Council directed that a discussion occur at a study session regarding the city’s auditing firm. POLICY CONSIDERATION:  Is there a desire to finish the remaining two audit years (2016 & 2017) from the contract extension approved on October 7, 2013?  Does the Council desire to have staff work on a Request for Proposal (RFP) for audit firms that audit municipalities this fall?  Does the Council desire to have staff revisit this item after the next audit year (2016) in which one year will be remaining? SUMMARY: In 2010, staff issued a RFP for auditing services which resulted in the Council awarding a four-year auditing contract with Redpath and Company (audit for fiscal year 2010, 2011, 2012, and 2013). Given the high quality of services provided by Redpath and Company, in October, 2013 the Council authorized a one year extension (2014 audit) and up to three (3) additional extensions thru the 2017 audit. POLICY CONSIDERATION: Does the City Council wish to proceed with the contract extension for auditing services with HLB Tautges Redpath, LTD for 2014 - 2017? SUMMARY: In December 2010, the City Council approved a contract for auditing services for fiscal year 2010 with three option years after that with HLB Tautges Redpath, LTD. Staff has been extremely satisfied with the high quality work, integrity, professionalism and industry knowledge displayed by Tautges during the last three audit years. In addition, staff meets quarterly with Tautges to discuss City business and opportunities to partner together to achieve results. Some examples are creating a smooth transition plan for the consolidation of the Park and Recreation Fund into the General Fund as required after the reorganization, and staff worked with both Tautges and Hennepin County to obtain more detailed information related to property taxes, including working with the County as they implement a new property tax hardware and software system over the next few years. Finally, they have helped us with efficiencies in general with the audit process. This was based on an RFP and receipt of seven proposals from CPA firms. After review of information and interviews, Council made the decision to hire a new auditing firm, HLB Tautges Redpath LTD, to conduct the audit for the year 2010 and also approve the contract for auditing services through auditing fiscal year 2013. Proposals were also received for single audits which are required if the City expends $500,000 or more of Federal assistance. The current contract with HLB Tautges Redpath, LTD includes auditing services for the 2013 financial year and will be $52,700, not including single audit. Funds for this service are budgeted in the general fund. As discussed in the Council report, the work done by this firm has been very thorough and they have provided opportunities to advance some financial systems for the City. HLB Tautges Redpath, LTD has also been an excellent source for problem solving of unique financial situations as well as a source of education for staff. HLB Tautges Redpath, LTD provides timely information to Council along with high quality informational sessions, allowing for answering questions with Council. Below are the fees for audit services for years 2014 through 2017. Staff is recommending approval of HLB Tautges Redpath, LTD for auditing services for 2014 and authorizing the City Manager to approve the auditing service contract for 2015 - 2017. This item is being brought back for further discussion at the request of the City Council. Representatives from the American Legion will be in attendance at the meeting. POLICY CONSIDERATION: Does the Council want to move forward with an ordinance amendment to formally exempt the holders of Club On-Sale liquor licenses from the requirement to have at least 50% of the establishment’s gross receipts attributable to the sale of food? SUMMARY: On May 9, 2016 the City Council reviewed a request from Frank Lundberg American Legion Post 282 for consideration of an ordinance amendment that would formally exempt the holders of a Club On-Sale Intoxicating liquor license from the requirement that at least 50% of the gross receipts of the establishment be attributable to the sale of food. At that time the Council directed staff to schedule a formal discussion with the American Legion regarding their request. The American Legion currently holds Club On-Sale Intoxicating and On-Sale Sunday liquor licenses and is considering relocating to a new facility on Walker Street. For reasons that are not clear the Legion has not been required to meet the food-liquor ratio requirement for a number of years. However, staff has made it clear that if the Legion were to move to a new location, it was expected they would meet the food-liquor ratio standard. Prior to finalizing a lease agreement for a new facility, the American Legion has requested a formal exemption from the food-liquor ratio requirement. The Council is asked to determine how to handle this issue once the Legion moves to its new location. The City Attorney has been consulted and has given the opinion that, unlike zoning, there is no grandfathered right to a liquor license. Each license holder is subject to the code (whether it has been amended or not) at the time a license is issued or renewed. If Council would like to allow continuance of this practice at their new location, it is recommended that approval of an exemption take place. Minnesota Statute 340A.404, Subd. 1(a)(4) allows cities to issue an on-sale intoxicating liquor license to “clubs or congressionally chartered veterans organizations with the approval of the commissioner, provided that the organization has been in existence for at least three years and liquor sales will only be to members and bona fide guests”. State statute does not require Clubs to serve food, however a Club not serving food could not be open on Sundays. In this case the Legion is not proposing to stop serving food. However, given their past sales history, they know that they will continue to be unable meet the established 50-50 food-liquor ratio. FINANCIAL OR BUDGET CONSIDERATION: The American Legion currently pays an annual license fee of $500 plus an additional $200 for the Sunday on-sale license. The current license fee for an on-sale intoxicating liquor license (not a club) is $8,750. This report is being provided to inform the Council of amendments being prepared to City Code Article IV. Zoning Districts. Division 10. Floodplain Districts as required by the Federal Emergency Management Agency and the DNR. Please inform staff of any questions or concerns you might have regarding this item. POLICY CONSIDERATION: Should the City Council approve amendments to City Code to comply with new Federal and State regulations in order for the community to remain in the National Flood Insurance Program (NFIP)? SUMMARY: The Federal Emergency Management Agency (FEMA) contacted the City of St. Louis Park on May 4, 2016 with a Letter of Final Determination (LFD) to inform the Mayor and City Council that the city’s Floodplain Ordinance must be amended to comply with new and updated Federal regulations with regards to the National Flood Insurance Program no later than November 4, 2016. The updated regulations include updating the list of properties located within the floodplain as determined by the Flood Insurance Rate Map created and managed by FEMA. The Minnesota Department of Natural Resources NFIP coordinator followed up with the city on May 12, 2016 stating that the city’s floodplain ordinance currently does not comply with the new federal regulations, and provided a newly updated model floodplain ordinance created by MNDNR for the city to use and modify as needed. The new model floodplain ordinance is intended as a guide for communities across Minnesota, and can be adapted by individual communities to best suit their needs. Staff is in the process of preparing a draft and modified model ordinance. The draft will be submitted to the DNR for their review no later than August 4, 2016. Once the draft ordinance is approved by the DNR it will be brought before the Planning Commission for a public hearing and recommendation, and City Council for adoption by November 4, 2016. This section requires that notice of final flood hazards shall be sent to the Chief Executive Officer of the community, all individual appellants, and the State Coordinating Agency, and shall be published in the Federal Register. On September 2, 2004, the Department of Homeland Security’s Federal Emergency Management Agency (FEMA) issued a Flood Insurance Rate Map (FIRM) that identified the Special Flood Hazard Areas (SFHAs), the areas that would be inundated by the flood having a 1-percent chance of being equaled or exceeded in any given year (base flood), in your community. Recently, FEMA completed a re-evaluation of flood hazards in your community. On December 31, 2005, and August 17, 2012, FEMA provided you with Preliminary copies of the Flood Insurance Study (FIS) report and FIRM that identify existing flood hazards in your community, including Base Flood Elevations (BFEs). The proposed flood hazard determinations (FHDs) for your community were published in the Star Tribune on March 29, 2013, and April 5, 2013, and in the Federal Register, at Part 67, Volume 78, Page 8180, on February 5, 2013. The statutory 90-day appeal period, which was initiated on the second newspaper publication date cited above, has ended. The proposed FHDs for your community were appealed during that time. All technical data submitted in support of the appeal have been evaluated, and the appeal has been resolved. Therefore, the FHDs for your community are considered final. The final notice for FHDs will be published in the Federal Register as soon as possible. The FIRM for your community will become effective on November 4, 2016. Before the effective date, FEMA will send you final printed copies of the FIS report and FIRM. Because the FIS establishing the FHDs for your community has been completed, certain additional requirements must be met under Section 1361 of the National Flood Insurance Act of 1968, as amended, within 6 months from the date of this letter. Prior to November 4, 2016, your community is required, as a condition of continued eligibility in the National Flood Insurance Program (NFIP), to adopt or show evidence of adoption of floodplain management regulations that meet the standards of Paragraph 60.3(d) of the enclosed NFIP regulations (44 CFR 59, etc.) by the effective date of the FIRM. These standards are the minimum requirements and do not supersede any State or local requirements of a more stringent nature. It must be emphasized that all the standards specified in Paragraph 60.3(d) of the NFIP regulations must be enacted in a legally enforceable document. Some of the standards should already have been enacted by your community in order to establish initial eligibility in the NFIP. Your community can meet any additional requirements by taking one of the following actions: • Amending existing regulations to incorporate any additional requirements of Paragraph 60.3(d); • Adopting all the standards of Paragraph 60.3(d) into one new, comprehensive set of regulations; or • Showing evidence that regulations have previously been adopted that meet or exceed the minimum requirements of Paragraph 60.3(d). Communities that fail to enact the necessary floodplain management regulations will be suspended from participation in the NFIP and subject to the prohibitions contained in Section 202(a) of the Flood Disaster Protection Act of 1973 (Public Law 93-234) as amended. In addition to your community using the FIS to manage development in the floodplain, FEMA will use the FIS to establish appropriate flood insurance rates. On the effective date of the revised FIRM, actuarial rates for flood insurance will be charged for all new structures and substantial improvements to existing structures located in the identified Special Flood Hazard Areas, the areas subject to inundation by the base flood. These rates may be higher if structures are not built in compliance with the floodplain management standards of the NFIP. The actuarial flood insurance rates increase as the lowest elevations (including basement) of new structures decrease in relation to the BFEs established for your community. This is an important consideration for new construction because building at a higher elevation can greatly reduce the cost of flood insurance. To assist your community in maintaining the FIRM, we have enclosed a Summary of Map Actions to document previous Letter of Map Change (LOMC) actions (i.e., Letters of Map Amendment, Letters of Map Revision) that will be superseded when the revised FIRM panels referenced above become effective. Information on LOMCs is presented in the following four categories: (1) LOMCs for which results have been included on the revised FIRM panels; (2) LOMCs for which results could not be shown on the revised FIRM panels because of scale limitations or because the LOMC issued had determined that the lots or structures involved were outside the SFHA as shown on the FIRM; (3) LOMCs for which results have not been included on the revised FIRM panels because the flood hazard information on which the original determinations were based are being superseded by new flood hazard information; and (4) LOMCs issued for multiple lots or structures where the determination for one or more of the lots or structures cannot be revalidated through an administrative process like the LOMCs in Category 2 above. LOMCs in Category 2 will be revalidated through a single letter that reaffirms the validity of a previously issued LOMC; the letter will be sent to your community shortly before the effective date of the revised FIRM and will become effective 1 day after the revised FIRM becomes effective. For the LOMCs listed in Category 4, we will review the data previously submitted for the LOMA or LOMR request and issue a new determination for the affected properties after the revised FIRM becomes effective. The FIRM and FIS report for your community have been prepared in our countywide format, which means that flood hazard information for all jurisdictions within Hennepin County has been combined into one FIRM and FIS report. When the FIRM and FIS report are printed and distributed, your community will receive only those panels that present flood hazard information for your community. We will provide complete sets of the FIRM panels to county officials, where they will be available for review by your community. The FIRM panels have been computer-generated. These files can be used in conjunction with other thematic data for floodplain management purposes, insurance purchase and rating requirements, and many other planning applications. This report is being provided to update the Council on the status of this project. The Planning Commission is scheduled to hold a public hearing for this project on July 20 with Council consideration tentatively scheduled for August 15. POLICY CONSIDERATION: Are the proposed modifications consistent with the intent of the Planned Unit Development Ordinance? SUMMARY: Sela Group has submitted an application for a Preliminary and Final Planned Unit Development, Preliminary and Final Plat, and drainage and utility easement vacation for redevelopment of the former Vescio’s restaurant (4001 Highway 7) and ValuStay Inn site (4025 Highway 7). The sites are proposed to be combined and developed into a five story, mixed-use building with 111 residential units, approximately 8,000 square feet of commercial space, and parking located in two surface lots and in an underground parking ramp. The building will be composed of brick, stone, stucco, glass, and metal paneling and will feature a front patio and a partial green roof. A neighborhood meeting was held in February regarding the proposal. Key features include a large exterior courtyard with underground pool, fireplaces, and a private art piece, secure indoor bike parking, fitness space, business conference center, and dog run. The commercial uses anticipated at ground level are a private yoga/fitness studio and a casual dining restaurant. SRF Consulting Group completed a traffic study that concluded the access proposed for this development to be acceptable, and the surrounding roadways and intersections will operate acceptably. The PUD is needed in order to allow an increase in density from 50 units per acre to 66.7 units per acre. The PUD also provides flexibility on the building setbacks. The PUD is 1.57 acres, and Council approval is needed for a PUD under two acres. The applicant owns the adjacent property (4051 Highway 7) and is contemplating redevelopment of that site into a complimentary 5 story, mixed use building at a future date. Parkway 25 will serve as the first phase of the larger development and will incorporate many of the amenity spaces to be shared by both buildings. Please inform staff of any questions you might have. SUMMARY: Health in the Park (HIP) started as a grassroots initiative to create connections, conversations and actions to make St. Louis Park a healthier and more active community. HIP was led by volunteer residents and focused on three health topics: better eating, active connections and wellbeing (mental health). Since 2013, HIP worked to inspire healthier, more active individuals and families through activities, events and partnership with other health and community organizations. Funding for this initiative was provided by the Center for Prevention at Blue Cross and Blue Shield of Minnesota (BCBS) from 2013-2016. This funding ended as of July 1. Although the funding from BCBS has ended, efforts started by HIP will continue by the city, its partners, and its residents to continue to make St. Louis Park a city where healthy choices are possible. This will include incorporating health and wellness objectives into existing city policies, events, activities, and programs. The city will continue to collaborate with partners to support health and wellness activities. The following has been recommended by Health in the Park volunteers, staff, and partners:  Volunteer health and wellness leaders will remain intact, and will be led by the Volunteer and Wellness Coordinator. They will partner with city departments, school district and partner health initiatives, including community engagement and championing wellness at local city events.  City departments will continue to receive resident feedback on priorities related to health such as programs and policies, and review policies that impact resident health.  Partners and steering committee participants will meet 1 time per year (or more as needed) to provide updates on health initiatives and collaborate efforts.  Volunteer and Wellness Coordinator Laura Smith will serve as the health & wellness contact for city initiatives moving forward.  A healthy living grant program is being proposed in the 2017 budget. More information will be provided as the program details are confirmed.  An event inspired by the two Park the Street demonstrations will take place this fall. FINANCIAL OR BUDGET CONSIDERATION: Funds to continue this initiative are available in the 2016 HR general budget and are being included in the 2017 budget request.
