294 December 9, 1946 Resolution, Continued: on the property benefited by the construction of sanitary sewers in Joint Sani- tary Sewer District No. 14 in said -Village, and the full faith and credit and taxing powers. of the Village have been and are hereby irrevocably pledged to the payment of the principal and interest hereof. It is hereby-certified and recited that all acts, proceedings and things required by the Constitution and Laws of the State of Minnesota to be done and performed precedent to and in the issuance of this warrant have been done and performed at the time and in the manner as required by, law and that the-issuance of this warrant will not cause the indebtedness of the Village to exceed any constitutional or statutory limitation of indebtedness. Building Permit for Commercial Building On motion of Trustee Bolmgren, seconded by Trustee Perkins, the Building 296 December 16, 1946 Inspector was instructed to issue a building permit for commercial building to D. J. Hoffman on Lots 8, 9, 10, Block 4, Sunset Gables Second Addition as per survey dated November 6, 1946 and blue prints dated December 3, 1946, #343; Architect Irwin E. Engler with side yard requirement on Inglewood Ave- nue be waived on the ground that hardship would result due to the irregular line of the Street. Motion was passed by unanimous vote of Councilmen present. Selling Fur Goods from Home _ (Reuben Frank) Mr. Reuben Frank, 3052 Florida appeared, in response to letter written him regarding the selling of fur goods from his home. The matter was taken under advisement on the suggestion of President Erickson. Special Permit to Connect to Water Main On motion of Trustee Bolmgren, seconded,by Trustee Perkins, a special permit was granted to the Owner of Lot 11, Block 8, Sunset Gables Second Addi- tion to connect to the 2 inch water main on Sunset Boulevard, just West of France Avenue to supply the house on said lot, the address being 2844 France Avenue with the understanding that if and when a water main is installed on France Avenue the special assessments will be.paid. Protest Permit . On motion of Trustee Perkins, seconded by Trustee Bolmgren, the petition signed by L. E. Stewart and others protesting the granting of a permit for a commercial building on the NE corner of 35th Street & Alabama. Petition for Water Main A petition dated November 29, 1946, signed by Alfred Anderson, 2921 Natchez Avenue and others for water main extension in Kentucky Avenue from Minnetonka Boulevard to 28th Street was read. On motion of Trustee Bolmgren, seconded by Trustee Perkins, petition was referred to the Village Attorney and Village Engineer for checking and recommendation by unanimous vote of Council- men present. December 16, 1946 297 Permission to Place Poles N. S. Power Company On motion of Trustee Perkins, seconded by Trustee Bolmgren, the request of the Northern States Power Company for permission to place 1 pole on Franklin Street between Jersey and Idaho Avenues; 3 poles on West 18th Street from Jersey to Idaho Avenues; and 5 poles North of West 36th Street and East of Web- ster Avenue as shown on skethes attached to request. Motion was passed by un- animous vote of Councilmen present. Phelps-Drake Company $4,055.80 _ On motion of Trustee Perkins, seconded by Trustee Bolmgren, the above bid of Phelps-Drake Company (Alternate) for the construction of sanitary lateral sewer for Sanitary Sewer District No. 1-N, in Raleigh Avenue from Minnetonka, Boulevard to 29th Street, as tabulated by Village Engineer, J. C. Utton, was de- termined the lowest bid received December 9, 1946, of responsible bidder, re- ceived pursuant to advertisement for bids in the St. Louis Park Dispatch, Novem- ber 15, 22, 29, 1946, and the President and Clerk were directed to enter into a written contract in behalf of the Village on forms approved by the Village Attorney. Motion was passed by unanimous vote of Councilmen present. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of Councilmen present: RESOLUTION REQUESTING THE COUNTY BOARD TO WIDEN EXCELSIOR BOULEVARD WHEREAS, the population of Rural Hennepin County has increased tremend- ously during the past few years, and, WHEREAS, many large manufacturing and distributing firms have located, and are about to locate in the St. Louis Park and Hopkins area, many. of them along Excelsior Boulevard, and, WHEREAS, the traffic along Excelsior Boulevard has shown a rapid increase during the past few years and will show a much greater increase in the next five years, IT IS HEREBY RESOLVED, that the Village Council of the Village of St. Louis Park join with the Village Council of the Village of Hopkins in a petition to the Honorable Board of County Commissioners of Hennepin County, to widen Excel- sior Boulevard from the Belt Line to Hopkins, and cause an immediate survey to be made so that the work can be completed before the anticipated increase of traffic occurs. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of Councilmen present: RESOLUTION CANCELING GARBAGE COLLECTION ASSESSMENT BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the following assessment levied'pursuant to resolution adopted, October 1, 1945, be hereby canceled, for the reason that home occupies both Lots 3 aid 4, Block 3, Minikanda Oaks-, and only one assessment should have been levied, and the President and Clerk are hereby authorized to refund the amount paid on receipt of a verified claim signed by the owner. Green, Partner in Lee's Sandwich Shop, 7121 Wayzata Blvd. for licences to operate a restaurant and sell cigarettes from January 1, 1947 to December 31, 1947 was approved, and the President and Clerk were authorized to issue licenses for same to expire December 31, 1947. Weiland, 31 East Hennepin Avenue, Minneapolis, dated December 9, 1946; and the application of Ettel & Franz Company, 4829 Minnetonka Boulevard, St. Louis 111 Park, for 1946 heating licenses were approved and the President and Clerk were authorized to issue same to expire December 31, 1946, by unanimous vote of Coun- cilmen present. - Letter Re: Basswood & Cedarwood A letter dated December 11, 1946, from K. T. Wiedmann, 420 Sexton Building, Minneapolis, Minnesota relative to Basswood and Cedarwood Additions was read and ordered placed on file for future reference. Hearing - Proposed Assessments . For Street Improvements Separate hearings were had on proposed assessments for Street Improvements Nos. L-2 and L-6. No one appeared. , Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: . ASSESSMENT RESOLUTION WHEREAS, pursuant to resolution of the Village Council adopted Novem ber 4, 1946 and published in the St. Louis Park Dispatch November 15, 1946, the Village Council has met at the time and place specified .in said resolution and has heard all testimony offered by interested parties in connection with proposed assessments III for each of the following street improvements: . Improvement No. L-2 - Dakota Avenue from West 33rd Street to Minnetonka Boulevard. Improvement No. L-6 - Vernon Avenue from West 2$th, Street to West 26th Street. therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that the total cost of each of said improvements is hereby determined to be in the res- pective amounts hereinafter set forth and the amount of benefits conferred by said improvements upon each lot, part of lot, piece or parcel of ground so benefited , thereby, rateably and in proportion to the special benefits conferred upon it, is _ hereby determined to be as respectively set forth in the following list, and there , is hereby levied and assessed against each lot, ,part of lot, piece or parcel of ground described therein an assessment equal to ,the' sums therein respectively set forth, as authorized by Chapter 382, Laws of Minnesota, 1903, payable in three equal annual installments, the first of which shall be payable concurrent with real - estate taxes levied in 1945 and collecped in 1946, together with a penalty of 10% if not paid in full within 30 days after publication of this resolution and interest at 6% per annum from the date of issuance of orders for financing this improvement. Resolution On motion of Trustee Perkins, seconded by Trustee Bolmgren, the following resolution was adopted by unanimous roll call vote of all members of Council pres- ent as follows: ' Trustee Perkins, Yea; Trustee Bolmgren, Yea; Clerk Justad, Yea; President Erickson, Yea: RESOLUTION FOR IMPROVEMENT OF STREET WHEREAS, pursuant to resolution adopted by the Village Council, November 4, 1946, and published in the St. Louis Park Dispatch November 15, 1946, the Village Council has met at the time and place specified therein, and heard all persons interested with reference to the proposed improvement for the street in said resolution and consideration thereof, having been regularly adjourned to this present meeting,therefore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that said proposed Improvement No. L-92 by grading to grade established by the Village Council of Ottawa Avenue from Morningside Road to Littel Street shall be undertaken, and BE IT FURTHER RESOLVED that said improvement shall be made under the direction and supervision of the Village Engineer acting as Street Commissioner of the Village in accordance with plans and specifications prepared by him and the cost reported to the Village Council for assessment as authorized by Chapter 382, Laws of Minnesota, 1903.
