2 6 4 October 28, 1946 Resolution On motion of Trustee Perkins, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of the Council: // RESOLVED that the bond of Al Johnson Construction Company as principal, and St. Paul Mercury Indemnity Company as surety, dated September 28, 1946 in the total sum of $703,158.80 in favor of the Village of St. Louis Park and the Village of Hopkins, guaranteeing performance of Sewer Contract for Joint District Sewer No. 2, dated September-16, 1946, as approved by the Village Attorney, be hereby approved and filed with the Village Clerk. Salary Set (John Balich) On motion of Trustee Perkins, seconded by Trustee Bolmgren, the salary of John Balich, while employed on the Sewer Project in District #2 was set at $1.75 per hour; and one inspector at $1.25 per hour, and 2 chainmen at $1.00 per hour were authorized for the same project, by unanimous vote of the Council. M. with the following Councilmen present at roll call: Trustee Bolmgren Trustee Jorvig Clerk Justad President Erickson Bids - Sanitary Sewer 1-N Bids were received from the following bidders for construction of sanitary sewer 1-N; in Raleigh Avenue from Minnetonka Boulevard to 29th Street: 1. Phelps-Drake Company $5,600.00 2. Lametti & Lametti 5,270.05 On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above bids were referred to the Village Engineer and Sewer Department for checking and recom- mendation econmendation by unanimous vote of Councilmen present. Minutes The minutes of meeting held October 28, 1946 were read and approved as read. Hearing - Two-family Dwelling A hearing was had on the application of August Bloom for a permit to build a two-family dwelling on Lots 176 and 177, Richmond Third Addition. Mr. August Bloom appeared in favor of his petition. Mr. G. B. Miller appeared in favor of Mr. BloomIs petition. On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the application of August Bloom for a permit to build a two-family dwelling on Lots 176, 177, Richmond Third Addition, was approved and the Building Inspector was authorized to issue a building permit for same, by unanimous vote of Councilmen present. Hearing - Two-family Dwelling • A hearing was had on the petition of Chester Thompson for a permit to build a two-family dwelling on Lot 21, Block 2, Minikanda Terrace, Second Addition. No one appeared. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the petition of Chester Thompson for a permit to build a two-family dwelling on Lot 21, Block 2, Minikanda TErrace Second Addition was approved, and the Building Inspector was 1 November 4, 1946 ,265 authorized to issue building permit for same, by unanimous vote of Councilmen present. Plumber's License Bond On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Plumber's 2(36 November 4, 1946 License Bond with Frank H. Miars of Minneapolis, Minnesota as Principal, and Commercial Casualty Insurance Company of Newark, New Hersey as Surety, dated October 28, 1946, in the amount of $4,000.00 was approved by unanimous vote of Councilmen present. Hearing -- Two-family Dwelling A hearing was had on the petition of C. K. Bros for permit to build a two- family dwelling on Lots 6 and 7, Block 7, Lenox Addition. C. K. Bros appeared in favor of his petition. After some discussion, during which Mr. Bros offered to .bring in a set of his revised plans to the Planning Commission's meeting on November 7, 1946, it was moved by Trustee Bolmgren, seconded by Trustee Jorvig that action on Mr. Bros petition be deferred to November 12, 1946. Motion was passed by unanimous vote of Councilmen present. Damages Paid - Police Car On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the check for $40.00 No. G-826042, dated October 28, 1946 from Globe Indemnity Company was accepted for all claims for damages to Police car (License No. 475 689) against Coca Cola Bottling Company of Minnesota, Inc., by reason of accident occurring October 9, 1946 at 4008 Minnetonka Boulevard, St. Louis Park, Minnesota, repairs of which were made by Dahlberg Brothers, Inc., Hopkins, Minnesota, and the Treasurer was authorized to endorse said check as directed. Motion was passed by unanimous vote of Councilmen present. Petition -- Street Light The petition of E. Werner Johnson, 2633 Monterey Avenue and others for the, installation of a street light on the corner- of 27th Street and Monterey Avenue was read. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the above petition was approved, and the Clerk directed to order installation of same, by unanimous vote of Councilmen present. Dumping Permit On motion of Trustee Bolmgren, seconded by. Trustee Jorvig, M. M. Rude was granted a thirty (30) day permit for dumping on the property known as `Rice Sand and.Gfavel Pit; and a permit for 1947 to operate- a Public Dump on the same property, was approved by unanimous vote of Councilmen present. Licenses Approved On motion of Trustee Bolmgren, seconded by. Trustee Jorvig, the application of William Splan for licenses to sell 3.2cbeer off-sale; cigarettes; and soft drinks for year 1946 was approved, and the President and Clerk were authorized to issue same to expire December 31, 1946, by unanimous vote of Councilmen resent. Gas. Storage Tanks . On motion of Trustee Bolmgren, seconded by Trustee Jorvig, a special permit was granted to M. M. Rude for construction and installation of nine (9) 10,000 gallon tanks for storage of gasoline and fuel oil, to be constructed'14 feet high with the tops of tanks not to be more than seven. (7) feet above the level of Ex- celsior Boulevard on location shown on drawing prepared by R. W. Farnsworth, dated September 3, 1946 and filed with the Clerk; and permit was also granted to M. M. Rude to use warehouse space in proposed filling station building, shown on said plans for storage of petroleum products in metal drums and containers, sub- ject to regulatory ordinances and laws. Motion.wws passed by unanimous vote of Councilmen present. Building Permit for Gas Station . On motion of Clerk Justad, seconded by Trustee Bolmgren, the Building In- spector was authorized to issue building permit to M. M. Rude for gasoline service station an d petroleum products warehouse on the .front end of Rice Sand & Gravel Pit .property facing Excelsior Boulevard. Motion.was passed by unanimous vote of Councilmen present. Lindahl Garage Mr. English and Village Attorney E. T. Montgomery discussed the Lindahl garage and made arrangements to meet with their attorneys to discuss same. Estimates Approved On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following Estimates for contract work in progress was presented to the Village Council by J. C. Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution was adopted by unanimous vote of all members of'the Council present, by roll call, as follows: ; Trustee Jorvig, Yea; Trustee Bolmgren, Yea; Clerk Justad, Yea; President Erickson, Yea: RESOLUTION SETTING HEARING FOR STREET IMPROVEMENT WHEREAS, the Village Council desires on its own motion to improve the follow- ing named street within the corporate limits of the Village of St. Louis Park as authorized by Chapter 382, Laws of Minnesota, 1903, therefore, _ BE IT RESOLVED that it is necessary and expedient to improve the following portion of existing street in said ?Village by grading to grade established by the Village Council: IMPROVE- MENT NO. STREET FROM TO L-92 Ottawa Avenue Morningside Road Littel Street BE IT FURTHER RESOLVED that said Village Council will meet at the Village Hall in said Village on the 2nd day of December, 1946, at 8 o'clock P. M. and will at said time and place hear all persons interested for and against said improve- ment and determine whether said improvement shall be made; that in case said im- provement shall be made, the total cost thereof will be assessed against the lots, parts of lots, and pieces or parcels of land benefited by said improvement. 270 November 4, 1946 Resolution On motion of Trustee Bolmgren, seconded by Clerk Justad, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION FOR CONDEMNATION OF LAND FOR STREET PURPOSES WHEREAS, it appears to the Village Council that Lots 8 and 9, Block 3, Brookside, are a proper and desirable site for Well No. 5 for the Village Water Supply System and said site has been approved by the State Board of Health; there- fore, BE IT RESOLVED by the Village Council of the Village of St. Louis Park that it is necessary to take said Lots 8 and 9, Block 3, Brookside, according to the plat thereof on file and of record in the office of the Register of Deeds of Hennepin-County, Minnesota] for use as a site for a well and pump house for Vil- lage Water Supply System; that the persons appearing of record and known to-be owners thereof are: Lot 8, Block 3, Brookside S. H. Holt Lot 9, Block 3, Brookside Edith K. Brown therefore, BE IT FURTHER RESOLVED that the Village Attorney is hereby authorized and directed to prepare and file in behalf of the Village a petition in condemnation proceedings in the District Court of Hennepin County, Minnesota, for condemnation of the property herein described and to prosecute said proceeding to. the end that the Village may take and acquire the said property. Sewer Contract Modified On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the Village En- gineer was authorized to modify the contract of Al Johnson Construction Company for construction of Joint District Sewer for Joint Sewer District #2 by substitu- tiori -of vitrified double strength clay pipe 'in sizes 12 inch, 15 inch, 18 inch and 21 inch at the prices specified in the Contractor's bid in place of reinforced concrete pipe due to Contractor's report of unavailability of reinforced con- crete pipe in these sizes. Motion was passed by unanimous vote of Councilmen pre sent. Order to Proceed - Joint District Sewer Joint District Sewer No. 2 On motion of Trustee Bolmgren, seconded by Trustee Jorvig.that on receipt of opinion of Village Attorney approving the sewer warrants, the Village Engineer was authorized to notify the Contractors, Al Johnson Company to proceed with the work of construction of Joint District ,Sewer in Joint Sewer District #2, by unani- mous vote of Councilmen present. Ordinance On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following Ordinance was passed by unanimous vote of Councilmen present: ORDINANCE NO. 252 AN ORDINANCE AMENDING ORDINANCE NO. 241 ESTABLISHING STORM SEWER DISTRICT NO. 14 The Village Council of the Village of St. Louis Park do ordain as follows: Section 1. Ordinance No. 241 entitled "An Ordinance Creating Storm Sewer District No. 14", adopted by the Village Council, June 3, 1946 is hereby amended to read as follows: "Section 1. There is hereby created and established a storm sewer district in the Village of St. Louis Park to be known as Storm Sewer District No. 14, the boundaries of which shall be as follows: Commencing at the SW corner of Lot 1, Block 1, Brooklawns; thence North along the Wrest line of Lots 1 to 17, inclusive, said Block 1, to the NW corner of said Lot 17; thence East along the North line of said Lot 17 to the NE corner thereof; thence NEly to the NW corner of Lot 15, Block 2, Brooklawns; thence East along the North line_of said Lot 15 to the NE corner thereof; thence South along the East line of said Lot 15 to the SE corner thereof; thence along the South line of , November 4, 1946 27 Lot 24, said Block 2, to the SE corner thereof; thence SEly to the NW corner of Lot 36, Block 1, Brooklawns; thence East along the North line of said Lot 36 to the NE corner thereof; thence North along the Wly lot lines of Lots 38 to 46, inclusive, said Block 1, to the NW corner of said Lot 46; thence East along the North line of said Lot 46 to the NEly corner of Lot 15, Block 2, Brookview Park; thence SEly along the Sally line of the right-of-way of Minneapolis, Northfield & Southern Railway to Excelsior Boulevard; thence Sally along the NWly line of Excelsior Boulevard to the point of beginning." 111 j Section 2. Resolution On motion of Clerk Justad, -seconded by Trustee Bolmgren, the following resolution was adopted by unanimous vote of all members of the Council present: RESOLUTION SETTING ASSESSMENT HEARINGS b WHEREAS, pursuant to resolution duly adopted April 1, 1946,/the Village Council the following street improvements have been compleed within 30 days prior hereto: IMPROVEMENT NUMBER LOCATION L-2 Dakota Avenue from West 33rd Street to Minnetonka Boulevard L-6 Vernon Avenue from West 28th Street to West 26th Street therefore, BE IT RESOLVED by the Village Council of the Village of Ste Louis Park that said completed improvements be hereby accepted and that said Council will meet on the 16th day of December, 1946 at 8 o'clock P. M. at the Village Hall in said Village, and ascertain the amount of special benefits received by any properties in said Village by reason of the construction of said improvements and hear the testimony in that connection of all persons interested or whose property is affect- ed, who may appear in person or by attorney and present witnesses for examination. Resolution On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following resolution -was adopted by unanimous vote of all members of the Council present: RESOLUTION SETTING ASSESSMENT HEARINGS WHEREAS, pursuant to resolutions of the Village Council heretofore adopted construction of sidewalks has been completed within thirty days prior hereto at the following locations in said Village: West side of Hampshire Avenue from 31st Street to Minnetonka Boulevard and South side of Minnetonka Boulevard from Hamp- shire Avenue to Idaho Avenue. West side of Florida Avenue from Minnetonka Boulevard to 31st Street. East Side of Florida Avenue from Minnetonka Boulevard to 31st Street 111 I East side of Jersey Avenue adjacent to Lots 13 to 18, Block 6, Lenox Addition. West side of Jersey Avenue adjacent to Lots 19 to 29, Block 7, Lenox Addition. West side of Zarthan Avenue from 39th Street to Excelsior Boulevard. Therefore, BE IT RESOLVED by the Village Council of the Village of St.- Louis Park that said Council will meet at the Village Hall in said Village on the 9th day of Dec- ember, 1946 and will at said, time and place hear testimony of all persons interested 27 2 November 4, 1946 or affected and ascertain the amount of benefits to property fronting such sidewalks by reason of the construction thereof. Easement Accepted On motion of Trustee Jorvig, seconded by Trustee Bolmgren, the easement for part of Lot 2, Block 2, Highwood Tract, Lake Forest Addition from Walter H. Edlund and Ethel M. Edlund for the purpose of cutting hill on corner to allow a clear view, was accepted by the unanimous vote of Councilmen present. Level Corner of Highwood Road and Glenhurst Ave. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the Village ` Engineer was authorized to proceed to level the corner down on the corner of Highwood Road and Glenhurst Avenue on the space covered in the easement above mentioned for Lot 2, Block 2, Highwood Tract, Lake Forest Addition, by unanimous vote of Councilmen present. Hearing - Rezoning A hearing was had on the petition of Elmer Ffoberg for the rezoning of the following property from Residential and Open Development Use to Commercial Use: "The East i of Tract commencing at the SW corner of the SE4 of SE4; thence North to NW corner thereof; thence East 438.5 feet; thence South to a point 437.8 feet East from beginning; thence West to beginning: Section 7, Township 117, Range 21 containing 5.73 acres." Mrs. Westling, 8550 Minnetonka Boulevard appeared and said that she had no objection to the rezoning. Mr. Elmer Froberg appeared in favor of his petition. A hearing was also had on the petition of M. M. Rude for rezoning the follow- ing described property to Light Industrial Use: " "3.32 acres lying North of Excelsior Boulevard in the NW- of the NWI, Section 7, Township 28, Range 24, described as follows: Commenc- ing at a point on the East line of said NWS of NW , 543.24 feet S of the NE corner thereof; thence West 400.8 feet;-thence South to Excelsior Boulevard; thence NE along the North line of Excelsior Boulevard to the East line of said NW,, of NW's; thence North along - Ill said line to point of beginning." - Mr. Farnsworth representing M. M. Rude appeared in favor of the petition and presented a petition signed by property owners and swellers near the property in question who also were in favor of rezoning. On motion of Trustee Bolmgren, seconded by Trustee Jorvig, the following Ordinance amending the zoning ordinance was passed by unanimous vote of Council- men present: ORDINANCE NO. 253 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF ST. LOUIS PARK The Tillage Council of the Village of St. Louis Park do ordain as follows: Section 1. The Zoning Ordinance of the Village of St/ Louis Park adopted by the Village Council January 20, 1932 as heretofore amended.is hereby further amended by deleting the following described area of the Village now within the Residential District and adding the same to that portion of the Village within the Commercial District and subject to the restrictions imposed on such district by said Ordinance: South 150 feet at the East Half of Tract commencing at SE corner of SE of SEE; thence North to NW corner there- of; thence East 438.5 feet; thence South to a point 437.8 feet East from beginning; thence West to beginning; Sec. 7, Township 117, Range 21. Section 2.
