Resolution No. 25-154
Authorizing acceptance of real property and
dispensing with statutory requirements for review
by planning commission of disposal of property
Whereas, the St. Louis Park Economic Development Authority (“authority”) is the fee
owner of certain parcels of real property located in the City of St. Louis Park, County of
Hennepin, State of Minnesota, each of which is legally described as set forth in Exhibit A
attached hereto (collectively, the “properties”);
Whereas, the authority has determined that the properties are no longer needed to
further the mission and goals of the authority, and could be better used for public purposes by
the City of St. Louis Park;
Whereas, Minn. Stat. § 462.356, subd. 2, requires that the planning commission review
the city's proposed acquisitions and dispositions of real property by the city, and;
Whereas, Minn. Stat. § 462.356, subd. 2, provides for an exception from the planning
commission review requirement upon 2/3 vote of the city council dispensing with the
requirement and finding that the acquisition of real property has no relationship to the
comprehensive municipal plan.
Now therefore be it resolved by the city council of the City of St. Louis Park, Minnesota,
that:
1. The city council finds that the conveyance of the properties from the authority to
the city has no relationship to the comprehensive municipal plan;
2. Review by the planning commission of the acquisition of the properties is hereby
dispensed with;
3. The city’s acceptance of the conveyance of the properties by quit claim deed
from the authority is approved.
4. The mayor and city manager are hereby authorized to execute any documents
necessary for the conveyance of the properties.
5. City staff are directed to cause the quit claim deeds for the properties to be filed
of record in the Office of the Hennepin County Recorder or the Office of the Hennepin County
Registrar of Titles, as applicable.
