 1945 to hear all objections to this extension, but records show that no one appeared. As some of the group already have water either from their own well or twe-inch extension from 29th Street, they wanted to avoid the expense of the extension at this time. President Erickson suggested that the Council take the matter under con- 5() April 8, 1946 sideration and the Clerk was asked to notify the petitioner. Building Permit Authorized Four-Flat Building On motion of Trustee Jorvig, seconded. by Trustee Perkins, the Building Inspector was authorized to issue a building permit to Wm. A. Tuscany to erect a four-flat building on Lot 3, Block 5, Meadowbrook Addition as recommended by the Planning Commission. Motion was passed by unanimous vote of the Council. County Wagon Road Vacation On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the matter of vacating County Wagon Road was deferred to May 6, 1946, by unanimous vote of the Council. Minnesota Egg Company On motion of Trustee Perkins, seconded by Trustee Jorvig, the Village Attorney was authorized to bring an action in District Court to enjoin violation of the Village Zoning Ordinance by the Minnesota Egg Company, 6006 Excelsior Boulevard. Motion was passed by unanimous vote of the Council. Heating Inspector Appointed • On motion of Trustee Perkins, seconded by Trustee Jorvig, C. H. Farmer, "1806 Natchez Avenue (KE 0156) was appointed as Heating Inspector on a fee 'basis - 75% of heating permit fees, by unanimous vote of the Council. Chairman of Water Dept. Committee President Erickson proposed H. J. Bolmgren as Chairman of the Water De- partment Committee. On motion of Trustee Jorvig, seconded by Trustee Perkins, "the recommendation of President Erickson for the appointment of Trustee 'Bolmgren as Chairman of the Water Department Committee was approved by the "unanimous vote of the Council. • 'Petitions - Grading & Gravelling, 'Sanitary Sewer Construction, Etc. • Petitions were received, signed by Roy E. Olson, for construction of 'sanitary sewer in Edgewood Avenue, from 29th to 28th Streets; and in 28th- 'Street, from Edgewood Avenue to Dakota Avenue; Alley grading and gravel11/ - ling in Block 10, Park Manor; Alley grading and•gravelling in Block 11, Park 'Manor. • On motion of Clerk Justad, seconded by Trustee Bolmgren, the above 'petitions were referred to the Village-Engineer and Village Attorney for checking and recommendation. Motion was passed by unanimous vote of the 'Council. • 'Petition - Sidewalk A petition signed by Earl C. Ware for construction of sidewalk on the "West side of Jersey Avenue, between 32nd and 33rd Streets was read. On motion of Clerk Justad, seconded by Trustee Bolmgren, the Earl C. Ware petition was referred to the Village Engineer and Village Attorney for check- ing and recommendation. Appointment to Police Civil Service COMMISSION - OSCAR L. JOHNSON President Erickson presented the name of Oscar L. Johnson for appoint- ment to the Civil Service Commission (Police) for term expiring October 1, 1948. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the appointment of Oscar L. Johnson as a member of the Police Civil-Service Commission for term expiring October 1, 1948 was approved by unanimous vote of the Council. • Animal Nuisance A report from Dr. Darby, M. D. regarding Mrs. Peterson's place at 31st Street and Inglewood was read and referred to Chief of, Police Nelson to get kennel license application and fee. Permission to Erect Poles • N. S. Meeting on Taxation On motion of Trustee Perkins, seconded by Trustee Bolmgren, the Clerk and Assessor were authorized to attend the meeting of instruction called by Commissioner of Taxation for Wednesday, April 24, 1946 in the Minneapolis Court , House at 10:00 A. M. Motion was passed by unanimous vote of the Council. Plumbing License On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the application of C. U. Clarke for a plumbing license for 1946 was approved, subject to re- ceipt of.Plumbers Bond for $4,000., and the President and Clerk were authorized to.issue same to expire December 31, 1946. Motion was approved by unanimous vote of the Council. Licenses Approved An application received from Donald B. Moritz was read, asking for transfer of licenses now held by F. J. Archambo, 4215 Excelsior Boulevard. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the application of Donald B. Moritz was approved for the following licenses and the President and Clerk were authorized to issue same to expire December 31, 1946: Motion was passed by unanimous vote of the Council. Sell milk at retail 3.2 beer, off-sale Sell soft drings Sell cigarettes Licenses Approved On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the application for licenses for 1946 made by the Minneapolis Golf Club covering the following were approved, and the President and Clerk were authorized to issue licenses to expire December 31, 1946: Sell hard liquor (Club) on-sale Sell 3.2 beer, on-sale Sell 3.2 beer, off-sale Sell cigarettes . Operate a Restaurant Motion was passed by unanimous vote of the Council. Electrical License On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the application of A. Ingebretson, DBA Electric Repair & Construction Company, for a license to do electrical work for 1946 was approved and the President and Clerk were authorized to issue license for same to expire December 31, 1946. Motion was passed by unanimous vote of the Council. Application for Settlement and Abatement of Delinquent Taxes The Clerk read from Abatement Application that Beatrice Tucker, 3541 Dupont Avenue South, Minneapolis was under the impression that she would be unable to build on Lot 23, Bassfords Addition because of.ite particular . geographic position. However, in hopes that some day the land will be usable she would like to pay the delinquent taxes and asks the Village Council to waive the interest and penalties on special assessments on said iot. On motion of Trustee Perkins, seconded by Trustee Jorvig, the interest and penalties on special assessments against Lot 23, Bassfords Addition for the years 1942, 1943, 1944 were waived by unanimous vote.of the Council. 5 2 April 8, 1946 Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of the Council: RESOLUTION CANCELING CERTAIN SANITARY SEWER ASSESSMENTS BE IT RESOLVED that the assessments levied by resolution of October 20, 1941, for Lake Street Joint District Sewer against the following lots be canceled for the reason that it now appears that each of said lots is either unsuitable for building or has been so divided that it will be impossible to use for building purposes and the President and Clerk are hereby author- ized to refund the amount paid on receipt of a verified claim signed by the taxpayer, for the years payable - 1942, $41.65; 1943, $44.45; 1944, $43.40 and 1945, $42.35 - Total $171.85: Robinson and Gregorys Subdivision of the East 76.6 acres of Lots 5 and 8, Section 9, Township 117 N, Range 21 W, Village of St. Louis Park. That part of Lot 3 lying South of a line running West at right angles from East line thereof at a, point 682 6/10 feet South from NE corner thereof. That part of Lot 3 lying South of a line running West at right angles from East line thereof at a point 682 6/10 feet South from NE corner thereof. Reduced in 1946 from $76.70 to $35.40 1947 " 74.75 " 34.50 1948 " 72.80 " 33.60 1949 " 70.85 " 32.70 1950 " 68.90 " 31.80 1951 " 66.95 " 30.90 Addressing Equipment For Water Department The purchase of addressing equipment for the Water Department was dis- cussed, and the Clerk recommended the acceptance of bid received March 12th, 1946 from the Addressograph Sales Agency for One (1) Model 700 Addressograph machine equipped with skipper lever and statement gauge at $125.50; and one (1) twelve drawer cabinet and drawers at $34.00. This was the only bid re- ceived. On motion of Trustee Perkins, seconded by Trustee Bolmgren, the bid of Addressograph Sales Agency dated March.l3, 1946 was accepted and the Clerk was authorized to issue purchase order for one (1) Model 700 Addressograph machine at $125.50; and one (1) twelve drawer cabinet and drawers at $34.00 abd sufficient 3-line, Style 0, name and address plates .to cover the water and sewer accounts. Motion was passed by unanimous vote of the Council. Licenses Approved Heating, Plumbing On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the applica- tion of-the Twin City Plumbing & Heating Company for Plumbing and Heating licenses was approved subject to getting a local address from the Twin City April 8, 1946 53 Plumbing & Heating Company to conform with the Heating Ordinance. Motion was passed by unanimous vote of the Council. Application for Permit (Duplex) The petition of John M. Gustafson for a permit to duplex his home at 2725 Toledo Avenue was referred to the Planning Commmssion for checking and recom- mendation. Date Set for Hearing On motion of Trustee Perkins, seconded by Trustee Jorvig, a hearing was set for April 29th, 1946 on the petition of, Robert and Frederick Millard for a permit to erect twe-family dwellings on Lots 26 and 26, Block 5, Meadowbrook Addition, by unanimous vote of the Council. Rezoning Denied On motion of Trustee Jorvig, seconded by Trustee Perkins, upon the recommendation of the Planning Commission in their report dated April 6, 1946, the application of Albert Kipp, 3117 Hennepin Avenue, Minneapolis for re- zoning of Lots 17, 18, 19, Block 194, Rearrangement of St. Louis Park was denied by unanimous vote of the Council. Hearing Date Set -On motion of Trustee Jorvig, seconded by Trustee Bolmgren, on the recom- mendation of the Planning Commission on the request of M. T. Bentzen, 3550 France 'Avenue South to build two (2) double bungalows on Lots 1, 2, 3, Block 2, Hankes Minikanda Vista Addition was accepted and ,a hearing was set for April 29, 1946 as required by the Zoning Ordinance. Motion was passed by unani- mous vote of the Council. Hearing Date Set On motion of Clerk Justad, seconded by Trustee Bolmgren, a hearing was set for April 29, 1946 for one two-family dwelling on Lots 29, 30, Block 3, Browndale Addition as petitioned for ,by J. F. Finn and recommended by the Planning Commission in their report of April 6, 1946. Motion was passed by unanimous vote of the Council. Building Permit Approved Quanset Hut Denied ,On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Building Inspector was authorized to issue a building permit to N. A. Jamgotch for a permanent building on Lot 5 and West 10 feet of Lot 4, Bassfords Addition, subject to 20 foot setback on Excelsior Boulevard and regulation setback on Joppa Avenue; and permit for Quanset Hut on this property was denied by unani- mous vote of the Council. Building Permit Approved Cement Block Industry On motion of Trustee Perkins, seconded by Trustee Jorvig, the Building Inspector was authorized to issue a building permit to 0. Wicks and others for a cement block industry on Lots 11 to 20, Block 68, Rearrangement of St. Louis Park as recommended by the Planning Commission in their report of April 6, 1946. Motion was passed by unanimous vote of the Council. Building Permit Approved Commercial4Residential Building On motion of Trustee Bolmgren, seconded Trustee Perkins, the Building Inspector was authorized to issue a building permit for a combination commercial and residential building on Lot 1, Block 5, Minikanda Vista Addition as-recom- mended by the Planning Commission in their report of-April 6, 1946. Motion was passed by unanimous vote of the Council. Resolution On motion of Clerk Justad, seconded by Trustee Perkins, the following resolution was adopted by unanimous vote of the Council. RESOLUTION DETERMINING SUFFICIENCY OF CURB AND GUTTER PETITIONS RESOLVED by the Village Council of the Village of St. Louis Park that petition of A. Fine Company and others for construction of curb and gutter on the West side of Edgewood Avenue ffom 31st Street to 32nd Street; and petition of Walter H. Kairies and others for construction of curb and gutter on the East side of Webster Avenue between 28th Street and 29th Street are both sufficient petitions, signed by owners of more than 35% of property fronting upon the respective streets where said improvements are to be made. 54 April 8, 1946 Ordinance On motion, of Trustee Perkins, seconded by Trustee Jorvig, the following Ordinance was passed by unanimous vote of the Council: ORDINANCE NO. 237 AN ORDINANCE ESTABLISHING A BUDGET FOR THE YEAR 1946 The Village Council of the Village of. Resolution On motion of Trustee Perkins, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of the Council: ' RESOLUTION FOR SIDEWALK CONSTRUCTION • WHEREAS, the Village Council adopted a resolution August 20, 1945 order- ing sidewalk constructed at the location hereinafter setlforth prior to October 15, 1945, which resolution was duly served on the owners of property fronting on the portions of said street where said sidewalk was to be cons- tructed as set forth in said resolution and none of said sidewalks have been constructed as ordered in said resolution, THEREFORE, BE IT RESOLVE!) by the Village Council of the Village of St. Louis Park that the Village Clerk be hereby directed to advertise for bids for construction of sidewalk on the West side of Salem Avenue from 41st St. to 42nd St., said sidewalk to be 3i inch monolithic concrete sidewalk, 5 feet in width, constructed in accordance with specifications therefor approved by the Village Engineer on file in his office, which are hereby approved. Stenrud and others for the vacation of the platted alley in Block 1, Mazey & Langams Addition, by unani- mous vote of the Council. Sidewalk, Curb & Gutter On motion of Trustee Perkins, seconded by Trustee Jorvig, the bids of John Finstad & Son received April 1, 1946 for construction of following side- walk, curb and gutter were determined to be the lowest bid of a responsible bidder and the President and Clerk were authorized to enter into a contract with them for the following construction at $1.36 per lineal foot for curb and one (1) foot gutter, and $2.24 per square yard for 32 inch monolithic sidewalk. SIDEWALK North side of Vallacher Avenue from Natchez Avenue to the Southwesterly Lot line of Lot 30, Block 3, Minikanda Vista Addition. South side of Vallacher Avenue between the Northeasterly Lot line of Lot 3 and the Southeasterly Lot line of Lot 11, Block 9, Minikanda Vista Addition. East side of Edgewood Avenue adjacent to Lots 18 to 24 inclusive, Block 1, Parkview. West side of Dakota Avenue adjacent to Lots 8, 9, and 10, Block 1, Parkview. CURB AND GUTTER Both sides of Edgewood Avenue from Minne- tonka Boulevard to 31st Street. North side of West 41st Street from Quentin Avenue to Raleigh Avenue. South side of West 38th 'Street adjacent to Lot 24 and the West half of Lot 1, Block 1, Minikanda Vista. Both sides of Lynn Avenue from West 27th Street to abandoned Great Northern Railway Right-of-way. West side of Browndale Avenue from North line of Lot 10, Block 8, Browndale, to Morningside Road, and on the North side of Morningside Road adjacent to Lot 16; Block 8, Browndale Addition. Motion was passed by unanimous vote of the Council. 1 L W April 8, 1946. Water Main Extension On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Village Engineer was' instructed to extend Village water main in Vernon Avenue South so as to connect with Minnetonka Boulevard and add same to present contract as an extra with the Contractor (Lametti & Lametti) having the job for the balance of Vernon Avenue from 29th Street South, the cost to be paid from ,Water Department funds. Motion was passed by unanimous vote of the Council. Special Permit to Connect I To Watermain On motion of Trustee Bolmgren, seconded by Trustee Perkins, a special permit was granted to Owner of Lot }5, Auditors Subdivision #318, to connect to 8 inch water main that terminates at the Northwest corner of 29th Street and Natchez Avenue, with the understanding that if and when' eight (8") III water main is extended past 5, Auditors Subdivision;1 pecial assessments will be paid. Motion was passed by unanimous vote of the Council. Sand & Gravel On motion of Trustee Perkins, seconded by Trustee Bolmgren, the proposi- tion of Landers-Norblom-Christenson Company as contained in their letter regarding bids on sand and gravel for 1946 was accepted and the Street Department was authorized to purchase sand and gravel from them until a change is made in writing. Motion was passed by unanimous vote of the Council. Meeting Adjourned Meeting was adjourned by President Erickson at 11:58 P.
