Absent; Trustee Perkins and Clerk Justad. In the absence of the Clerk, the Village Attorney, E. T. Montgomery acted as Clerk. Sewer Bids, District 1-N Bids for sewer construction in District 1-N were opened and read as follows: Phelps-Drake Company $4,535.00 " " " (Alternate 4,055.80 _ (Bid bond attached) On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the above bid was referred to the Village Engineer and Sewer Committee for checking and recom- mendation by unanimous vote of Councilmen present. III r Pump House Bid Awarded On motion of Trustee Bolmgren, seconded by Trustee Jorvig, Mc Manis Cons- truction Company of St. Paul was determined the lowest responsible bidder for pump house construction for Well #4 at the base bid of $11,997.00 plus Alternate Bid A for $700.00, making the total bid, $12,697.00, and the President and Clerk were authorized to enter into a contract with Mc Manis Construction Company in behalf of the Village. Motion was passed by unanimous vote of Councilmen pres- ent. Hearing Date Set - Grading The hearing on grading of Ottawa Avenue from Morningside Road to Littel Street was continued to December 16, 1946. Hearing - Sidewalk Assessments Separate hearings were held on proposed assessments for each of the sidewalk 4 2 P December 9, 1946 improvements described in the following resolution: No one appeared. Resolution On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council. present: SIDEWALK ASSESSMENT RESOLUTION WHEREAS, the Village Council has met at the time and place specified in a resolution adopted-November 3, 1946, which was duly served on owners of proper- ty fronting on sidewalks constructed at the following locations in said Village and has heard all testimony offered by or on behalf of all persons interested or affected by the construction of said walks: Nest side of Hampshire Avenue from 31st Street to Minne- tonka Boulevard and South side of Minnetonka Boulevard from Hampshire Avenue to Idaho Avenue. West side of Florida Avenue from Minnetonka Boulevard to 31st Street. East side of Florida Avenue from Minnetonka Boulevard to 31st Street. East side of Jersey Avenue adjacent to Lots 13 to 18, Block 6, Lenox Addition. West side of Jersey Avenue adjacent to Lots 19 to 29, Block 7, Lenox Addition. West side of Zarthan Avenue from 39th Street to Excelsior Boulevard. THEREFORE, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the amount of benefits caused by said construction to each lot, part of lot or parcel of ground fronting the portion of the Street where such walks were respectively constructed, all as set forth in the fol- lowing list, and there is hereby levied against each lot, and parcel of groundIII described in said list, and assessment in the sums respectively therein set forth which shall be a charge against the same as in State, County and Village taxes payable in three installments, the first of which shall be due con- current with taxes collected in the year 1948. • • I ' December 9, 1946 291 Hearing --- Rezoning A hearing was had on the application of Adolph Fine to rezone Lots 13 to 17, and Lot 30, Block 11, Rearrangement of St. Louis Park. B. V. Mc Mullen presented a petition signed by E. L. Koppen and others opposing the application. Mr. Don Wilson spoke in opposition, as owner of property at 34th and Brunswick, except with respect to Lot 30. The petition of E. L. Koppen and others was read. Mr. Vollmer, 6213 West 34th Street spoke in opposition on the grounds that ex- cessive parking would result. Adolph Fine spoke in support of his petition and directed attention to the approval of his petition by the Planning Commission. He stated that he proposed to erect one building on Lots 13 to 17 to house not to exceed four families. A parking area off the street is to be provided. The rezoning of Lot 30 was requested because the lot is not useful as now zoned. 111 The exterior of buildings are to be designed as a single dwelling unit. He qualified his petition as requesting limited right to erect a building in accord- ance with plans filed. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the hearing was adjourned to December 16, 1946 because an in sufficient number of Councilmen were present to act on the petition. Motion was passed by unanimous vote of Councilmen present. Rezoning Property -- Hghy. #7 & Texas Consideration was given to rezoning of property adjacent to Highway #7 at the intersection of Texas Avenue as petitioned for by Mr. Lohman. Mr. Loh- man and other property owners were present. The matter was adjourned to Dec- ember 16, 1946. Proposed Store, Medical & Dental Clinic I/ M. Mandel and D. J. Hoffman presented plans for proposed store and medical and dental clinic on the Easterly 65 feet of Lots 8, 9, and 10, Block 4, Sunset Gables Second Addition. The Planning Commission had held that a setback of six feet from Inglewood Avenue be adhered to. A request for a waiver of the setback was made. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the matter was referred to the Committee of the Whole, by unanimous vote of Council- men present. Sewer for VFW Hall 111 Truman Hedwal appeared for the Veterans of Foreign Wars Post with respect to sewer for proposed hall and requested information. Condition of Mtka. Blvd. President Erickson called the Council's attention to the condition of Minnetonka Boulevard resulting from the Minneapolis Gas Light Company's excava- tions. Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of Councilmen present. RESOLUTION PROVIDING FOR INVESTIGATION OF BUS SERVICE r, WHEREAS, the Village Council believes that public transportation furnished to residents of St. Louis Park by the Minneapolis Street Railway Company is wholly inadequate due to insufficiency of the number of buses and inconvenience of schedules and routes, and that the growth of the Village requires improve- ment in transportion facilities; therefore BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the public transportation Committee of the Council be hereby authorized and directed to make a thorough investigation of the possibilities of providing additional transportation facilities by Minneapolis Street Railway Company and competing transportation companies; therefore, BE IT FURTHER RESOLVED that the said Committee be requested to advise the Council in respect to the need for employment of transportation experts to assist the Council in such investigation. Advertise For Bids -- Pump & Piping, Well #4 On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Clerk was' authorized to advertise for bids on pump and piping for Well ##4, according to plans and specifications, to be opened January 6, 1946. Motion was passed by unanimous vote of Councilmen present. Plat of "Adolph Fine Addition" The recommendation of the Planning Commission as to acceptance of plat of 2 9 2 December 9, 1946 "Adolph Fine' s Addition" was read. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the proposed plat was approved as a tentative plat with ex- ception that LOt 22, Block 3 be dedicated as a public park and an easement for access by foot be provided over the West 10 feet of Lot 11, Block 3. This approval of the tentative plat is not to be construed as action on request for 'rezoning as indicated on the plat. Motion was passed by unanimous vote of Councilmen present. • • Application for Rezoning The application of Adolph Fine, Incorporated for rezoning of property in proposed plat of "Adolph Fine's Addition" was read and date for hearing set for January 13, 1946. Date Set for Special Meeting To Discuss Salary Increases Earl Sewall requested in behalf of the Village Employees Union, a-meeting date with the Council for discussing salary increases. December 18, 1946, at 7:30 P. M. was set as the time for a special meeting, on motion of Trustee Jorvig, seconded by Trustee Bolmgren and passed by unanimous vote of Councilmen present. Resolution Re: Separate County - Trustee Jorvig offered the following resolution: WHEREAS, the Rural Hennepin County League of Towns and Municipalities have considered the question of establishing a separate County for that area outside of the City of Minneapolis, and WHEREAS, to fully acquaint the people of Hennepin.County with the problems relating to such a move, and to determine if such action is in the best interests of the County, and to make a thorough study of the problems of the Local Govern- mental Units, the County Government, and their relation to the City of Minnea- polis, will require expenditures beyond the present means of the Rural Hennepin League of Towns and Municipalities. Now therefore, BE IT RESOLVED that the Village of St. Louis Park of Hennepin County, Minnesota do hereby approve the action of the Rural Hennepin County League of Towns and Municipalities to conduct such an investigation and study with res- pect to creating a separate -County for the rural part of Hennepin County, and to recommend it seek to raise the funds necessary to defray such costs from the various civic, business and community organizations of Rural Hennepin County. - The question was on the adoption and the roll being called, there were 3 Yeas, and 0 Nays, and so the resolution was adopted. Purchase of Site for Well #5 Approved On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the purchase of the East 300 feet of the West 400 feet of the Ni of the Ni of the NE4 of the SES,, Section 18, Township 117, Range 21 from Emil Duemke at $2,500.00 for site for Well #5 was approved, and the President and Clerk were authorized to issue warrant for same upon the approval of title by the Village Attorney, E. T. Montgomery. Motion was passed by unanimous vote of Councilmen present. Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all members of the Council present. LOUIS PARK SEWER WARRANT No. $1,000.00 The Village Treasurer of the Village of St. Louis Park, Hennepin County, Minnesota, is ordered and directed to pay the bearer out of the fund of Joint Sanitary Sewer District No. 14 the sum of p1,000.00 on the 15th day of January, 1949, and to pay interest thereon at the rate of 3i per cent per annum_ before and after maturity, payable semi-annually on the 15th day of January and the 15th day of July in each year, interest to maturity being represented by separate interest coupons hereto attached. Both principal and interest are payable at Northwestern National Bank of Minneapolis in any coin or currency which at the time of payment is legal tender for public and private debts. This is one of an issue of said sewer warrants of like date and tenor except as to maturity issued by the Village of St. Louis Park under provisions of Chapter 312, Laws of Minnesota, 1903 and amendments thereto, in anticipation of the collection of special assessments heretofore or hereafter to .be duly levied 294 December 9, 1946 Resolution, Continued: on the property benefited by the construction of sanitary sewers in Joint Sani- tary Sewer District No. 14 in said -Village, and the full faith and credit and taxing powers. of the Village have been and are hereby irrevocably pledged to the payment of the principal and interest hereof. It is hereby-certified and recited that all acts, proceedings and things required by the Constitution and Laws of the State of Minnesota to be done and performed precedent to and in the issuance of this warrant have been done and performed at the time and in the manner as required by, law and that the-issuance of this warrant will not cause the indebtedness of the Village to exceed any constitutional or statutory limitation of indebtedness. IN WITNESS WHEREOF the Village of, St. Louis Park, by the Village Council, has caused this warrant .to be executed on its behalf by the President of the Village Council and the Village Clerk on this 15th day of January, 19471 . Permission to Set Poles - ' N. S. Power Company On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the application of Northern States Power Company to erect 3 poles South of 31st Street between Louisiana Avenue and Kentucky Avenue was approved by unanimous vote of Council- men present. Date Set for Meeting Committee of Whole - A meeting of the Committee of the Whole was set for 6:30 P. M., December 16, 1946.
